The Chair read a statement relative to the Zoning By-law Amendments
listed as items 4 to 10 on the agenda.
He advised that only those who made oral submissions at the meeting or
written submissions before the amendments were adopted could appeal to the
OMB. He noted that the applicant may
also appeal the matter if Council does not adopt an amendment within 120 days
of receipt of the application. He noted that there were comment sheets
available for anyone wishing to submit written comments on these applications.
With respect to Item 1, the Chair advised that the meeting would constitute the public meeting required under Section
41.1 (6)(b) of the Ontario
Heritage Act. As such, any person
attending the meeting will be given the opportunity to make oral or written
submissions regarding the proposal. He noted that any person who did not raise
objections to the adoption of the proposed heritage conservation district plan
by making oral or written submissions may later be denied an opportunity to
appeal the passing of a by-law adopting the plan to the Ontario Municipal
Board.

The
Ottawa Built Heritage Advisory Committee recommends that Planning Committee
recommend that Council approve:
1.
Designation of the Clemow Estate East
Heritage Conservation District, as identified in Document 1, under Section 41
of the Ontario Heritage Act; and
2.
The Clemow Estate East Heritage

Lesley
Collins, Heritage Planner, provided an overview of the staff report by means of
a PowerPoint presentation. A copy of her presentation is held on file with the
City Clerk.
Committee
heard from the following delegations:
Ann Hyland, owner of 10 Allan Place, spoke in
opposition to the Heritage Conservation District (HCD) as proposed. While she
was not opposed to the HCD, she requested revised boundaries for the proposed
district, including removal of her property from the proposed HCD. She argued
that her small house, designated “non-contributing,” was not a potential threat
to the neighbouring Noffke house if not designated.
Bill Price* spoke in support of the proposed HCD on
behalf of Heritage Ottawa. Mr. Price
also spoke as the owner of 54 Glebe Avenue, in support, but supporting a
reduced boundary. His detailed comments are included in his written submission,
which is held on file.
John McLeod,* resident of the Glebe, spoke in support of the
proposed HCD, for the reasons outlined in his written submission held on file.
He indicated that he would support a compromise if agreed to immediately, but
emphasized that there should be no delay.
Melissa Viinalaas, 12 Cobalt Avenue, spoke in opposition to
the Heritage Conservation District (HCD) as proposed. She requested revised
boundaries for the proposed district, including removal of her property from
the proposed HCD. She noted that her home did not have a sightline to Central
Park, and argued it would not impact the adjacent Noffke-designed house. She
did not anticipate changing the character of the house, nor did she anticipate
any future owner would do so.
Lara Wait,* 93 Glebe Avenue, spoke in opposition to the
Heritage Conservation District (HCD) as proposed. She referenced the petition
that had been submitted in opposition to the current boundaries, noting that
owners of 28 affected properties had signed. She expressed frustration with the
process to date, and requested revised boundaries for the proposed district,
including removal of her property from the proposed HCD. She suggested that although her home is
behind a Noffke-designed, house there are no sightlines to Central Park and
thus it does not contribute to the HCD. She
argued that the designation of the homes in the “buffer zone” was unfair, and
would negatively impact the affected homeowners.
Joan Bard Miller, Glebe Community Association* supported the proposed HCD, as outlined
in the written presentation held on file. She acknowledged that there was a
variety of opinions in the community and concerns about the proposed boundaries. In the interests of finding a consensus
solution, she requested on behalf of the association that Committee give
further consideration for reduced HCD boundaries based on consistent,
heritage-based criteria.
John Leaning* spoke in support of the proposed HCD. He gave an overview of some of the history of
how the HCD had come to be, and his own involvement in that process. He emphasized the importance of protecting
heritage in the Glebe as a whole and this area in particular. He noted the issue had not been resolved
eight years after the initial request for action was submitted. With respect to
the boundaries, he suggested the line had to be drawn somewhere, and urged the
Committee to support the proposal.

