APPOINTMENT OF SPECIAL CONSTABLES – CARLETON UNIVERSITY -RENEWAL

 

 


RECOMMENDATION

 

That the Ottawa Police Services Board approve the renewal appointments of Brian Edward Billings, Leonard Francis Boudreault, Laura Ann Branchaud, Justine Cain, Ashley De Laplante, Stephanie Foster, Alison Hanna, Trevor Sharpe, Paul Stam, Gregorz Szewczyk, Michael Warner, and Malarie Woolsey as Special Constables, pursuant to Section 53 of the Police Services Act in accordance with the terms and conditions set forth in the attached Approval of Appointment form.

 

BACKGROUND

 

The Ottawa Police Service and Carleton University have been working in partnership under a Memorandum of Understanding (MOU) since 27 May 1996.  That MOU replaced an agreement between the then Ottawa Police Force and Carleton University, dating back to the early 1990s.  The MOU is an agreement setting out the parameters of Carleton University’s Campus Safety Officers as designated Special Constables empowered to enforce the Criminal Code, Ontario Statutes and Municipal By-Laws. 

 

The Carleton University Department of Safety responded to 50,000 calls for service in 2008.  Of these calls, approximately 5000 generated written complaints and of those, Carleton staff handled 4500 without intervention by the Ottawa Police Service.  By extension, 500 of the calls required the presence of an Ottawa Police Service officer.  Carleton University special constables act under the authority of the Trespass to Property Act, Liquor Licence Act, Youth Criminal Justice Act, Mental Health Act and the Criminal Code of Canada.  It is not uncommon for the special constables to use the special constable status under the above mentioned statues three to five times each day. Without the status, Carleton University would require the frequent presence of an officer from the Ottawa Police Service to satisfy the needs of the University and its students. 

 

The underlying philosophy is that such enforcement will be done in cooperation with the Ottawa Police Service, as may be determined by the Chief of Police and the Police Services Board, and in compliance with the policing needs of Carleton University campus.

Special Constable designations are authorized by the Board and approved by the Ministry of Community Safety and Correctional Services for a maximum of a five-year term.  Stephanie Foster, Paul Stam, Malarie Woolsey, Justine Cain, Michael Warner, Alison Hanna, Ashley De Laplante, Gregorz Szewczyk, Laura Ann Branchaud, Trevor Sharpe, Brian Edward Billings, and Leonard Francis Boudreault are current employees of the Carleton University Campus Security Program and the University is seeking re-approval for Special Constable designation.

 

DISCUSSION

 

The Memorandum of Understanding between Carleton University and the Police Services Board was renewed on May 27, 2009 for a five year term.  The Ministry of Community Safety and Correctional Services has indicated that a program renewal will require a business case type of program review in order to meet the standards that the Ministry has adopted since 2004.  A review of the Special Constable program at Carleton University will be conducted prior to the end of Q2 2010.  The Memorandum of Understanding allows for termination of the agreement by either party, upon ninety days written notice to the other, prior to the end of the calendar year.

 

Subject to Board approval, the Ministry of Community Safety and Correctional Services will re-appoint the following people as Special Constables: Stephanie Foster, Paul Stam, Malarie Woolsey, Justine Cain, Michael Warner, Alison Hanna, Ashley De Laplante, Gregorz Szewczyk, Laura Ann Branchaud, Trevor Sharpe, Brian Edward Billings, and Leonard Francis Boudreault.

 

Pursuant to Section 53 of the Police Services Act, upon receipt of the Board appointment, the employees will be required to undertake Oaths of Office and Secrecy to be administered by a Commissioner of Oath.

CONCLUSION

 

The approval appointment of Special Constable status is required in order for the Campus Safety Officer (Special Constable) to provide security to Carleton University as per an agreement with the Police Services Board.
