RECOMMENDATION

 

That the Ottawa Police Services Board receive this report for information.

 

BACKGROUND

 

In September 2011, Ottawa police officers were dispatched to the area of Clarence and King Edward Streets for a disturbance call.  Officers located an intoxicated individual matching the suspect description.  During the interaction they observed the suspect to be intoxicated and exhibiting behaviour leading them to believe he was an immediate danger to himself and others.  The officers attempted to arrest the male and a struggle ensued as the suspect resisted arrest.  The suspect was grounded and in the process he received an injury which was later diagnosed as a fractured cheekbone.

 

The Special Investigations Unit was contacted and invoked their mandate.

 

INVESTIGATION

 

Special Investigations Unit Investigation

 

On October 20th, 2011, the Director of the Special Investigations Unit advised Chief White that their investigation was now complete and that no further action would be taken.  S.I.U. Director Ian Scott stated in his correspondence:

 

Pursuant to s. 11(4) of Regulation 267/10 under the Police Services Act , I advise you that my report regarding the Custody Injury  that occurred in September 2011, has been sent to the Attorney General.

 


 

The investigation by this Unit has been completed, the file has been closed and no further action is contemplated. In my view, there are no reasonable grounds to believe that the subject officers committed a criminal offence in relation to the injuries sustained by the complainant in September  2011. The statements of the independent civilian witnesses are consistent with those of the subject and witness officers. The subject officers were involved in an arrest of the complainant upon receipt of information that the complainant was swinging a dog leash at a dog and cars. They arrested the complainant for public intoxication, an arrest for which they had reasonable grounds in my view. The complainant resisted the officers’ attempts to secure the handcuffs, slid along the hood of the cruiser and struck their head on the rear view mirror. The complainant sustained a cut and fractured cheek during the arrest. The force used by the subject officers was clearly reasonable within the context of a lawful arrest notwithstanding the injuries received by the complainant.”

 

Professional Standards Investigation

 

Pursuant to section 11 of Regulation 267/10 of the Police Services Act, an investigation was conducted by the Professional Standards Section to determine if the policies of, or services provided by, the Ottawa Police Service were adhered to at the time of this incident, and to determine if the conduct of the police officers was appropriate.

 

The results are as follows:

 

Conduct: No misconduct was identified.

 

Policies: All policies were adhered to.

 

Service: No service issues were identified.

 

CONCLUSION

 

No further action to be taken on this matter.
