That the Ottawa Police Services Board:
1. Approve that the lessons learned from the 2012 Board Performance Evaluation Process be used to develop future board performance evaluation processes with due consideration to the continuous improvement opportunities outlined in the consultant’s report attached at Annex C.
2. Approve the actions recommended by the Policy and Governance Committee in response to the Board performance evaluation, contained in Annex D.
3. Approve that the Board’s Policy and Governance Committee be requested to work with the Board’s Executive Director to include, in the Board’s work plan, continuous improvement in the Board’s effectiveness and performance evaluation process.
4. Receive this report and forward it to City Council for information.
Que la Commission de services policiers d’Ottawa :
1. autorise l’utilisation des leçons tirées du processus d’évaluation du rendement de la Commission de 2012 pour élaborer les prochains processus d’évaluation, en tenant compte des possibilités d’amélioration continue décrites dans le rapport du consultant joint à l’annexe C;
2. approuve les mesures recommandées par le Comité des politiques et de gouvernance pour faire suite à l’évaluation du rendement de la Commission (annexe D);
3. accepte que le Comité des politiques et de gouvernance puisse être appelé à travailler avec la directrice exécutive de la Commission afin d’intégrer, au plan de travail de cette dernière, l’amélioration continue dans le processus d’évaluation du rendement et de l’efficacité de la Commission;
4. reçoive le présent rapport et le transmette au Conseil municipal pour qu’il en prenne connaissance.
4. RESOLUTION ON INTEREST ARBITRATION / RÉSOLUTION CONCERNANT L’ARBITRAGE D’UN DIFFÉREND

That the Ottawa Police Services Board approve the following resolution:
WHEREAS municipalities and police services boards continue to struggle with the escalating costs of police services, and increases in wages and benefits in the emergency services sector continue to exceed those of other public sector employees; and
WHEREAS interest arbitration is mandated by statute as a means of concluding a collective agreement for essential services when the parties are unable to reach a settlement through collective bargaining; and
WHEREAS the interest arbitration system lacks accountability and transparency because arbitrators are not required to demonstrate how their awards reflect any criteria in considering "ability to pay", and arbitration awards do not contain any consideration of the impact of increases in wages and benefits on a community's property taxes; and
WHEREAS the Emergency Services Steering Committee (ESSC) and the Association of Municipalities of Ontario (AMO) have developed a package of legislative changes that would bring more accountability and transparency to the arbitrators’ decision-making process;
THEREFORE BE IT RESOLVED that the Ottawa Police Services Board write to the Premier of Ontario, the leader of the Provincial Conservative Party and the leader of the Provincial New Democratic Party, expressing support for the ESSC/AMO proposed legislative changes, and calling on the political parties to work together to enact them.
Que la Commission de services policiers d’Ottawa approuve la résolution suivante :
ATTENDU que les municipalités et les commissions de services policiers continuent d’être aux prises avec l’escalade des coûts des services de police et que les augmentations des salaires et des avantages sociaux dans le secteur des services d’urgence demeurent supérieures à celles consenties aux autres employés de la fonction publique;
ATTENDU que l’arbitrage d’un différend est prévu par la loi comme moyen pour conclure une convention collective dans le secteur des services essentiels, lorsque les parties n’arrivent pas à s’entendre dans le cadre de négociations collectives;
ATTENDU qu’il y a des lacunes sur le plan de l’imputabilité et de la transparence dans le système d’arbitrage de différends, puisque les arbitres ne sont pas tenus de justifier comment leur décision a tenu compte de critères comme la « capacité de payer » et que la décision arbitrale ne tient pas compte de l’incidence des augmentations de salaire et d’avantages sociaux sur les taxes foncières;
ATTENDU que le Comité directeur de la gestion des services d’urgence et l’Association des municipalités de l’Ontario (AMO) ont élaboré ensemble de modifications législatives qui pourraient permettre d’instaurer une plus grande imputabilité et transparence dans le processus de prise de décisions;
PAR CONSÉQUENT, IL EST RÉSOLU que la Commission de services policiers d’Ottawa écrive à la première ministre de l’Ontario, au chef du Parti conservateur provincial et au chef du Nouveau Parti démocratique, pour exprimer son soutien aux modifications proposées par le Comité directeur de la gestion des services d’urgence et l’Association des municipalités de l’Ontario et demander aux partis politiques de travailler de concert en vue de l’adoption de ces modifications.
5. MORDEN REPORT: PROPOSED RESPONSE / ACTIONS / RAPPORT DE MORDEN : MESURES ET INTERVENTIONS PROPOSÉES

That the Ottawa Police Services Board:
1. Approve the proposed response and actions to Justice Morden’s recommendations as outlined in Annex A and direct the Review Team to develop and implement a detailed action plan.
2. Task the Policy & Governance Committee with developing, in collaboration with the Executive Director and in consultation with the Chief and staff, a Board policy that addresses the issues identified in Annex A.
3. Continue to monitor the deliberations and outcomes of the Future of Police Advisory Committee as it pertains to the accountability framework and recommended changes to legislation, regulations, and policies to the Ministry of Community Safety and Correctional Services, and provide comment as appropriate.
4. Direct the Chief to continue with an internal operational review of issues raised in major events reports, including the Morden Report.
Que la Commission de services policiers d’Ottawa :
1. approuve les mesures et les interventions proposées pour faire suite aux recommandations du juge Morden, décrites à l’annexe A, et mandate l’équipe d’examen d’élaborer et de mettre en œuvre un plan d’action détaillé;
2. mandate le Comité des politiques et de gouvernance d’élaborer, de concert avec la directrice exécutive et en consultation avec le chef et le personnel, une politique qui tient compte des problèmes mentionnés à l’annexe A;
3. continue de surveiller les délibérations et les conclusions du comité consultatif sur l’avenir des services policiers concernant le cadre de responsabilisation et les changements recommandés au ministère de la Sécurité communautaire et des Services correctionnels concernant les lois, les règlements et les politiques, ainsi que formuler des commentaires, au besoin;
4. demander au chef de poursuivre un examen opérationnel interne au sujet des questions soulevées dans les rapports sur les grands événements, dont le rapport de Morden.

That the Ottawa Police Services Board approve funding for one half of a table at the National Capital Area Crime Stoppers 2nd Annual Fundraising Gala being held on 30 May 2013 at the Ottawa Convention Centre, at a cost of $600.
