That Planning and Environment Committee recommend Council approve the application to vary Sign By-law 2005-439, to permit an illuminated menu board sign within 18 metres of a residential use and a video screen information sign within 20 metres of a residential use, instead of the required 30-metre setback, for the location at 2020 Trim Road.
Que le Comité de l’urbanisme et de l’environnement recommande au Conseil d’approuver la demande de dérogation au Règlement sur les enseignes 2005-439 afin de permettre un panneau de carte à menus lumineux en-deçà de 18 mètres d’une utilisation résidentielle ainsi qu’un panneau d’information avec écran vidéo en-deçà de 20 mètres d’une utilisation résidentielle, au lieu de la marge de recul de 30 mètres requise, pour l’emplacement situé au 2020, chemin Trim.
The Tim Horton's location at 2020 Trim Road has applied for signs permits for pre-menu video signs.
Following application review, it was determined that this location does not satisfy the 30‑metre setback requirement between the signs and adjacent residential uses in a residential zone. This new store has a menu board sign and a video screen information sign as part of the drive-thru on the south side of the lot. The by-law allows pre-menu board signs at drive-thru restaurants to promote products and services related to the use (see examples in Documents 1 and 2).
Provisions for illuminated drive-thru information signs limit the scale and location of video screen and menu board signs from residential uses in a residential zone. At this location, there is some screening between the signs and the nearby residents with existing fencing. However, this screening does not hide any views of the signage from the adjacent second floor windows of nearby residents.
As the menu board sign faces towards Trim Road, it does not adversely affect the adjacent residents and approval of this sign is recommended. Approval of the video screen sign, which is located further west on the drive-thru, is recommended as the applicant has agreed to change the orientation of the sign to lessen the impact to the community by having the sign face perpendicular to the drive-thru driveway (see Document 3). This change will result in the video screen sign facing west towards commercial uses rather than towards the residential homes south of this development.
The Department is satisfied the application is in keeping with the intent of the Sign By-law and approval is recommended.
Standard early notification was provided to community and business groups and adjacent owners. Councillor Jellett noted some concern with the variance requests for 2020 Trim Road. One respondent noted the following concerns:

The applicant has agreed to change the orientation to the video screen sign. This measure will minimize the impact of additional lighting. This By-law has no authority to address the noise associated with the drive thru services.
