RECOMMENDATIONS
That Council:
1. direct staff to enter into negotiations
with the Ottawa Sports and Entertainment Group (“OSEG”) for an agreement
between it and the City for shuttle services within the existing approved
Transportation Demand Management measures for the Lansdowne Partnership Plan
that would ensure a sufficient number of shuttle service vehicles would be
accessible and accommodate the needs of the disabled community for events at
Lansdowne and for staff to report back on the results of the negotiations at
the first Transit Commission meeting in September, 2012; and
2. request that OSEG
consult with the City’s Accessibility Advisory Committee on this matter as part
of the negotiation process for such an agreement.

At the
Transit Commission meeting of 23 April 2012, after receiving a presentation
from staff on the Lansdowne Park transportation plan, Commissioner Crew put
forth the following motion:
WHEREAS the City’s Transit Services Department is committed
to providing public transit services that are environmentally sustainable,
customer-focused, safe, reliable and accessible; and
WHEREAS Council approved the City’s first Accessibility
Standards for Customer Service Policy on November 9, 2009 and, further, this
Policy as of June 1, 2011 applies to all Transit Services’ employees and
volunteers who deal with the public and who develop policy on behalf of
Transit Services; and
WHEREAS the Ottawa Sports and Entertainment Group (“OSEG”),
the City’s partner in the Lansdowne Partnership Plan (“LPP”), should consider
how it might utilize this Policy in providing shuttle services within the
existing approved Transportation Demand Management (“TDM”) measures for the
LPP for events at Lansdowne.
THEREFORE BE IT RESOLVED that Transit Commission recommends
that Council:
At the March 7, 2012 meeting of the City’s Transportation
Committee Councillor Deans raised an Inquiry asking how
the City will guarantee that any shuttle service provider contracted at
Lansdowne Park will meet the City transit service standards (i.e. low floor
buses, safety standards, bicycle racks).
The response to that Inquiry on March 27, 2012 indicated that the
specifics regarding the operations of shuttle services at Lansdowne are still
in development in accordance with the Transportation Demand Management
Plan. It further noted that the City is
working to determine if the shuttle service will be provided directly by OC
Transpo, through an external service provider which will be secured through a
competitive procurement process or a combination depending on the nature and
size of the event the shuttle service will be supporting. Staff will work to ensure that the shuttle
service agreement includes provisions for accessible shuttle service in the
proposed procurement process for any future shuttle service.
Departmental comments
Planning and Infrastructure Portfolio – Planning and
Growth Management Department
The Stage 1 Site Plan approval given by Council in November 2010 included a condition that an accessibility plan be developed for the Lansdowne Revitalization to achieve the highest degree of universal accessibility for the buildings and public realm areas and also set out a condition requiring a shuttle operations plan to detail shuttle services and associated operational requirements to meet needs for different event sizes. These conditions did not require that either the accessibility plan or the shuttle operations plan provide for having shuttles meet accessibility requirements in the manner required for OC Transpo. Both the strategy for dealing with accessibility on site and for the shuttle operations has been approved as part of the Stage 2 approval of the site plan.
The provision of shuttle services as set out in the approved Transit and Shuttle Operations Plan and Transportation Demand Management Plan under the conditions set out as part of the Stage 2 Site Plan approval is fully the responsibility of the Ottawa Sports and Entertainment Group (OSEG). The motion approved by the Transit Commission recommended to be approved by Council is therefore considered acceptable as it is directed to have staff pursue attaining an agreement with OSEG to provide as part of the shuttle service, vehicles that would be accessible to meet the needs of the disabled community for individuals who may wish to utilize off-site parking and shuttles services to attend events at Lansdowne and to have OSEG consult with the Accessibility Advisory Committee on this matter. Subject to Council approval, staff will pursue an agreement with OSEG and report back to the Transit Commission.

There are no direct
rural implications associated with this report.
Consultation
was not required for this administrative report to Council.
Subject to the comments set out hereafter,
there are no legal impediments to implementing the recommendations in the
report. However, the accessible shuttle service agreement between the
City and OSEG would be brought to the Transit Commission and Council for
information subsequent to Council receipt of the Lansdowne Partnership Plan
Agreements for legal close.
The motion requires Council approval to be operative since it was not previously part of any of the Council approvals pertaining to the Lansdowne Partnership Plan and since Ottawa Sports and Entertainment Group (“OSEG”) is not a “public transportation organization” it is not subject to the Accessibility for Ontarians with Disabilities Act, 2005, S.O. 2005, c. 11.
There are no risks associated with the report
recommendation.
The potential financial impact of this recommendation is unknown until
such time as negotiations are entered into with OSEG. Should there be
financial implications for the City resulting from the negotiated agreement,
this information would be included in the report brought back to Transit
Commission. If the report was received by the Transit Commission and Council,
the financial impact would be included for consideration in future budget
submissions.
Although
federally regulated, Transit Services in the City of Ottawa continues to
strive to meet the spirit and intent of the provincial AODA. The City will
pursue an agreement with OSEG to ensure that the shuttle service at Lansdowne
is consistent with the services provided by the City’s Transit Services and
strive to meet the spirit and intent of the AODA Customer Service
Regulation and that the AODA Integrated Accessibility Regulation. The City will work with OSEG towards an
agreement to confirm that the proposed transit services and programs described
in this report are accessible to persons with disabilities. In addition, the
information regarding shuttle service will be communicated in an accessible
format.
There
are no direct technical implications associated with this report.
