Committee recommendation as amended

 

 

That Council approve an amendment to the Zoning By-law 2008-250 to temporarily change the residential parking requirement for Stittsville from one to two spaces, as detailed in Document 1, as amended to read as follows:

 

Amend Section 101 of By-law 2008-250 by adding to column IV of row (a)(iii), Table 101 the words “For a temporary period from March 28, 2012 to December 31, 2012 the requirement in Ward 6 as shown on Schedule 5 is 2 spaces, one of which may be provided on a driveway leading to a parking space, with the exception of a development for which an approval or a Notice of Decision by the City to issue approval to a draft plan of subdivision was issued under Section 51(37) before March 28, 2012 with respect to a Planning Act application or for which a complete building permit application was received prior to March 28, 2012.”

 

And that pursuant to the Planning Act, subsection 34(17) no further notice be given.

Que le Conseil approuve une modification suivante au Règlement de zonage 2008-250 afin de faire passer temporairement la norme pour le stationnement résidentiel à Stittsville de une à deux places, comme le précise le document 1, telle que modifiée par ce qui suit :

 

Modifier l’article 101 du Règlement 2008-250 en ajoutant la mention suivante à la colonne IV de la rangée (a)(iii), tableau 101 : « Pour une période temporaire allant du 28 mars 2012 au 31 décembre 2012, l’exigence imposée dans le quartier 6, illustrée à l’annexe 5, est de deux places, dont une peut se trouver dans une entrée privée menant à une place de stationnement, à l’exception des aménagements pour lesquels une approbation ou un avis de décision de la Ville d’émettre une approbation visant un plan de lotissement provisoire ont été donnés en vertu du paragraphe 51(37) avant le 28 mars 2012 dans le cadre d’une demande formulée aux termes de la Loi sur l’aménagement du territoire ou pour lesquels une demande complète de permis de construire a été reçue avant le 28 mars 2012. »


 

Il est également résolu que, conformément au paragraphe 34(17) de la Loi sur l’aménagement du territoire, aucun autre avis ne soit donné.

BACKGROUND

 

Purpose of Zoning Amendment

 

This proposed zoning amendment is the result of a motion passed by Planning Committee on January 24, 2012 which instructed staff to return to the March 13, 2012 Planning Committee meeting with a temporary Zoning By-law Amendment to reinstate a requirement in Stittsville for two parking spaces for detached, semi-detached and multiple attached properties with a front or corner side yard setback of three metres or less, to be in effect until December 31, 2012.

 

Existing Zoning

The current parking requirement for detached, semi-detached, and multiple attached dwellings in Stittsville is one space per dwelling unit.

 

Proposed Zoning

 

To require, on a temporary basis, two parking spaces, which may be provided in tandem, for detached, semi-detached, and multiple attached dwellings in R1, R2, R3, R4 and R5 zones in Stittsville where the required front yard setback or corner side yard setback is three metres or less.  The temporary zoning provision would be in effect from March 28, 2012 to December 31, 2012.

 

DISCUSSION

 

Official Plan

 

This proposal conforms with the Official Plan, as per Section 5.2.1, Policy 13 – Temporary Use Zones, which permits the City, in a Zoning By-law, to authorize the temporary use of lands, buildings or structures for any purpose set out therein that is otherwise prohibited by the Zoning By-law.

 

Details of Proposed Zoning

 

This proposal represents a reinstatement of the temporary zoning requirement that had previously been ordered by the Ontario Municipal Board on May 11, 2010.  This requirement, which has since expired, was intended to provide staff with adequate time to study and reach a resolution on the issue of Stittsville parking requirements.  A subsequent report to Planning Committee on January 24, 2012 recognized the challenges associated with compact suburban subdivision development and associated right-of-way standards, but did not recommend an increase in minimum residential parking requirements for Stittsville.  Instead it targeted December 2012 as the delivery date for findings and recommendations of the Intensification Implementation Working Group with respect to suburban subdivision standards.  Thus, the temporary zoning standard that had been established by the May 11, 2010 Ontario Municipal Board order is proposed to be reinstated until this study can be completed.

 

Response to Planning Committee Motion of January 24, 2012

 

At the January 24, 2012 Planning Committee, it was requested that staff provide comments on the applicability of this temporary Zoning By-law amendment for the entire suburban area.  It is noted that staff recommend this proposed temporary rezoning only as a stop-gap measure for Stittsville, given the historical context of the May 11, 2010 Ontario Municipal Board order and the temporary zoning provision that it had previously been in place.  Otherwise staff support the existing parking requirements of the Zoning By-law with respect to the remainder of the suburban area.

 

Council adopted the Comprehensive Zoning By-law in 2008, at which time new general residential parking provisions were adopted to reflect a more modern approach, with the objective of sustainable land use planning and development.  These minimum parking rates are founded on a principled, best-practices approach that is backed by the Provincial Policy Statement and the City’s Official Plan, and the Zoning By-laws of other Canadian cities.  They are also based on the need to promote more compact development patterns that minimize sprawl, make efficient use of land and infrastructure, encourage transit-supportive land uses, and generally help to create more affordable and liveable communities.

 

It is important to note that these are minimum, not maximum parking rates – developers have the option to provide more parking, and depending on market demand they may in fact choose to provide more than the minimum parking requirement.  That is, the current zoning has the built-in flexibility to allow for the provision of greater than the minimum parking requirement where appropriate.

There are no rural implications associated with this report.

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The City did not receive any negative comments or opposition to this application.

WHEREAS Report ACS2012-PAI-PGM-0055 recommends approval of a temporary Zoning By-law Amendment to require two parking spaces for detached, semi-detached and multiple attached dwelling units with a front or corner side yard setback of three metres or less;

 

AND WHEREAS there are in-stream planning applications and building permits that have been reviewed using the current parking provisions;

 

AND WHEREAS the proposed temporary Zoning By-law Amendment is only intended to apply to new development;

 

THEREFORE BE IT RESOLVED that Council approve:

 

1.                  That the Proposed Change to By-law 2008-250 in Document 1 be amended to read as follows:
