3. Authorize the City to enter into a
Front-Ending Agreement with 2129786 Ontario Limited (Monarch and Cardel) to
enable the design and construction of Blackstone Park, located in the Fernbank
Community Development Plan area, in accordance with the Council approved Park
and Trail Front-Ending Policy in Document 1, the Front-Ending Agreement
principles set out in Document 6, to the satisfaction of the ISCS Deputy City
Manager and the City Clerk and Solicitor; and
4. In
accordance with the City Park and Trail Front-End Policy, authorize the
expenditure of $577,916, plus applicable taxes, for reimbursement of design and
construction costs for Par-La-Ville Park, Campobello Park, Tempest Park,
Fairwinds South Phase 5A Park and Blackstone Park as detailed in this report.

That Planning Committee recommends Council:

Par-la-Ville
Park is located in the Fairwinds North phase 1 development, which was
registered in 2008. Campobello Park is
located in the Fairwinds North phase 2A development, which was registered in
2010. Tempest Park is located in the
Fairwinds South Phase 3 development, which was registered in 2008. All of the above-mentioned subdivisions are
completely built out. Park locations are
shown in Documents 7, 8, and 9 respectively.
Fairwinds South phase 5A Park is located in the Fairwinds South Phase 5A development, which should be registered by the end of the first quarter of 2012. Blackstone Park is located in phase 1 of Monarch and Cardel’s Blackstone subdivision in Fernbank, which should be registered by the end of the second quarter of 2012. The developers have the option to front-end these parks through their subdivision conditions and through the Park and Trail Front-Ending Policy, attached as Document 1. The park locations are shown in Documents 10 and 11 respectively.
Tempest
Park and Par-La-Ville Park were both built in 2009, although they are not
scheduled for funding under the current four-year park budget forecast until
2012. These two parks already have been accepted and assumed by the City.
Campobello Park was built in 2010, while it is not scheduled for funding under
the current four-year park budget forecast until 2012. This park has not been
accepted by the City due to some outstanding minor deficiencies that need to be
resolved. In these three cases, the parks have been open for public use and
enjoyment for up to three years prior to when the City would have been able to
provide them to the public.
Fairwinds
South Phase 5A Park and Blackstone Park are scheduled for funding in 2013 under
the current four-year park budget forecast. Both developers have requested to
build their parks in 2012. To do so would ensure the parks are operational at
the time the homes in the developments are being built and occupied. Enabling
the developers to front-end the parks will allow the new communities to enjoy valuable
amenities in advance of the City's normal park delivery timelines based upon City
budget availability.
The annual operating impact is estimated to be $35,500 beginning in 2012.
There are no rural
implications associated with this report.
The
Ward Councillor was consulted on the design of Par-La-Ville, Campobello, and
Tempest Parks and provided approval of the proposed park facilities. The design process occurred very early on
prior to residents living in the area.
The impetus of this request was through the initiative of both the developer and the Department. Consultation with staff was ongoing throughout the design and construction of the parks.
Consultation for Fairwinds South Phase 5A Park and for Blackstone Park will be done with City staff and the Councillor throughout the design and the construction of the parks.

Bringing Par-La-Ville Park, Campobello Park, Tempest Park, Fairwinds South Phase 5A Park and Blackstone Park forward is in line with several City planning objectives. The first objective is to manage growth and create liveable communities by ensuring that community facilities are built in tandem with new development. The second objective is to deliver parks in a more timely manner that keeps pace with development, described in the New Park and Trail Front-Ending Policy approved by Council this year.

Funds for Park-La-Ville Park, Campobello Park and Tempest Park are available in the 2012 capital budget. Funds for Fairwinds Phase 5A Park and Blackstone Park will be brought forward in the draft 2013 capital budget. The growth portion of the capital works will be funded from development charges and the non-growth portion will be funded from the City-wide Cash-in-Lieu of Parkland Reserve Fund.
The operating maintenance cost for these parks is estimated to be $35,500 and will be included in the draft 2013 operating budget for Council consideration.

PARK AND TRAIL FRONT-ENDING POLICY DOCUMENT 1
Front-ending agreements for parks and trails
are requested by developers who wish to have specific new growth-related park
and trail works in place in advance of the City’s capital project funding for
emplacement of these same works. Developers may voluntarily agree to
finance the works at the “front end” and recover their costs from the City at a
later date. The following conditions must be met for the City to enter
into a front-ending agreement for parks and trails:
1.
All front-ending agreements with the City will be
for new park and trail growth-related capital works that have been included in
the City's Development Charges Background Study. A park front-ending agreement
is only available for parkettes and neighbourhood parks.
2.
The contract for front-ended works shall be awarded
by the front-ender in accordance with the City’s Purchasing Policy of a
competitive procurement process and subject to the review and satisfaction of
the General Manager, Planning and Growth Management Department. Where the
front-ender does not award the work in accordance with the City’s purchasing
policy, they must demonstrate that competitive pricing has been obtained,
through analysis of an independent, qualified professional, to the satisfaction
of the General Manager, Planning and Growth Management Department. The
contract for the work must be made available to the City to provide to the
public.
3.
A lump sum payment, both the development charge
portion and the City portion, will be paid back to the front-ender in the year
the project is identified in the City's Development Charges Background Study
based on the 10-year capital program at the time the front-ending agreement is
approved.
4.
The capital project upset limit for design and
construction, project management and contingency shall be established in the
Council report approving the front-ending agreement in accordance with the
Development Charge By-law and shall be incorporated into the agreement.
Any expenditures incurred above and beyond the amount approved in the agreement
cannot be claimed and must be incurred by the front-ender.
5.
Where a front-ender is eligible for reimbursement,
documentation is required to support the reimbursement in accordance with the
City’s Purchasing Policy. The front-ending agreement shall identify what
documentation and at which stage it shall be required.
6.
A report to Council is required to authorize staff
to enter into a front-ending agreement. The recommendation will include
the financial commitment of the City and specify the funding source(s) and the
project timeline. The financial comment in the report will specify the
timelines for repayment, an operating budget impact and an estimate of the year
in which the operating budget impact will begin. The report will also
specify that the letter of credit for the registered subdivision in which the
park is situated with not be reduced beyond what is required for the works
associated with the subdivision plus the cost of the front-ended works until
such time as the front-ended works are accepted by the City. A capital
project will be established upon Council approval to enter into the
front-ending agreement.
