APPOINTMENT OF SPECIAL CONSTABLE – RCMP

 

RECOMMENDATION

 

That the Ottawa Police Services Board approve the appointment of Inspector Larry Brookson as a Special Constable pursuant to Section 53 of the Police Services Act in accordance with the terms and conditions set forth in the attached Approval of Appointment form.

 

BACKGROUND

 

Larry Brookson is an R.C.M.P. officer who is seconded to the Ottawa Police Service for the purpose of professional development and is performing the function of Inspector, Platoon West.  Currently, federal police officers that take their oath in a province other than Ontario do not have the ability to provide full enforcement under the provincial statutes of the Province of Ontario.  To ensure that during their OPS secondment assignment these officers can carry out their duties as a Police Officer, as defined in Section 42 of the Police Services Act (PSA) of Ontario, application is made to the Ministry of Community Safety and Correctional Services to have them appointed as Special Constables pursuant to Section 53 of the PSA.  The Police Services Board appoints the officer as a Special Constable upon approval by the Ministry.  The appointment is for a three-year period or until the appointee is no longer seconded to the Ottawa Police Service.  Upon termination of the secondment arrangement, the Ottawa Police Service will advise the Ministry to terminate the appointment.

 

The Board is being asked to appoint the Inspector as a Special Constable in accordance with the above noted process. 

 

Approval has been obtained from the Ministry of Community Safety and Correctional Services for this Special Constable appointment.  Pursuant to Section 53 of the Police Services Act, upon receipt of the Board appointment of his status, the officer will be required to swear the prescribed oaths.

CONCLUSION

 

The appointment of Special Constable status is required in order for federal police officers to provide full law enforcement under the provincial statutes of the province of Ontario.  This status enables seconded officers to carry out the full duties of a police officer while on secondment and will help ensure a more rewarding experience with the Ottawa Police Service.
