That the Planning and Development Committee recommend that Council approve an amendment to the former City of Cumberland Urban Zoning By-law 1-84 to eliminate the requirement for on-site parking for a private club on a residential lot at 817 Swallowtail Crescent.

BACKGROUND

 

An application has been received to amend the Cumberland Urban Zoning By-law for the property located at 817 Swallowtail Crescent, south of Innes Road and east of Portobello Boulevard.  The applicant is currently developing an adult oriented lifestyle community and is proposing to construct a private community building on one of the residential lots within the subdivision which would be owned in common and used by the residents on Swallowtail and Yellowthroat Crescents.  The property is zoned R1H-X1 – Block A – Residential - Singles – Wide Lots R1H – Exception One – Block A in accordance with the Cumberland Urban Zoning By-law.  This parcel was zoned to permit a private club when the overall zoning of the neighbourhood was completed, however parking provisions were not addressed at that time.  This amendment would eliminate the requirement for on-site parking.

 

DISCUSSION

 

The applicant has plans to construct a small community building which will serve 87 bungalow homes fronting on Swallowtail and Yellowthroat Crescents.  Because the users of this building reside within the neighbourhood, on-site parking is deemed unnecessary since parking is already provided on each individual subdivision lot.

 

The private club is to be designed to blend in with the existing residential development.  There is insufficient space on the lot for a parking area and it would not be in keeping with the residential nature of the street.  In fact, the applicant prefers to plant additional landscaping on the property rather that have a driveway located in the front yard.

 

CONSULTATION

 

Public notification was provided by the posting of an on-site sign.  The sign was installed on the property facing Swallowtail Crescent on April 9, 2002 notifying the residents in the surrounding neighbourhood of the proposed amendment to the zoning by-law.  No comments from the public were received regarding this application.

 

In addition to the usual agencies and City Departments, the application was also circulated to the Cumberland Township Historical Society.

Chair Hunter began by reading a statement required under the Planning Act, which advised that anyone who intended to appeal this proposed Zoning By-law Amendment to the Ontario Municipal Board (OMB), must either voice their objections at the public meeting, or submit their comments in writing prior to the amendment being adopted by City Council.  Failure to do so could result in refusal/dismissal of the appeal by the OMB.

 

Ms. Debbie Belfie was present on behalf Tamarack Homes and satisfied with the departmental recommendation contained in report dated 6 May 2002.

 

The Committee approved the recommendation contained in the report.

 

That the Planning and Development Committee recommend that Council approve an amendment to the former City of Cumberland Urban Zoning By-law 1-84 to eliminate the requirement for on-site parking for a private club on a residential lot at 817 Swallowtail Crescent.
