The Council of the City of Ottawa met at Andrew S. Haydon Hall, 110 Laurier Avenue West, Ottawa, on 11 April 2012 beginning at 11:00 a.m.
The Mayor, Jim Watson, presided and led Council in prayer.
The National Anthem was performed by

Announcements/Ceremonial Activities
RECOGNITION
– CITY
BUILDER AWARD
Mayor Jim Watson and Councillor Jan Harder presented
the Mayor’s City Builder Award to Jeanine and Dean Otto for their selfless
contributions to the community. Mr. and Mrs. Otto, as a tribute to their
daughter who passed away soon after being diagnosed with an inoperable brain
tumor, raised more than $125,000 for the eight-bed palliative care facility on
the grounds of CHEO.
RECOGNITION – EQUITY AND DIVERSITY AWARDS
Mayor Jim Watson and City Manager
Kent Kirkpatrick presented Equity and Diversity Awards to the 2011 winners. The
individual Equity and Diversity Award
was issued to two individuals in the Transit Services Department. The award was
issued to Kathy Riley who played an instrumental role in the development of OC
Transpo’s Co-operative seating Campaign, the Travel Training Program and the
Community Bus Pass Program, and to Peter Paquette who displayed leadership in
developing an exceptional training program entitled “Learning My Way”.
The team Equity and Diversity Award went to the Cultural Plan Renewal Team comprised of Cathy Shepertycki, Catherine Caron, Jim Mountain, Kwende Kefentse, Natali Zuniga, Nicole Zuger and Debbie Hill. This team ensured that all diverse people and communities had an opportunity to give their input on their visions for the future of Ottawa’s arts, culture and heritage scene. They incorporated the equity and inclusion principles with its cultural service partners in the community throughout the City’s Cultural Plan Renewal process.

COLLECTIVE DE LA SECTION LOCALE 279 DU SYNDICAT UNI DU TRANSPORT |
WHEREAS the City of Ottawa (the City) and the
Amalgamated Transit Union, Local 279 (ATU 279) have committed to working
collaboratively to resolve issues of mutual concern in the workplace; and
WHEREAS this joint commitment resulted in a one-year
renewal of the collective agreement in October 2011 that was approved
unanimously by City Council and overwhelmingly supported by an 83% vote of the
ATU 279 membership; and
WHEREAS the City and ATU 279 committed to returning to
the bargaining table to negotiate a longer-term renewal of the collective
agreement; and
WHEREAS the collective agreement between the City and
the Amalgamated Transit Union, Local 279 (ATU 279) expired on March 31, 2012;
and
WHEREAS the bargaining teams for the City and the ATU
279 have been in negotiations since December 8, 2011, in an effort to conclude
a longer-term renewal of the collective agreement; and
WHEREAS the City and ATU 279 bargaining teams
concluded a tentative agreement on March 30, 2012, subject to ratification by
the ATU 279 membership and City Council; and
WHEREAS the ATU membership has ratified the tentative
agreement by a vote of 85%; and
WHEREAS the tentative agreement is affordable and fair
to taxpayers and our employees and serves to ensure continuous transit service
for passengers;
THEREFORE BE IT RESOLVED That City Council, with the
Transit Commission’s endorsement, ratify the tentative agreement reached with
the ATU Local 279 and that the terms of the tentative agreement be made public.

COMMITTEE RECOMMENDATIONS
That Council:
1.
Re-enact the Taxi By-law (By-law No. 2005-481,
as amended), as well as approve specific amendments thereto, as summarized
below and detailed in Document 1, to take effect September 1, 2012:
a)
increase the maximum age limit for a taxicab
from seven (7) to eight (8) model years, and the maximum age limit for
replacement vehicles from four (4) to five (5) model years;
b)
require that all taxicabs be inspected in the
Fall and that those taxicabs which are older than five (5) model years be
inspected in both the Spring and the Fall;
c)
permit all accessible plate holders to transfer
or sell their plates after five (5) years from the date of initial issuance or
from the transfer date, and repeal the requirement for them to be the primary
driver on the plate;
d)
not issue any additional accessible taxicab
plates until the plate/population ratio warrants it and, when that is the case,
authorize the Chief License Inspector to re-commence issuance accordingly;
e)
replace the requirement for all licensed taxicab
drivers to attend a refresher course with enhanced customer service training
for drivers where the Chief License Inspector deems it appropriate and that
delegated authority be granted the Chief License Inspector to so require;
f)
reflect the requirements and language used in
the Accessibility for Ontarians with
Disabilities Act, 2005, and Regulations under the Act, (e.g. the
prohibition from charging a fee for the storage of mobility aids or mobility
assistive devices);
g)
require that the vehicle identification number
on all taxicabs be in Arial 600 font;
h)
require that all accessible taxicab drivers be
required to provide accessible taxicab service in all areas of the City of
Ottawa with the following stipulations:
i.
service is to be provided for disabled persons
who are registered with Para Transpo or with a community support agency;
ii.
the transport of passengers is between the
unregulated (rural) area and the regulated area, and vice versa, only; and
iii.
the fare will be the amount shown on the meter
or $30.00, whichever is greater;
i)
establish a License Transfer Fee of $3800 per
plate upon the death of a plate holder with two or more plates to be
transferred;
j)
require, as a condition of issuance or renewal
of a license, that all applicants and licensees have duly paid all fines
imposed under the Provincial Offences Act;
k)
effect various administrative and minor policy
amendments, and clarifications, including the addition of definitions and of
the ability of the Chief License Inspector to impose
such additional conditions with respect to the issuance or renewal of a
license, as he or she deems necessary to ensure public safety (including
passengers and drivers) and consumer protection; and
Delegate
authority to staff to prepare a new, consolidated by-law, including the
above-noted amendments, to place on the Agenda of a future Council meeting.
2.
Direct staff to:
a) review the licensing and regulation of companies which
transport both the person and the person’s vehicle for a fee;
b) review the current limousine licensing regulations to
ensure that limousine operators do not operate as illegal or “bandit” taxicabs;
c) partner with the City’s Public Works Department to
develop amendments to the Traffic and Parking By-law to permit occupied
taxicabs to park in spaces adjacent to fire hydrants in order to increase the
number of taxi stand spaces, particularly in the city’s core areas;
d)
consider, the inclusion of a prohibition on the
advertising or promotion of illegal taxicabs by businesses licensed under that
by-law. as part of the Business Licensing By-law review

