ZONING – PART OF 4175 NIXON DRIVE COMMITTEE RECOMMENDATION That Council approve an amendment to the Zoning By-law 2008-250 to change the zoning of part of 4175 Nixon Drive from AG2 (Agricultural, Subzone 2) to AG6 [XXXr] (Agricultural, Subzone 6 with an exception), as shown in Document 1 and as detailed in Document 2. 3. ZONING – 2215 SIXTH LINE ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to the Zoning By-law 2008-250 to change the zoning of 2215 Sixth Line Road, as shown in Document 1, by amending Exception 326r to permit a garden suite for a three year period, as detailed in Document 2. 4. REGULATING HYDRONIC HEATERS / OUTDOOR WOODBURNING BOILERS COMMITTEE RECOMMENDATION That Council approve an amendment to the Zoning By-law 2008-250 to include provisions for regulating hydronic heaters (outdoor woodburning boilers), as detailed in Document 4. ZONING – 302 LONGFIELDS DRIVE COMMITTEE RECOMMENDATION That Council approve an amendment to the Zoning By-law 2008-250 to change the zoning of 302 Longfields Drive from Residential Third Density Subzone Z, [1648] to Residential Third Density Subzone Z [XXXX], Residential Third Density Subzone U [1649] to Residential Third Density Subzone U [YYYY], Parks and Open Space Zone to Residential Third Density Subzone U [YYYY] and Residential Third Density Subzone U [1649] to Parks and Open Space Zone, as detailed in Document 2 and as shown in Document 1. 7. ZONING - 801 ALBERT STREET COMMITTEE RECOMMENDATIONS That Council: 1. Approve an amendment to the Zoning By-law 2008-250 to change the zoning of 801 Albert Street from MC[1351] F(1.5) - h “Mixed-Use Centre, Exception 1351, holding zone”, to MC[****], Schedule **** - h, “Mixed Use Centre, Exception [****], Schedule [****], Schedule [****], holding zone as detailed in Documents 2, 3 and 4; and 2. Approve an amendment to the Zoning By-law, 2008-250 to add a new Part to the by-law to include Zoning By-law provisions passed pursuant to Section 37 of the Planning Act. 8. COMPREHENSIVE ZONING BY-LAW 2008-250: ANOMALIES AND MINOR CORRECTIONS - THIRD REPORT 2012 AGRICULTURE AND RURAL AFFAIRS COMMITTEE RECOMMENDATION AS AMENDED That Council approve the amendments recommended in Column III of revised Document 2 (Items 4 and 5 deleted) and as shown in revised Document 3 (Attachments 11 and 12 deleted), to correct anomalies in Zoning By-law 2008-250 and that no further notice be provided to Section 34(17) of the Planning Act. PLANNING COMMITTEE RECOMMENDATION That Council approve the amendments recommended in Column III of Document 1 and as shown in Document 3, to change Zoning By-law 2008-250 and repeal certain subsections of By-law 2012-147, which amended Zoning By-law 2008-250 to implement regulations for the development of low-rise infill housing in mature neighbourhoods, all of which are for the purpose of correcting anomalies. 9. OMNIBUS ZONING BY-LAW AMENDMENTS AGRICULTURE AND RUAL AFFAIRS COMMITTEE RECOMMENDATION That Council approve amendments to the Zoning By-law 2008-250 to change the zoning as detailed in Document 2. PLANNING COMMITTEE RECOMMENDATION AS AMENDED That Council approve amendments to the Zoning By-law 2008-250 to change the zoning as detailed in Documents 1 and 2, and as shown in Document 3, and that there be no further notice pursuant to Section 34(17) of the Planning Act. REVISED BULK CONSENT AGENDA AGRICULTURE AND RURAL AFFAIRS COMMITTEE REPORT 22B A ZONING – 168 A AND B RIVINGTON STREET COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law 2008-250 to change the zoning of 168 A and B Rivington Street from V3I[361r] (Village Residential Third Density, Subzone I, Rural Exception 361) to V3B[XXXr] (Village Residential Third Density, Subzone B, with a Rural Exception) as shown in Document 1 and detailed in Document 2. FINANCE AND ECONOMIC DEVELOPMENT COMMITTEE REPORT NO 24 B DECLARE SURPLUS AND TRANSFER 2140 BASELINE ROAD TO OTTAWA COMMUNITY LANDS CORPORATION (OCLDC) FOR FUTURE DISPOSAL COMMITTEE RECOMMENDATION That Council: 1. Declare the non-viable parcel of land known municipally as 2140 Baseline Road, described as part of PINS 04692-0309, 04692-0323, 04692-0478, 04696-0454 and 04692-1301, being part of Constellation Crescent to be closed, containing an area of 3,000 m2 (32,292.7 square feet), subject to final survey and subject to existing and any future easements that may be required and shown as Parcel 1 on Document 1 attached, as surplus to the City’s needs; and 2. Authorize staff to transfer the land detailed in Recommendation 1 above, to the Ottawa Community Lands Development Corporation (OCLDC) on the basis outlined in this report. PLANNING