REPORT RECOMMENDATION

[U1] 

That the Planning and Environment Committee recommend Council approve an amendment to the former City of Ottawa Zoning By-Law to change the zoning of 223 First Avenue from I1 - Minor Institutional - SCH. 119 [571] to R3J - Townhouse/Converted House - [exception], and to change the exception provision of the I1 zone applying to 217 First Avenue to modify the performance standards, as shown in Document 1, and as detailed in Document 3.

Que le Comité de l’urbanisme et de l’environnement recommande au Conseil d’approuver une modification au Règlement de zonage de l’ancienne Ville d’Ottawa en vue de modifier le zonage du 223, avenue First de I1 – zone de petites institutions – SCH. 119 [571] à R3J – maison en rangée/maison convertie – [exception], et de changer la disposition d’exception de la zone I1 relative au 217, avenue First en vue de modifier le seuil de nuisance, tel qu’indiqué dans le document 1 et précisé dans le document 3.

 

 

BACKGROUND

The subject properties, 217 and 223 First Avenue, are located on the north side of First Avenue, west of Bank Street, in the Glebe.  The properties historically have been zoned and have functioned as one property, being occupied by St. Matthew's Anglican Church and the associated Rector's residence.  The Church applied to the Committee of Adjustment to sever the Rector's residence from the main church building and property in July, 2005.  The consent to severance was approved by the Committee of Adjustment subject to the aproval of the rezoning, and the exhaustion of all appeals.

 

The severed lands, 223 First Avenue, will be occupied by the existing single-detached dwelling house, and will be rezoned to a new R3J exception zone.  The lands to the north, south, and east of the severed property are currently zoned R3J.  The required exception to the proposed R3J zone for the subject property arises as a result of the location of the house as it relates to the proposed property line.

 

The retained lands, as 217 First Avenue, will continue to be occupied by St. Matthew's Church, and will retain the I1 SCH. 119 [571] zone.  The provisions of exception 571 will be amended as a result of the location of the Church as it relates to the proposed property line.

 

 

DISCUSSION

 

The proposal to rezone the property at 223 First Avenue to an R3J exception zone to permit the existing single-detached dwelling to exist as a use separate from the adjacent Church, and to amend the exception provisions of the I1 zone applying to the Church, is consistent with the policies associated with the General Urban Area designations that apply to the site under the City Council Approved Official Plan, the Region of Ottawa-Carleton Official Plan and the policies associated with the Residential Area designation that applies to the site under the former City of Ottawa Official Plan.  The proposed rezoning will provide an opportunity for the existing building to remain part of the residential community, on a lot that is consistent with the size of residential lots in the area.  In this regard, the severed lot will have a frontage of 15.1 metres, and an area of 458.5 square metres.

 

The proposal, therefore, advances the policy objectives of all three Official Plans to maintain existing residential uses in the urban area to continue to make efficient use of existing services and infrastructure.  The residential lot that would be created for the existing house is located within 100 metres of a main street, with bus service, and is close to institutional and commercial uses that support the community.  Finally, the modifications to the performance standards reflect existing conditions and will allow both the Church and the single-detached dwelling to remain as they are located. 

 

 

CONSULTATION

[U3] 

Notice of this application was carried out in accordance with the City’s Public Notification and Consultation Policy. The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.

EXPLANATORY NOTE                                                                                                                

 

By-law Number       amends Zoning By-law, 1998 of the former City of Ottawa.  The amendment affects the properties at 217 and 223 First Avenue, which are located on the north side of First Avenue, west of Bank Street, as shown on the attached Location Map.

 

The application is to rezone a portion of the subject property from “I1 SCH.199 [571]” (Minor Institutional Zone) to “R3J” (Converted House/Townhouse Zone), and to amend the exception provisions applying to the remainder of the property, exception 571.  The proposed zoning will permit the severance of a residential lot, will regulate the lot size of the severed parcel, and will permit the buildings located on the severed and retained lands to meet the requirements of the applicable zones.
