That the Planning and Environment Committee recommend Council approve an amendment to the former City of Kanata Zoning By-Law to change the zoning of 750 March Road from Public and Institutional "P" Zone to Residential Type 5A - exception 4 "R5A-4" Zone and Open Space Type 1 "OS1" Zone as detailed in Document 2, subject to the following amendments:


WHEREAS the last sentence of the fourth paragraph of page 5 to Staff Report ASC2004-DEV-APR-0180, being the Proposed Zoning By-law Amendment, does not accurately reflect the proposed change in parking requirements of the subject property,

 

AND WHEREAS “Document 2” attached to Staff Report ASC2004-DEV-APR-0180, being the Proposed Zoning By-law Amendment, does not accurately reflect the proposed changes in the zone provision requirements of the subject property, and did not identify that the subject property is to be removed from By-law 74-79 and incorporated into By-law 164-93,

 

AND WHEREAS “Document 1” attached hereto has been prepared to detail required corrections to Staff Report ACS2004-DEV-APR-0180,

 

THEREFORE BE IT RESOLVED THAT “text corrections” and “Document 2” to Staff Report ACS2004-DEV-APR-0180 be amended in accordance with “Document 1” attached hereto.

BE IT RESOLVED that Planning and Environment Committee approve and implement the following revisions to Staff Report ASC2004-DEV-APR-0180:

 

1.         That “Document 2” DETAILS OF RECOMMENDED ZONING be amended by adding the following statement:

 

“That the subject lands be repealed from By-law 74-79, incorporated into By-law 164-93 and rezoned from Public and Institutional “P” to Residential Type 5A – exception 4 “R5A-4” Zone”.

 

2.         That the last sentence of the fourth full paragraph of page 5, being the “Discussion” Section to Staff Report ASC2004-DEV-APR-0180 is hereby amended by deleting the sentence in its entirety and substitute the following new text:

 

“The Zoning By-law amendment proposal requests 0.7 parking spaces per apartment dwelling unit, 1.5 parking spaces per multiple attached dwelling unit, plus 0.25 visitor parking spaces per overall dwelling units for the development, as shown in Document 2.”

 

3.         That “Document 2” DETAILS OF RECOMMENDED ZONING be amended by changing the following zone provisions:

 

“That the minimum Interior Side Yard Depth of the proposed R5A-4 Zone be changed from 20.0 metres (apartment), to 15.0 metres (apartment).”

 

“That the minimum Net Floor Area, subclause (iii), of the proposed R5A-4 Zone be changed from 70 m2 (2 bedroom apartment), to 68 m2 (2 bedroom apartment)”

That the Planning and Environment Committee recommend Council approve an amendment to the former Township of West Carleton Zoning By-Law to change the zoning of 1362 Regional Road 29 from Rural Zone (RU) to Rural Exception Zone - 1 (RU-1) as detailed in Document 2 subject to the following amendment:

 

WHEREAS the address used in the title and report recommendation is that of the severed house and that the Proposed Zoning By-law Amendment proposes to change the zoning of the retained farmland only,

 

AND WHEREAS “Document 1” attached to Staff Report ASC2004-DEV-APR-0202, shows the affected area as 1362 Regional Road 29,

 

AND WHEREAS “Document 2” attached to Staff Report ACS2004-DEV-APR-0202 refers to 1362 Regional Road 29,

 

THEREFORE BE IT RESOLVED THAT Planning and Environment Committee approve and implement the following revisions to Staff Report ASC2004-DEV-APR-0202:

 

1.                  That the address in the report title be changed from 1362 to 1374 Regional Road 29,

 

2.                  That the address in the report subject be changed from 1362 to 1374 Regional Road 29,

 

3.                  That the address in “Document 1” LOCATION MAP be changed from 1362 to 1374 Regional Road 29,

14.       ON TIME REVIEW IMPLEMENTATION

That the Planning and Environment Committee recommend that Council:

 

1.         Approve the On Time Review initiatives to streamline the development review process as detailed in this report and outlined in Documents 1 and 2;

 

2.         Approve the study requirements for selected applications as contained in Document 3, subject to the following amendments:

 

a.                  That the conditions for Noise and Vibration Studies be amended to include:

 

“and for non-residential development, where the new use creates a stationary noise source.”

 

b.                  That staff be directed to review the Noise and Vibration Policies of the new Official Plan and the relevant Provincial regulations and policies and that a report be submitted to the Planning and Environment Committee no later than February 1, 2005.

 

3.         Approve changes to the Circulation to Technical Agencies as detailed in Document 4, subject to the following amendment:

 

That staff be directed to ensure that the Ward Councillor is consulted prior to the installation or alteration of permanent facilities in a park or City-owned greenspace.