COMMITTEE REPORT 36 C ZONING – PART OF 175-425 MARCH VALLEY ROAD AND 940 KLONDIKE ROAD COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning Bylaw 2008-250 to change the zoning of part of 175 and 425 March Valley Road, 940 Klondike Road and part of Lots 9 and 10, Concession 4, Geographic Township of March, described as Parts 7, 10, 14 and 16 on Plan 4R-16049 to permit the three-year extension for a golf course, as shown in Document 1 and detailed in Document 2. D ZONING - 1213 WOODROFFE AVENUE COMMITTEE RECOMMENDATION That Council approve an amendment to the Zoning By-law 2008-250 to change the zoning of 1213 Woodroffe Avenue from R1O, Residential First Density Zone, to R2G, Residential Second Density Zone, as shown in Document 2. E RESOLUTION OF ONTARIO MUNICIPAL BOARD APPEAL – ZONING 1440 BANK STREET COMMITTEE RECOMMENDATION That Council approve an amendment to Zoning By-law No. 2008-250 to change the zoning of 1440 Bank Street from AM1 – Arterial Mainstreet, Subzone 1 to AM1[1913] – Arterial Mainstreet, Subzone 1, Exception [1913] as shown on Document 1 and as detailed in Document 2. TRANSPORTATION COMMITTEE REPORT 20 F TRANSPORTATION MANAGEMENT IMPLEMENTATION PLAN FOR RICHMOND ROAD/WESTBORO -ADDITION OF AN INTERPRETATION SECTION TO THE REPORT COMMITTEE RECOMMENDATIONS That Council approve the addition of an Interpretation Section to the Transportation Management Implementation Plan for Richmond Road/Westboro. G PROPERTY ACQUISITION – TRIM ROAD PROJECT (NORTH SERVICE ROAD TO INNES ROAD), GUSARA THANDA COMMITTEE RECOMMENDATION That Council approve the acquisition of approximately 4,010 m2 of land in fee simple described as being part of Lot 30, Concession 1 in the Geographic Township of Cumberland, City of Ottawa and municipally known as 1465 Trim Road, shown as parcel 1 on Document 1 from Gusara Thanda for the consideration of $600,000 plus applicable taxes and legal fees related to the purchase pursuant to Section 30 of the Expropriations Act. H INSTALLATION OF A TRAFFIC CONTROL SIGNAL AT THE INTERSECTION OF BIRCH AVENUE AND HEMLOCK ROAD COMMITTEE RECOMMENDATION That Council approve the installation of a traffic control signal at the intersection of Birch Avenue and Hemlock Road as part of the upcoming East-West bikeway construction project. DISPOSITION OF ITEMS APPROVED BY COMMITTEES UNDER DELEGATED AUTHORITY That Council receive the list of items approved by its Committees under Delegated Authority, attached as Document 1. MOTION TO ADOPT REPORTS (Councillors D. Deans and T. Tierney) MOTIONS OF WHICH NOTICE HAS BEEN GIVEN PREVIOUSLY MOTION Moved by Councillor P. Hume Seconded by Councillor D. Chernushenko WHEREAS Dymon Self Storage proposes to construct and operate a roof top solar installation in its building located at 1830 Walkley Road, K1H 8K3 under the Province's FIT Program; AND WHEREAS the Applicant has requested that Council of City of Ottawa indicate by resolution Council's support for the construction and operation of the Project on the Property; AND WHEREAS, pursuant to the rules governing the FIT Program (the “FIT Rules”), Applications whose Projects receive the formal support of Local Municipalities will be awarded Priority Points, which may result in the Applicant being offered a FIT Contract prior to other persons applying for FIT Contracts; NOW THEREFORE BE IT RESOLVED THAT Council supports without reservation the construction and operation of the Dymon Self Storage roof top solar installation at 1830 Walkley Road, K1H 8K3; FURTHER BE IT RESOLVED THAT this resolution's sole purpose is to enable the Applicant to receive Priority Points under the FIT Program and may not be used for the purpose of any other form of municipal approval in relation to the Application or Project or any other purpose. MOTION Moved by Councillor S. Desroches Seconded by Mayor J. Watson Whereas 2012 is Her Majesty Queen Elizabeth II’s 60th anniversary since her accession to the Throne as Queen of Canada and Diamond Jubilee celebrations are taking place throughout Canada and the Commonwealth; and Whereas the City of Ottawa is the nation’s capital and home of the Queen’s representative in Canada and has a long history with Her Majesty and her family; and Whereas it is fitting that the City have a permanent remembrance of the jubilee celebrations; and Whereas the City of Ottawa will officially open a new central park in the Findlay Creek area in 2012 and the Findlay Creek Community Association has been consulted and is supportive of naming it “Diamond Jubilee Park”; and Whereas the City Clerk’s office has been consulted on the proposed park name and advises