That the Planning and
Environment Committee and Council approve the demolition of 1486 Clementine
Boulevard, subject to the following conditions:
a. That the Registered Owner shall
seed/sod and maintain the properties as open space and not use them for other
interim use between the demolition of the existing building and the time of
construction of any replacement building(s).
b. That the Registered Owner acknowledges
that if the site is not maintained to City standards after demolition, the
provisions of the Property Standards By-law will apply.
Que le Comité de l’urbanisme et de
l’environnement, ainsi que le Conseil approuve la démolition de la propriété
située au 1486, boulevard Clementine, sous réserve des conditions
suivantes :
a. Que
le propriétaire inscrit assure l’ensemencement/le gazonnement et l’entretien
des propriétés en tant qu’espaces ouverts, et n’en fasse aucun autre usage
temporaire entre la démolition du bâtiment et la construction de tout nouveau
bâtiment.
b. Que
le propriétaire inscrit accepte, si l’emplacement n’est pas entretenu selon les
normes de la Ville après la démolition, l’application du Règlement sur les
normes de bien-fonds.
The subject property located at 1486 Clementine Boulevard is
occupied by a single detached dwelling that
had a tenant who moved out without notification to the owner. The building subsequently became an attraction
to area youth who vandalized the property extensively. Upon investigating the site, the owner had
all services (water, oil, and hydro) severed and has advised her insurance
company of the situation.
Given the closeness to adjacent properties, and the potential for fire
to spread quickly and cause major damage to adjacent properties, the owner has
been instructed to demolish the building by the insurance agent, and advised
that no liability insurance will be issued until this is done. The building also has knob and tube wiring
which is no longer permissible under the Building Code Act, making any attempt
to renovate the property not viable at this time.
The City is currently in the process of
reviewing the Demolition Control By-law of the former City of Ottawa with a
view to recommending changes that would simplify the process for obtaining
demolition control approval for certain classes of residential use buildings,
including single family homes where circumstances require demolition and where
no replacement building is immediately proposed. This process of modifying this by-law however has not yet been
concluded requiring the owner to obtain Demolition Control Approval under the
current by-law to demolish the existing single detached residential dwelling in
advance of obtaining a Building Permit for a replacement building. As noted, the owner has received a notice
from her insurance carrier requiring that the building be demolished in order
to retain liablilty coverage on the property as the properties current state is
considered by the insurance carrier to be a fire hazard constituting a threat
to adjacent properties. The situation
faced by the owner is considered an exceptional circumstance warranting
Planning and Environment Committee providing expeditious resolution of this
matter by giving approval to the demolition of the existing building under the
Demolition Control By-law of the former city of Ottawa.
The Planning and Growth Management Department
was made aware of this report by the Councillor’s office and provided input on
the review of the demolition Control By-law that is currently underway.
FINANCIAL
IMPLICATIONS
An application submitted to the City to obtain
demolition control approval where no replacement building is proposed would
require the submission of a $2 096.25 application fee. In this case, as this matter has been
initiated by the Councillor, no formal application or application has been
received.
This item will be advertised in
the local dailies as part of the Public Meeting Advertisement on Friday
preceding the Planning and Environment Committee meeting. The public notice requirements under
Council’s Public Notification and Consultation Policy for Demolition Control
applications was not undertaken. There
is no legal requirement under the Planning Act for public consultation for
Demolition Control applications.
LEGAL/RISK IMPLICATIONS
There are no Legal/Risk Management Implications at this time. This will have to be reviewed upon
completion of the Strategy.
