1. That the City permit the
South Kanata Development Corporation to front-end the design and construction
of the Monahan Stormwater Management Facility Upgrade subject to entering into
a front-ending agreement with the City in accordance with the Council-approved
Front Ending Policy;
2. That
the City reimburse the South Kanata Development Corporation for the
rehabilitation component of the works from the funds previously budgeted under
the Monahan Constructed Wetland Rehabilitation capital project 905757, once these works have been
accepted by the City; and,

le personnel soit enjoint de soumettre les modifications au Règlement sur les
redevances d’aménagement afin d’augmenter les redevances d’aménagement
relatives aux eaux de ruissellement propres au secteur en vue d’inclure les
coûts admissibles d’aménagement liés à cette réhabilitation.

Pursuant to Section 77 (12) of the Procedure By-law, Councillor Hubley requested that the following motion be placed on the Planning Committee Agenda of 8 May 2012:
WHEREAS
the Monahan Stormwater Management Facility constructed in the mid-1990’s is
presently in need of rehabilitation to deal with erosion, water quality and
water quantity issues;
and
WHEREAS the City has budgeted funds to undertake these rehabilitation works;
and
WHEREAS the Monahan Stormwater Management Facility will require further
improvements and expansion to accept additional flow associated with the
development of Monahan Landing Subdivision (formerly known as the Hope Lands);
and
WHEREAS the tributary area to the Monahan Stormwater Management Facility is
subject to an area-specific Development Charge associated with this facility;
and
WHEREAS the Owner of the Monahan Landing Subdivision, the South Kanata
Development Corporation, has approached the City with respect to front-ending
all of the works associated with upgrading the Monahan Stormwater Management
Facility;
THEREFORE
BE IT RESOLVED that the South Kanata Development Corporation be permitted to
front-end the design and construction of the Monahan Stormwater Management
Facility Upgrade subject to entering into a front-ending agreement with the
City in accordance with the Council-approved Front Ending Policy;
AND
BE IT FURTHER RESOLVED that the City reimburse the South Kanata Development
Corporation for the rehabilitation component of the works from the funds
previously budgeted under the Monahan Constructed Wetland Rehabilitation
capital project 905757, once
these works have been accepted by the City;
There are no rural implications to
this report.
The developer is
aware and supportive of this report.
Planning and Growth Management Comments
Staff support the proposed approach in that will facilitate the timely remediation of the existing facility as well allow for the required capacity expansion to accommodate planned growth. The Ministry of Environment is supportive of the timely implementation of the required improvements to the Monahan Stormwater Management Constructed Wetland Facility. The front ending will facilitate the development of the subject subdivision lands and also allow for the timely construction of important road linkages and park facilities that will not only serve the subdivision lands but will also benefit the existing Bridlewood community.
Councillor Hubley supports the amendment, and is moving the motion to this effect.
In order to implement the second recommendation to this report, an amendment to the Monahan Stormwater Management Facility Development Charge By-law will be required. Such an amendment is subject to appeal to the Ontario Municipal Board.
There are no risk management implications.
Capital
internal order 905757 Monahan Constructed Wetland Rehab has approved available
funding of $2.7 million for the rehabilitation component of the project.
Additional authority requirements for the design and construction, to be fully
funded by development charges, will be identified and included in the 2013 Rate
Capital Budget and in the DC By-Law amendment.
There are no accessibility impacts associated with
this report.
There
are no technology implications associated with this report.
By
providing for the appropriate treatment of stormwater, this report will
implement the Council priority of Environmental Stewardship.
The City Solicitor and Clerk’s Department in conjunction with the Planning and Growth Management Department will prepare the necessary agreements to implement this report.
The Planning and Growth Management Department will present the required background study to Planning Committee and Council for the amendment to the Monahan Stormwater Management Facility Development Charge By-law.