that there are no issues with the proposal; Therefore be it resolved that the new Findlay Creek central park be named “Diamond Jubilee Park” to commemorate the Queen’s Diamond Jubilee. MOTION Moved by Councillor S. Desroches Seconded by Councillor R. Bloess  WHEREAS the use of red light cameras has been shown to be a cost-effective way of increasing road safety and reducing accident-related injuries; and WHEREAS the requirement under the Highway Traffic Act that red light camera tickets be served on the offending vehicle owner by mail at the address recorded in the database maintained by the Ontario Registrar of Motor Vehicles; and WHEREAS this requirement prevents the effective use of red light camera enforcement where the offending vehicle is registered outside of the Province of Ontario, undermining the effectiveness of the red light camera project and resulting in a significant loss of fine revenue; and WHEREAS Ottawa City Council has petitioned the Minister of Transportation to make changes to the Highway Traffic Act to allow the use of ownership information maintained by other jurisdictions in order to “both facilitate the use of red light cameras and other photo-based traffic enforcement technologies in Ontario and help to ensure the uniform application of such road safety programs to all drivers on the Province’s roads”, and WHEREAS the Minister of Transportation has responded by indicating that “there is no restriction for a municipality to consult with other jurisdictions to seek individual information sharing agreements for plate registrant information” and also that “no further action was requested of the Ministry of Transportation”; and WHEREAS the rules under the Highway Traffic Act would still preclude the City from serving a red light camera ticket on a plate registrant from another jurisdiction, even if the City was able to obtain that information from the other jurisdiction; THEREFORE BE IT RESOLVED that Ottawa City Council reiterate its request for amendments to the Highway Traffic Act that would allow effective service of red light camera tickets on plate registrants from jurisdictions outside of Ontario, in the same manner as for plate registrants from within the Province. MOTION Moved by Councillor R. Chiarelli Seconded by Councillor A. Hubley WHEREAS Council has directed that the position of Auditor General be subject to performance reviews; and WHEREAS Council has delegated the authority for the performance review for the Auditor-General to the Finance and Economic Development Committee; and WHEREAS the last performance review for the position of the Auditor General was completed in 2008 for the period of 2004 to 2007, and it is important that performance reviews be completed in a more timely manner; and WHEREAS this City Council has established and mandated the Audit Sub-Committee, reporting through the Finance and Economic Development Committee, to oversee the annual work program for the Office of the Auditor General; THEREFORE BE IT RESOLVED that the performance review for the Auditor General be delegated to the Chair and Vice-Chair of the Audit Sub-Committee and the Mayor, as Chair of the Finance and Economic Development Committee, including all outstanding reviews, and that the Mayor, Chair and Vice-Chair be able to call on City staff expertise on an as-needed basis to support their work. Tierney WHEREAS the United Nations has declared October 11, 2012 as the first International Day of the Girl Child and Canada has led the international community in adopting this day; and WHEREAS the Day of the Girl is about highlighting, celebrating, discussing, and advancing girls lives and opportunities across the globe; and WHEREAS Gender equality is a fundamental right for all people as well as a cornerstone of global development, as research shows that investing in girls can create a ripple effect that not only improves the lives of girls but also benefits the economic growth and the health and well-being of communities; and WHEREAS the Day of the Girl Child recognizes that empowerment of and investment in girls is critical for economic growth and eradicating poverty; and WHEREAS meaningful participation of girls in decisions that affect them is key in breaking the cycle of discrimination and violence and in promoting and protecting the full and effective enjoyment of their human rights; THEREFORE BE IT RESOLVED THAT Ottawa City Council declare October 11, 2012, to be International Day of the Girl Child in the City of Ottawa and urge all citizens to support and participate in programs and events to improve the lives of girls everywhere.
