             Section 4.6.5.3 – Site Plan and Other Agreements, Section 4.6.5.4 – Water Supply and Sanitary Sewage Treatment/Disposal, Section 4.6.5.5 – Storm Water Management, Section 4.1 Zoning By-laws and Holding Provisions (Section 6.2)

             Be modified to delete the word “Council” wherever it appears and replace it with “the City of Ottawa”.

 

      b)   Add an additional modification

             That this application conform with the former Regional Official Plan prohibition regarding gated communities.

 

2.   Direct Development Services Department staff to develop policies for mobile home parks as part of the Official Plan review having regard to the issues raised in this report.

             That the Planning and Development Committee recommend that Council approve:

 

1.    A temporary Zoning By-law expiring December 30, 2003 to permit ultimate Frisbee on Spratt Road in Lot 29, Concession 1, Rideau Front in former Gloucester;

 

2.    That City staff be directed to work with the Ottawa Carleton Ultimate Association to identify 16 Ultimate Frisbee fields for the 2002 and 2003 playing season to replace the Spratt Road fields, and that the Spratt Road fields be decommissioned as new fields are identified.

 

             3.   That staff be directed to draft an agreement between the Ottawa-Carleton Ultimate Association and the City for the use of Lot 29, Concession 1, Rideau Front on Spratt Road to resolve neighbourhood issues such as:

·      The provision of sufficient on-site parking

·      Prohibition of parking on Spratt Road

·      Suppression of dust on the laneway to the fields

·      Clearance of debris both on-site and off-site at regular intervals

·      Mechanisms to control noise and traffic

 

Further that the extension beyond 2001 of the temporary use by-law not be placed before Council until the agreement has been signed by the parties.

That the Planning and Development Committee recommend that Council approve a minor variance to the Signs By-law 36-2000, of the old City of Ottawa, to permit an internally illuminated secondary wall sign at 150 Gloucester Street, installed on the east façade as shown on Document 2, and located within 30 metres of a residential zone, provided that the sign use reverse illumination only and is not illuminated between the hours of 10 p.m. and 7 a.m.

1.    That this matter be referred back to staff in order to determine whether the applicant will submit an application that more closely reflects the scale, massing, height and footprint in keeping with the character, scale and details of the Heritage Conservation District; and failing that, Committee and Council reject the application for demolition and new construction.

 

2.    That should the owner not agree to an extension of the time limit in the Act, the application be refused.

18.       COMMITTEE OF ADJUSTMENT - STRUCTURE AND ORGANIZATION - IMPLEMENTATION PLAN /

That the Planning and Development Committee recommend that Council approve the following: 

 

1.   The existing Committees of Adjustment/Rural Alliance Severance Committee continue their service until December 31, 2001 with provisions for an interim budget covering that period;

 

2.   A new 15-member Committee of Adjustment sitting in three panels of five members (one rural and two urban panels) be created with a centralized Committee office to commence operation on January 1, 2002, with the boundaries set as shown in Document 3, with the addition of the Cumberland urban area, as defined in the Cumberland Official Plan, to the suburban area.

 

3.   That a Secretary-Treasurer and Deputy Secretary-Treasurer for the new Committee of Adjustment be appointed by the new Members before the end of this year (2001) and that in the interim the Development Services Department appoint an interim Secretary-Treasurer in order that the operational framework and office requirements can be developed to ensure a seamless transition on January 1, 2002;

 

4.   That Development Services Department provide professional planning support on all applications made to the Committee of Adjustment as outlined in this report and that an additional three professional planners (3 new FTEs) be included in the Department’s 2002 Budget;

 

5.    That a Tariff of Fees Schedule that would reflect 100% cost recovery as shown in Document 5 be approved and that the new Committee of Adjustment reflects this cost recovery in their budget.

 

6.    That the issue of secondary consent application fees be referred to the new Committee of Adjustment.

That the Planning and Development Committee recommend that Council approve:

 

1.   the following types of Zoning By-law Amendment applications as “minor” amendments for the purpose of applying a $1,500 application fee:

 

·      modifications to performance regulations only

·      extension of a zoning boundary to reflect addition of lands to existing property

·      establishment of a temporary garden suite, an accessory apartment or a special needs/group home

·      lifting of interim control for one use only

·      any zoning changes required as a condition of severance

 

and that all other types of Zoning By-law Amendment applications be considered as “major” amendments subject to a $3,000 application fee.

 

2.   That the upset limit for legal costs incurred by the City be set at:

a)    minor zoning amendments be $3,000.00

b)    major zoning amendments, official plan amendments and plans of subdivisions be $10,000.