Councillor Hobbs
moved the following motion on behalf of Councillor Chernushenko, which exempted
the following properties from the proposed HCD: 38 Monkland Avenue; 37 Linden
Terrace; 93,95,97,99,101,103, 105 and 117 Glebe Avenue; 683,685,697 Bank Street;
550 O’Connor Street; 10 Allan Place and 12 Cobalt Place.
MOTION NO PLC 16/1
Moved by Councillor K. Hobbs:
WHEREAS the Clemow Estate East Heritage
Conservation District is an important step towards ensuring the retention and
conservation of the area’s heritage resources;
AND WHEREAS based on feedback from
residents, the Glebe Community Association and Heritage Ottawa;
AND WHEREAS feedback has included requests
to either expand or reduce the proposed boundaries of the District.
BE IT THEREFORE RESOLVED that the
boundaries and staff report be modified in accordance with map “C” as attached;
AND BE IT FURTHER RESOLVED and re-confirmed
that this process be followed by a public consultation process for Phase II,
which would include Linden Terrace and Patterson Creek to the Canal, and by
Phase III including Central Park and buildings adjacent to it to the West of
Bank Street, as approved by City Council at its meeting of October 24, 2004.

the staff report by means of a PowerPoint presentation. A copy of his

Committee heard from the following public
delegations:
Nick Masciantonio, John Dance and Paul
Goodkey, * presented on behalf of the Old Ottawa East Community Association. They were in general support of the Community
Design Plan (CDP.) However, they outlined some outstanding community issues and
requested some additional minor amendments.
These are outlined in the association’s PowerPoint presentation, copies
of which are held on file with the City Clerk.
Christian Pupp,* also a member of
the Old Ottawa East Community Association, spoke in support of the CDP and the
process that had led to its development. His comments are held on file with the
City Clerk.
Michael Polowin and Lloyd Phillips on behalf of the
Oblates and St. Paul University, and Ted Fobert on behalf of Sisters of
the Sacred Heart, were present in support of the CDP
as written. Mr. Polowin asked staff to
consult with his team if any changes to the plan were to be proposed. Mr.
Fobert spoke highly of the process between the City, the institutional owners
and the community, suggesting that it be taken as a model to follow for future
CDPs.

That
staff review the suggested amendments, from the Old Ottawa East Community
Association, consult with the other presenters, and work with the Ward
Councillor and interested parties to see which can be incorporated into the
plan.

that all the above be done before the matter is considered by City Council, so
that motions can be brought forward at Council to make changes where
appropriate.
And
that this item be submitted to the August 24, 2011 meeting of City Council

capacity of the Hazeldean Pump Station up to 1225 litres per second are
complete,
AND WHEREAS, this was the last required
provision for lifting the holding symbol on lands within the sewershed of the
pump station (which includes the subject lands),
AND WHEREAS the maximum height exemption
from 11 to 12 metres is not necessary for the street townhouses and only some
of the single family lots,
THEREFORE BE IT RESOLVED that the report recommendation be amended as
follows:
‘That
the Planning Committee recommend Council approve an amendment to Zoning By-law

At the outset,
two motions of deferral were introduced, as set out below. Therefore Committee
did not consider the substance of the matter.
Committee heard
from the following public delegations, on the matter of deferral:
William Murray, Bruyère Street Rezoning Task Force spoke in favour of
deferring the matter to September 2011, and did not feel deferral to August
would be sufficient.
Jodi Murray, also spoke in
favour of deferring the matter to September 2011 rather than August.
Joel Weiner also spoke in
favour of deferring the matter to September 2011 rather than August.
Jim Burghout, on behalf of the applicant, Claridge Homes, indicated that he would support deferral to August, but would not
support deferral to September
The following
individuals were present to speak in opposition to the application. They indicated their support for deferral,
but reserved their comments for when the substantive matter would be before
Committee: Marc Aubin, Selena Fraser, Adam Barbolet,
John Chenier, Nancy Chenier, Ruth Rodger, Stuart Savage.

residential uses.

overview of the application and staff’s rationale for recommending refusal.
Brian Casagrande of FoTenn
Consultants and Paul Rothwell of Ashcroft Homes were present on behalf of the applicants. They requested deferral of the matter to the
August Planning Committee meeting, or whichever meeting the Committee deemed
appropriate, to allow the opportunity to resolve staff’s outstanding concerns
with the application: the heights and the requirement for a Plan of
Subdivision.
As no motions to defer were
forthcoming, Mr. Casagrande spoke in support of the application and urged
Committee to support it. The following
is a summary of the points raised in his presentation:
·
The
application has evolved throught discussions with staff and meetings with the
local community. 15 and 20 story
compondents of the development have been removed; approximately 1/3 of the
residential units have been removed; a public park has been provided and a
public road and pathway has been provided.
·
The
highest buildings will be 80-108 metres away from the closest residence, with a
wooded park buffer and other development components in between. He advised that there would be no impact on
the exising homes, citing the sun shadow studies that had been prepared.
·
Staff is
opposed to specific aspects of the application, as outlined in the report, but
are not opposed to a mixed use development at this location.
·
The
ratio of jobs per houselold being proposed is in accordance with the Official
Plan.
·
The
orientation, massing, buffering, mix of uses and key public elements make this
an ideal development for this location.
The report recommendation was put
to Committee and CARRIED as presented.

