Waiver to the Private Approach By-law 170-73 - 911 Industrial Avenue

REPORT RECOMMENDATION


 

That the Transportation and Transit Committee recommend Council approve that Section 13(j) be waived to permit a one-way access to be located 40 feet from an arterial or collector street.

 

RECOMMANDATION DU RAPPORT

 

Que le Comité des transports et des services de transport en commun recommande au Conseil que l’application de l’article 13(j) soit suspendue afin de permettre qu’une voie d’accès à sens unique soit située à quarante (40) pieds d’une artère ou d’une voie collectrice.

 

 

BACKGROUND

 

In accordance with Section 13(j) of the Private Approach By-law 170-73, where a property abuts on or is within 150 feet of an arterial or collector street and the number of parking spaces provided are less than 99, no access is permitted within 100 feet of the arterial or collector street.

 

The primary intent of this provision of the By-law is to ensure that there is adequate separation between the proposed private approach and any arterial or collector street in order that sufficient sight distances are maintained for vehicles entering or exiting any given site.

 

Plans submitted for Site Plan Control Approval is for the construction of two, fast food restaurants which provide a drive-thru service.  The parking area will provide 64 spaces at grade.

 

Staff have reviewed the submitted plans and inspected this location, and noted the following observations.

 

The main two-way access servicing this development is off Industrial Avenue. 

 

1.      The secondary westerly access off the City’s Service Road is located approximately 40 feet from Industrial Avenue, instead of the required 100 feet separation. 

2.      The secondary westerly access will be designated as a one-way, exit only access. 

3.      The secondary westerly access will be closed when the lands to the north of this site are redeveloped. 

4.      The Service Road is a City of Ottawa street and is currently being used by City maintenance vehicles only.

 

Based upon the above observations, it is the opinion of this Branch that granting this waiver to the Private Approach By-law will not create any foreseeable vehicular or pedestrian safety issues.

 


 

ENVIRONMENTAL IMPLICATIONS

 

No environmental impact is anticipated and the recommendation is within the MEEP Automatic Exclusion List – Section I(f) Routine Operations.

 


CONSULTATION


 

No public consultation on the recommendation has taken place.  The Department believes that the westerly private approach at this site will not adversely affect established traffic patterns in the immediate area.
