4.             WAIVER TO ENCROACHMENT BY-LAW FOR A SCULPTURE ON THE ROAD ALLOWANCE - MOTION

 

EXCEPTION AU RÈGLEMENT EN MATIÈRE D’EMPIÈTEMENT SUR LES VOIES PUBLIQUES DE LA VILLE VISANT À PERMETTRE UNE SCULPTURE SUR L’EMPRISE ROUTIÈRE – MOTION

 

 

Committee Recommendations

 

That Council recommend that Section 3(2) of the Encroachment By-law (No.2003-446), as amended, be waived to permit the installation of “The Three Watchmen” sculpture on City road allowance, subject to the following conditions:

 

1.         That the proposal undergoes an internal circulation for technical review and approval;

2.         That the National Gallery of Canada maintains the sculpture and any associated landscaping within the traffic island, at no cost to the City of Ottawa;

3.         That the National Gallery of Canada enters into an agreement with the City of Ottawa in regards to any maintenance and liability issues arising from the installation of the sculpture.

Que le Conseil renonce à l’application de l’article 3(2) du Règlement municipal sur les empiètements (Règlement no 2003-446), tel que modifié afin de permettre l’installation de la sculpture « The Three Watchmen » (les trois vigiles) sur l’emprise routière municipale, sous réserve des conditions suivantes :

 

1.         la proposition doit faire l’objet d’une diffusion interne aux fins d’examen technique et d’approbation;

2.         le Musée des beaux-arts du Canada doit assurer l’entretien de la sculpture et de l’aménagement paysager qui y est associé dans l’îlot séparateur, et ce, sans aucun frais pour la Ville d’Ottawa.

3.         le Musée des beaux-arts du Canada doit conclure une entente avec la Ville d’Ottawa concernant les questions d’entretien et de responsabilité qui pourraient découler de l’installation de ladite sculpture.

REPORT RECOMMENDATIONS

 

That the Transportation Committee recommend to Council that Section 3(2) of the Encroachment By-law (No.2003-446), as amended, be waived to permit the installation of “The Three Watchmen” sculpture on City road allowance, subject to the following conditions:

Que le Comité des transports recommande au Conseil de renoncer à l’application de l’article 3(2) du Règlement municipal sur les empiètements (Règlement no 2003-446) afin de permettre l’installation de la sculpture « The Three Watchmen » (les trois vigiles) sur l’emprise routière municipale, sous réserve des conditions suivantes :

BACKGROUND

 

Councillor Fleury moved the addition of this item at the Transportation Committee meeting of 29 June 2011:  The following motion was added and approved.

 

WHEREAS Section 3(2) of the City of Ottawa Encroachment By-law (No. 2003-446), as amended, provides that: “no person shall erect a permanent surface encroachment”;

 

AND WHEREAS the National Gallery of Canada has applied to the City of Ottawa for permission to install a sculpture entitled “The Three Watchmen” in the centre of a small triangular traffic island on City road allowance bordered by St. Patrick Street to the north, Murray Street to the south and MacKenzie Avenue to the east.

 

AND WHEREAS the placement of the sculpture on road allowance is considered a permanent surface encroachment;

 

BE IT THEREFORE RESOLVED that Section 3(2) of the Encroachment By-law  (No.2003-446), as amended, be waived to permit the installation of the sculpture on City road allowance, subject to the following conditions:

 

1.         That the proposal undergoes an internal circulation for technical review and approval;

 

2.         That the National Gallery of Canada maintains the sculpture and any associated landscaping within the traffic island, at no cost to the City of Ottawa;
