In addition, the applicant may appeal the matter to the OMB if Council does not adopt an amendment within 120 days after receipt of the application

2.                  Delegate authority for minor design changes to the General Manager, Planning and Growth Management Department; and

 

3.                  Issue the heritage permit with a two-year expiry date from the date of issuance.

 

(Note: The statutory 90-day timeline for consideration of this application under the Ontario Heritage Act will expire on May 29, 2012.)

2.                  Delegate authority for minor design changes to the General Manager, Planning and Growth Management Department; and

 

3.                  Issue the heritage permit with a two-year expiry date from the date of issuance.

That the Planning Committee recommend Council approve an amendment to Zoning By law 2008-250 to change the zoning of 5649 Hazeldean Road (formerly 1774 Maple Grove Road) from Development Reserve (DR) to Residential Third Density Subzone YY Exception 1297 (R3YY[1297]) and Parks and Open Space Subzone R (O1R), and from R3YY[1297] to O1R, from O1R to R3YY[1297] and from DR to R3YY[1297]-h , as shown in Document 1 and as detailed in Document 2.

REPORT RECOMMENDATION

 

That the Planning Committee recommend Council direct staff to complete the Environmental Assessment process to identify the right-of-way for the future Centrum Boulevard Extension and bring forward the construction of a pedestrian and emergency vehicle access for future budget considerations and take no further steps to amend the Official Plan in respect of Centrum Boulevard.

Moved by Councillor B. Monette:

 

WHEREAS there is not a current need for the Centrum Boulevard Extension for automobiles and other motorized vehicles;

 

AND WHEREAS the community desires the assurance that notwithstanding the preparation of an Environmental Assessment, a road will not be constructed;

 

THEREFORE BE IT RESOLVED THAT the recommendation be amended by the addition of the following words to the end of the recommendation:

 

“Nor to construct the Centrum Boulevard Extension such as to permit motorized vehicular traffic.”

Councillor S. Blais:

 

The Zoning by-law only allows three accessory structures on one lot. Under the current definition of a building, a playhouse would constitute a structure as it has a roof, walls, and a floor and remains more or less in one location permanently. The same would apply for a gazebo or a shed. 

 

Can staff clarify if some flexibility can be read into the definition to allow homeowners to enjoy typical amenities that families enjoy? Can additional clarification be added to exempt structures that are small in size and typical in use? Rather than set a limit in the number of accessory structures, can another method be used such as percentage of lot area or some other calculation?
