REPORT ON S.I.U. INVESTIGATION – CUSTODY INJURY – SEPTEMBER 2012

That the Ottawa Police Services Board receive this report for information.
In September, an officer arrested an individual for breaching a recognizance. The individual was taken into custody and pushed away from the officer and fled. Other officers arrived on scene and after a foot chase the individual was arrested. The individual had cut his hands while jumping over fences and was taken to the hospital by ambulance.
The individual was treated for superficial cuts to his hand and was diagnosed as having a fracture to his little finger on his right hand. The Special Investigations Unit was contacted and invoked its mandate.
Special Investigation Unit Investigation
The Director of the Special Investigations Unit advised the following:
“The investigation by this unit has been completed, the file has been closed and no further action is contemplated. In my view, there are no reasonable grounds to believe that the named subject officer committed a criminal offence in relation to the injury sustained by the complainant.”
Professional Standards Section Investigation
Pursuant to section 11 of Regulation 267/10 of the Police Services Act, an investigation was conducted by the Professional Standards Section to determine if the policies of, or services provided by, the Ottawa Police Service were adhered to at the time of this incident, and to determine if the conduct of the police officers was appropriate.
This investigation confirmed that officers used appropriate force to make the arrest. No misconduct was identified.
Police officers re-qualify annually in their ‘use of force’ training to refresh decision making skills in live scenarios and practical skills with issued weapons. It was confirmed that the subject officer had successfully re-qualified in use of force as per legislative requirements.
The results are as follows:
Conduct: There were no conduct issues identified.
Policies: The following policies were reviewed; Partner Assault/Partner Conflict, Prisoner Care and Control, and Use of Force. There were no issues identified.
Service: The officers observed the hands of the individual to be cut and bleeding and called paramedics to assess and treat the individual. The review of this arrest indicates that the officers acted lawfully and used only necessary force to affect the arrest of the individual. The officers complied with all applicable policies and acted professionally throughout this matter.
No further action to be taken on this matter.