WHEREAS
Recommendation 1 h) iii currently recommends that all accessible taxicab
drivers be required to provide accessible taxicab service in all areas of the
City of Ottawa for disabled persons who are registered with Para Transpo or

regulated area, and vice versa such that “the fare will be the amount shown on
the meter or $30.00, whichever is greater”; and
WHEREAS
the current wording of this recommendation needs further refinement to reflect
the municipality’s statutory requirements under Section 80 (1) (a) of the
regulations pursuant to the Accessibility
for Ontarians with Disabilities Act, 2005;
THEREFORE
BE IT RESOLVED THAT Recommendation 1 h) iii be amended to delete the phrase,
“or $30.00, whichever is greater”.

Council wants to establish a level playing field for all current taxi plate
holders; and

Council seeks to create a uniform and equitable structure for plate ownership
for all previously issued plates; and

the Council may ultimately want to move toward a single transferable class of
taxi plate; and
WHEREAS
the plate owner may be able to transfer said plate on the open market at a
price dictated by the open market;
THEREFORE
BE IT RESOLVED THAT, given the growth of the City of Ottawa and the future
requirement for more taxis to service that growth, staff report back to Council
within six months on all possible options for restructuring taxi plate
fees, including options for capturing the market value of such plates for the
taxpayers of the City of Ottawa; and
BE IT FURTHER RESOLVED THAT Council direct that the Chief License
Inspector review options to determine how service demands could be met which
may include identifying mechanisms which would not allow for the transfer of
standard taxicab plates to occur unless such plates were made accessible.

That in conjunction with the Motion No. 32/4, staff be directed to investigate the following:
1) The possibility of requiring taxicab owners, when they are purchasing their next vehicle, to purchase accessible vehicles.
2) The possibility of having a commission paid to the City on the value of any transfer sale of a taxi license, e.g. if a taxi license is sold for $200,000, at 10% commission, the City would received $20,000 commission plus the license transfer fee.
That staff consider but not be limited to the following criteria when developing the refresher course outlined in 1.e) of the report: the number of consumer complaints against the driver, the years of driver experience as a taxi operator, and any and all Provincial Offences convictions.

COMMITTEE RECOMMENDATIONS
That Council approve:
1. The Brownfields Property Tax
Assistance/Rehabilitation Grant Application submitted by Unitrin Developments
Inc. and Triform Developments Inc., owners of the property at 280-300 West Hunt
Club Road, for a Brownfields Property Tax Assistance and Brownfields
Rehabilitation Grant not to exceed $4,579,511.00 payable as a property tax
rebate or equivalent to Unitrin Developments Inc. and Triform Developments Inc.
over a maximum of eight years subject to the establishment of, and in
accordance with, the terms and conditions of the Brownfields Property Tax
Assistance/Rehabilitation Grant Agreement;
2.
Delegation of
authority to the Deputy City Manager, Planning and Infrastructure, to execute a
Brownfields Property Tax Assistance/Rehabilitation Grant Agreement with Unitrin
Developments Inc. and Triform Developments Inc. establishing the terms and
conditions governing the payment of the Brownfields Property Tax Assistance/Rehabilitation
Grant for 280-300 West Hunt Club Road to the satisfaction of the Deputy City
Manager, Planning and Infrastructure, the City Clerk and Solicitor and the City
Treasurer;
3.
An exemption for
the proposed redevelopment at 280-300 West Hunt Club Road from paying future
Municipal development charges up to a maximum of $2,029,651.00 under Section 7
of the South Urban Centre Stormwater Development Charges By-law, 2009 in
accordance with the Guideline for the Development Charge Reduction Program due to
Site Contamination approved by Council March 28, 2007 and included in the
$4,579,511.00 grant request as outlined in Recommendation 1 above;
4.
The enactment of
a property tax assistance by-law providing tax assistance for the property at
280-300 West Hunt Club Road in the form of conditional cancellation and/or
deferral of the increase in the taxes levied on the property for municipal
purposes under the provisions and requirements of Section 365.1, as amended, of
the Municipal Act with the amount not to exceed $4,579,511.00
subject to the terms and conditions of the Brownfields Property Tax
Assistance/Rehabilitation Grant Agreement; and
5.
Staff to apply
for matching property education tax assistance for the property at 280-300 West
Hunt Club Road under the Provincial Brownfields Financial Tax Incentive Program
or through any other replacement program administered by the Ministry of
Municipal Affairs and Housing.

The construction of the intersection of
