That Council permit the introduction
of, and approve the following:
1.
That
the implementation date provided in Section 103(3) of By-law No. 2005-481
pertaining to security cameras in taxis as required in Section 37 of the By-law
be extended to July 2nd 2008; and
2. Approve that the expiry date provided in Schedule “C” of
By-law 2005-481 be amended to July 2nd in 2008 only, for the
purposes of:
a)
the renewal of standard taxi
driver licenses as provided in Section 9 (1) and the grace period provided in
Section 11 (1) of the By-law;
b)
the renewal of accessible taxi
cab driver licenses as provided in Section 13 of the By-law;
c)
the renewal of standard taxi
plate holder licenses as provided in Section 16 (1) and the grace period
provided in Section 17 (1) of the By-law;
d)
the renewal of accessible taxi
plate holder licenses as provided in Section 19 of the By-law; and
e) the
renewal of taxicab broker licenses as provided in Section 23 (1) of the By-law
and the grace period provided in Section 24 (1) of the By-law.
3. That after discussion with the Taxi
Industry and consultation with the Office of the Information and Privacy
Commissioner of Ontario, that staff prepare before the implementation date an
Access and Privacy Protocol related to the operation of the security cameras in
taxis to ensure that access and privacy concerns are addressed, as required in
applicable legislation.
Que le Conseil d’autoriser la mise en place des
mesures suivantes, et d’en approuver l’application :

Que
la date de mise en œuvre stipulée à l’article 103(3) du Règlement municipal
2005-481, concernant les caméras de surveillance dans les taxis exigées en
vertu de l’article 37 dudit règlement, soit prolongée au 2 juillet 2008;
2. Approuver le prolongement de la date
d’expiration mentionnée à l’annexe « C » du Règlement municipal
2005-481 au 2 juillet 2008, aux seules fins suivantes :
a) renouvellement des permis de chauffeur
de taxi usuel, tel que stipulé à l’article 9 (1) et délai de tolérance stipulé
à l’article 11 (1) du Règlement;
b)
renouvellement
des permis de chauffeur de taxi accessible, tel que stipulé à l’article 13 du
Règlement;
c)
renouvellement
des permis de plaque de taxi usuel, tel que stipulé à l’article 16 (1) et délai
de tolérance stipulé à l’article 17 (1) du Règlement;
d)
renouvellement
des permis de plaque de taxi accessible, tel que stipulé à l’article 19 du
Règlement;
e) renouvellement de permis de
concessionnaire de taxi, tel que stipulé à l’article 23 (1) et délai de
tolérance stipulé à l’article 24 (1) du Règlement.
3. Que,
après discussion avec le secteur du taxi et après consultation auprès du Bureau
du commissaire à l’information et à la protection de la vie privée de
l’Ontario, le personnel élabore, avant la date de mise en œuvre, un protocole
sur l’accès à l’information et la protection de la vie privée s’appliquant à
l’utilisation des caméras de surveillance dans les taxis, qui tienne compte des
préoccupations en matière d’information et de protection de la vie privée, tel
qu’exigé en vertu des lois applicables.

Committee recommend that Council permit the introduction of, and approve the

On 7 February 2008, the Community and
Protective Service Committee approved the aforementioned recommendations. Staff presented Recommendations 1 and 2 at
the meeting and Recommendation 3 was added by the Committee.

DISCUSSION
Recommendation 1
The purpose of this recommendation is to provide a brief extension of time in which taxi plate holders can install the in-vehicle security camera systems that are required in Section 37 of the Taxi By-law. Originally required to be installed by March 1, 2008, a delay until July 2nd is now sought so as to allow City Staff to review the privacy issues relating to the use of the security camera systems, including the finalizing of an access and privacy policy for the cameras that will ensure compliance with both the access and protection of privacy rules contained in the Municipal Freedom of Information and Protection of Privacy Act.
Recommendation
2
This recommendation complements Recommendation 1, by outlining amendments required to bring the license renewal dates (for taxi drivers, plate holders and brokers) in line with the above-noted extension, so that all of the administrative procedures required for these regulatory steps may be efficiently undertaken at the same time by both the licensees and City staff.
Recommendation 3
This recommendation is a direction to staff to consult with the Office of the Information and Privacy Commissioner of Ontario to develop an Access and Privacy Protocol with respect to the access and privacy policy and in order to ensure not only that all legislative requirements are adequately addressed, but also that best practices are in place from a privacy point of view.
In addition, staff will discuss above-noted access and privacy issues with members of the Taxi Industry in order to determine what its concerns are relating to the camera system and to address these concerns in the policy or by other means, as appropriate.
Consistent with Section 37(2)
of the Taxi By-law, the access and privacy policy will regulate how information
collected by the cameras will be securely accessed and used by law enforcement
personnel only as authorized by the Chief License Inspector for the purposes of law
enforcement. The processes set out in
the policy will ensure that the information recorded by the security cameras
remains under the control of the City at all times.
The policy will set out the process by which information obtained from the cameras will be disclosed to the Police in those instances where it is required for law enforcement purposes.
Finally, the policy will contain procedures for providing suitable public notification for the collection of personal information (photographic images), as well as criteria for the retention and disposal of the information, and will set out an inquires and complaint process for anyone having questions or concerns regarding how the City is regulating personal information collected by the camera systems.
CONSULTATION
Staff from the
By-law and Regulatory Services and Legal Services Branch have been consulted
with respect to both the Recommendations in question and the finalizing of the
access and privacy policy noted above.
Input from the
City’s Access and Privacy Office will also be sought on the policy.
Staff will
formally consult with the Office of the Information and Privacy Commissioner on
the policy and on related privacy best practices. Staff will engage members of
the Taxi Industry in
discussions regarding access and privacy issues related to the camera
system.
There are no financial implications related to the
recommendations.
Upon
approval by Council, By-law and Regulatory Services and Legal Services will
make the appropriate amendments to the Taxi-By-law regarding the deadlines
contained in Recommendation No. 1 and 2.
By-Law
Services Staff will undertake the consultation and discussions noted in
Recommendation No. 3.