a waiver of Sections 95, 96 and 106 of the Permanent Signs on Private Property
By-law 2005-439 (as amended) to allow a sign permit to be issued for a digital
message centre as a wall sign on the IKEA building located at 2685 Iris Street,
as shown on Documents 2 and 3, subject to the conditions outlined in this
report; and
2. Delegate
authority to the Director of Building Code Services to include this digital
sign in the pilot project for digital billboard signs.

WHEREAS on March 24, 2010 Council directed staff to
undertake a review of rooftop signs, and in the interim allowed a rooftop sign,
in the shape of a cow, to remain above the store known as Cheddar Et Cetera,
located at 900 Watters Road in Orléans;
AND WHEREAS the review has been
completed and the Departmental report is recommending no change to the
Permanent Signs on Private Property By-law 2005-439, therefore continuing the prohibition
of rooftop signs;
AND WHEREAS the results of the
survey that was conducted to gauge public opinion on rooftop signs indicate a
much higher level of acceptance for such signs in the East Urban and Rural
areas, with comments specifically supporting the existing cow sign at 900
Watters Road;
AND WHEREAS a petition was
submitted to the City containing over 9000 signatures in support of retaining
the cow sign;
AND WHEREAS this particular
rooftop sign promotes local agri-businesses and does not negatively impact
surrounding properties;
AND WHEREAS it is desirable to
allow this sign to remain for a specified term given the policy objective to
prohibit rooftop signs throughout the City;
THEREFORE BE IT RESOLVED THAT that
Planning Committee approve a waiver of Section 51(a) to the Permanent Signs on
Private Property By-law 2005-439 (as amended), to allow a roof sign on the
building located at 900 Watters Road, with the following permit conditions:
i)
the sign is limited to an object sign, in the
form of a cow;
ii)
the sign is only permitted for the Cheddar Et
Cetera retail business, and is not transferable to another location, nor
another business;
iii)
the sign installation is subject to the
building permit process in view of any safety concerns; and
iv)
the sign
is permitted until July 13, 2015.

WHEREAS
in May 2007 City Council approved the Graffiti Management Strategy, which
identifies the use of murals and art as an effective deterrent;
AND
WHEREAS the Ottawa West End Community Chaplaincy, a non-profit entity
representing 17 places of worship that provide services to the tenants of
Morrison Gardens, are planning a mural to be painted on the south wall of a
portable that they own which is used by the community;
AND
WHEREAS the portable is located in Lisa Park which is zoned O1 (open space
zone), and is therefore subject to the District 1 regulations of the Permanent
Signs on Private Property By-law which do not permit murals in this District;
AND
WHEREAS prior to amendments to the Permanent Signs on Private Property By-law
in 2008 grouping together the zones of the new Comprehensive Zoning By-law under
various signs Districts, parks such as Lisa Park were subject to the District 3
regulations which permitted murals;
AND
WHEREAS the O1 zone for such parks should instead be subject to the District 2
rather than the District 1 sign regulations, consistent with other similar open
space zones which are in a District 2, where murals are permitted for
institutional uses;
AND
WHEREAS it is intended to align certain zones under a more appropriate sign
District in a report on technical amendments to the Permanent Signs on Private
Property By-law in the fall of 2011;
THEREFORE
BE IT RESOLVED that the Permanent Signs on Private Property By-law 2005-439 (as
amended) be waived to allow a mural on the portable building located at 6 Lisa
Avenue; and
BE
IT FURTHER RESOLVED THAT in accordance with By-law 2002-522 (as amended)
respecting public notice, and in particular notice for changes to the Permanent
Signs on Property By-law; that the notice requirements be waived as the
timeline for a decision in order to proceed with this mural during the summer
does not make it possible to comply with the notice requirements.