 

4.         Approve an increase to the on-site sign fee to $400, authorize the Department of Planning and Growth Management to charge for additional on-site signs beyond the two-sign minimum, and amend By-law No 2004-160, the Planning Fees By-law accordingly; 

 

5.         Approve the implementation of a two-stage process (Draft and Final Approval) for site plan control applications as detailed in Document 5;

 

6.         Approve the establishment of a fee for the two-stage site plan process as detailed in Document 7, and amend By-law No 2004-160, the Planning Fees By-law accordingly;

 

7.         Approve the implementation of a joint site plan control/plan of subdivision process for street townhouses, and an abbreviated site plan control process for street townhouses within a plan of subdivision as detailed in Document 8;

 

8.         Approve the establishment of a fee of $1263 for the abbreviated site plan control process for street townhouses within a plan of subdivision and amend By-law No 2004-160, the Planning Fees By-law accordingly;  

 

9.         Approve the establishment of a planning fee of $250 and a legal fee of $250 plus GST for the extension of the time limit for Lifting Part Lot Control.

 

10.       Approve the implementation of an heritage application process including the review of site elements for single family homes in a Heritage Conservation District as detailed in Document 9;

 

11.       Approve the establishment of a fee of $1263 for the heritage application with the review of site elements and amend By-law 2004-160, the Planning Fees By-law accordingly;

 

12.       Approve amendments to the Site Plan Control By-law, By-law Number 2002-4 as detailed in Document 10, subject to the following amendments:

 

a.                  WHEREAS the City of Ottawa must acknowledge that it has limited control over the construction of communication towers due to federal government jurisdiction;

 

BUT WHEREAS the location, construction and light of communication towers continues to be of community interest;

 

THEREFORE BE IT RESOLVED THAT communication towers continue to be subject to site plan control.

 

b.                  Amend 4. (1) (c) (i) and (ii)

 

(i)                 a requirement under the Zoning By-Law for the provision of more than 10 additional parking spaces on the lot, excepting the conversion to restaurant use;

 

(ii)               the establishment of more than 10 additional parking spaces, excepting the conversion to restaurant use.

 

13.       Approve the amendments to the Delegation of Authority By-law, By-law Number 2001-12 as listed in Document 11;

 

14.       That applicable legal fees to planning approvals be exclusive of all disbursements and that the legal fees pursuant to By-law 2004-160, Schedule H be in accordance with Document 12;

 

15.       Approve the implementation of recommendations 1-14 effective November 1, 2004;


16.       Direct the Corporate Services Department to develop and implement an online solution to provide information to the development industry and the community as to the status of applications being processed by the City by June 2005; and

 

17.              Direct the Planning and Growth Management Department to report to City Council by May 2006 providing an update on the On Time Review Initiative.

 

18.              That staff reports, once the Deputy City Manager has signed off, be posted on the City’s website at the same time they are sent to the Ward Councillor for review.

 

19.              That the Planning and Environment Committee Agenda be posted on the City’s website 5 working days before the Committee meets.

2.         Approve the recommended amendment to Signs By-law 02-99, of the former City of Nepean, to permit one (1) third-party advertising billboard ground sign at this location, to display multi-tenant logos, provided that the sign is located perpendicular to the road and at least 100 metres from any other similar sign, has a height no greater than 4.5 metres, has an area on both sides no greater than 7 square metres, has a setback from any lot line of at least 4 metres and the owner of the lot has a permit issued prior to January 1, 2005.

17.       CASH-IN-LIEU OF PARKING - 480 METCALFE & 88 - 112 Isabella

WHEREAS on September 12, 2002 the Planning and Environment Committee carried a recommendation that approved a cash contribution in lieu of providing 10 additional parking spaces for expansion of a retirement home located at 480 Metcalfe Street;

 

AND WHEREAS that approval recognized that the zoning by-law requirement at the rate of 0.75 spaces per dwelling unit was excessive based on the estimated car ownership of the elderly residents;

 

AND WHEREAS the proposed development was not expected to cause an excess demand for on-street parking in the neighbourhood;

 

AND WHEREAS the approved contribution was reduced to $1.00 per space for a total payment of $10.00 to reflect that there was no need to provide public parking to compensate for the 10 parking spaces not being provided for the expansion;

 

AND WHEREAS an Agreement between The City of Ottawa and The Palisades Ottawa Retirement Residence Inc. was registered on title on January 28, 2003, as Instrument No. OC163781, for cash-in-lieu of parking for 10 parking spaces at the rate of $1.00 per space;

 

AND WHEREAS the planned expansion has been revised and enlarged to incorporate the adjacent lands at 88 – 112 Isabella Avenue resulting in a deficiency of 16 parking spaces;

 

AND WHEREAS the proposed development is desirable as it will reinforce part of the residential area adjacent to the Highway 417 corridor;

 

AND WHEREAS the neighbours are in support of the revised expansion plans and are satisfied that adequate parking is being provided;

  

THEREFORE BE IT RESOLVED that the previous decision of the Planning and Environment Committee and the Agreement registered as Instrument No. OC163781 with respect to the cash-in-lieu application by The Palisades Ottawa Retirement Residence Inc. in respect of 480 Metcalfe Street be amended to include the lands at 88 – 112 Isabella Avenue to allow for cash-in-lieu of parking for six (6) additional parking spaces, bringing the total to 16 parking spaces at the rate of $1.00 per space for an additional payment of $6.00.
