1.             APPLYING THE RURAL PATHWAYS SHARED-USE POLICY TO THE OTTAWA-CARLETON TRAILWAY

That Council:

 

1.         Approve that the Rural Pathways Shared-Use Policy be applicable to the Ottawa-Carleton Trailway, with the specific condition that snowmobiles and all other motorized vehicles and horses be prohibited on all sections of the Ottawa-Carleton Trailway east of West Ridge Road; and

 

2.                  Approve that staff undertake a review of all signage on the Ottawa-Carleton Trailway to ensure that it is consistent with the usage policy above, and satisfies notification requirements for enforcement of shared-use rules.

REPORT RECOMMENDATIONS

 

That the Joint Transportation Committee and Agriculture and Rural Affairs Committee consider the following, as referred by Council at its meeting of 10 March 2011, and submit its recommendation(s) to Council:

 

WHEREAS the Ottawa-Carleton Trailway is very similar in nature to the Prescott-Russell and Osgoode Pathways and has a similar shared-use practice and issues associated with the practices;

 

THEREFORE BE IT RESOLVED that Council approve that the Rural Pathways Shared-Use Policy be applicable to the Ottawa-Carleton Trailway, with the specific condition that snowmobiles and horses be prohibited on all sections of the Ottawa-Carleton Trailway east of West Ridge Road; and

 

BE IT FURTHER RESOLVED that staff undertake a review of all signage on the Ottawa-Carleton Trailway to ensure that it is consistent with the usage policy above, and satisfies notification requirements for enforcement of shared-use rules.

Que le Comité mixte des transports et de l’agriculture et des affaires rurales examine la motion suivante, telle que transmise par le Conseil à sa réunion du 10 mars 2011, et soumette ses recommandations au Conseil :

 

ATTENDU QUE par sa nature, le sentier Ottawa-Carleton ressemble beaucoup aux sentiers Prescott-Russell et Osgoode, que son utilisation partagée y est similaire, tout comme les problèmes associés à son utilisation;

 

PAR CONSÉQUENT, IL EST RÉSOLU QUE le Conseil approuve l’application de la Politique d’utilisation partagée des sentiers ruraux au sentier Ottawa-Carleton, à la condition expresse que les motoneiges et les chevaux soient interdits partout sur les parties du sentier Ottawa-Carleton à l’est du chemin West Ridge;

BACKGROUND

 

City Council, at its meeting held on 10 March 2011, considered the following Motion from Councillor Qadri (Motion 9/3) and, through Motion 9/4, referred same to the Joint Transportation Committee and Agriculture and Rural Affairs Committee.

CONSULTATION

 

This item will be advertised in the local dailies as part of the Public Meeting Advertisement on Friday preceding the Joint Committee meeting.

 

Comments by Planning and Growth Management Department

 

Planning and Growth Management staff are in agreement with the motion put forward by Councillor Qadri.  Its purpose is to ensure that the general terms of the rural pathway usage policy as approved by Council on 10 March 2011 apply also to the Ottawa-Carleton Trailway.  The Ottawa Carleton Trailway (running from Bells Corners towards Carleton place) has been in use for 10 years as a shared pathway.  This motion will not change these historical shared-use rules.

 

Comments by Public Works and Services

 

The Public Works Department is supportive of the motion and will work with the Planning and Growth Management Department to implement the Rural Pathways Shared Use Policy for the Ottawa Carleton Trailway, subject to approval by Council.

 

Comments by By-law and Regulatory Services

 

The By-law and Regulatory Services Branch will participate in a review of signage along the Ottawa-Carleton Trailway with a view to ensuring that it is consistent with the said usage policy and satisfies notification requirements for enforcement of applicable by-law provisions.

 

 

FINANCIAL IMPLICATIONS

 

To date, there are no financial implications associated with operating and maintenance costs, and the signage review have been identified; however, Police Services will advise on any financial implications associated with enforcement of the policy on the Ottawa Carleton Trailway.

 

 

LEGAL / RISK MANAGEMENT IMPLICATIONS

 

It should be noted that anyone entering the pathway or using it in contravention of a posted regulation on site commits an offence under the Trespass to Property Act, and therefore may be the subject of enforcement action by police. It is therefore recommended that the signs posted on this pathway be consistent with those approved on the other multi-use recreational rural pathways, Prescott-Russell and Osgoode, to assist By-law and Regulatory Services Branch and the Ottawa Police Services in enforcing the recommendations herein.

Karen Wallace Graner mentioned that the section from Stittsville Main to West Ridge Road is a residential area and there are homes bordering this particular pathway.  She spoke in support of the referral Motion, to protect the rights of residents over the recreational privilege of the users of these pathways.  Many of her comments then strayed to the item previously dealt with by Council on the Rural Pathways policy last month and the Chair reminded the delegation to ensure her comments focus on the matter currently before the Joint Committee.

 

Councillor Qadri suggested amending the first action portion of the Motion to include all other motorized vehicles.  He indicated that staff are supportive of this because the condition already exists on the trail.

That the first ‘therefore be it resolved be amended to include the following:  “and all other motorized vehicles to read as follows:
