BACKGROUND
The subject lands (Document 1) are located at the west end of Burgess Avenue, west of Pulford Crescent. The western portion of the subject lands are partially utilized by the Ministry of Transportation for the purpose of an off-ramp from Highway 417, leading towards Richmond Road and Bayshore Drive. The remaining portion of the subject lands is untraveled.
The purpose of the Street Closure is to convey a portion of the lands (Parcel B – Document 2) to the Ministry of Transportation for the continued use as an off-ramp from Highway 417. In August 2009, the contract to construct the West Transitway Extension (between Bayshore Transit Station and Pinecrest Road) was completed. At this time it was agreed that the City would convey a segment of the subject lands to the Ministry of Transportation. The remaining portion (Parcel A – Document 2) of the proposed closure is to be conveyed to the adjacent property (Document 2) legally known as Lot 26 of Registered Plan 421148, for the purpose of residential development.
DISCUSSION
The Official Plan does not designate this road allowance as either a proposed or conceptual public road within Schedule E (Urban Road Network). The subject road allowance ends at the Off-Ramp for Highway 417. The lot abutting the subject lands to the north, 11 Burgess Avenue, is City-owned lands and is currently vacant. Its frontage will remain on Pulford Crescent.
The adjacent property is zoned Residential First Density, Subzone FF (R1FF), and permits the use of a single-detached dwelling. This lot measuring approximately 718 square metres, with a lot width of approximately 30 metres, complies with the required lot width and lot area for development as per the provisions under Zoning By-law 2008-250, Section 155-156. The conveyance of the subject lands to 11 Burgess Avenue would increase the lot area to approximately 905 square metres, and increase the lot width of this parcel to approximately 45 square metres.
CONSULTATION
Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.
In addition to the posting of an on-site sign and the circulation of the application summary to registered community groups in the subject area, three properties on Pulford Crescent deemed to be directly affected by the recommendation to close this segment of Burgess Avenue were circulated the Notice of Intent to Close.
A letter of objection was received from a property owner which stated an issue with the potential for a portion of the closed segment to be conveyed to the City owned property of 11 Burgess Avenue for future residential development. It was explained to the resident that the vacant lands of 11 Burgess Avenue is a complying lot zoned for residential development, and that the potential conveyance of lands from this road closure would increase this lot’s size. A further response from the resident was not received.
Councillor Taylor does not have any objection to the closure or to the conveyance of the excess land to city owned 11 Burgess Avenue. He has indicated that he would be active in any future residential development of the property to ensure it will fit in well with the community.

ENVIRONMENTAL IMPLICATIONS
The benefit of conveying a portion of the segment of the road closure to the adjacent property for residential development is that it will allow for a reduction in hard surfaces by providing an opportunity for landscaped areas of a residential property.

is consistent with the objectives of the City Strategic Plan which provides
guiding principles in creating a green and environmentally sensitive city, by
encouraging the wise use of lands and development within the urban boundary.

RECOMMENDATION
That
the Planning Committee recommend Council approve the closure of the segment of
Burgess Avenue, located west of Pulford Crescent.
Natalie Persaud, Planner, provided an
overview of the staff report and recommendation. A copy of her PowerPoint presentation is held
on file with the City Clerk.
Committee heard from one public
delegation. Gary Green, resident of Pulford Crescent, was opposed to the
staff recommendation. He opposed the
addition of the road allowance to the 11 Burgess avenue property and the sale
of that property for development. He suggested the increased lot size would
make it more desirable for developers to build a multiple-unit dwelling. He
also referenced a public meeting held prior to the City’s acquisition of the
Burgess Avenue properties for Transitway construction, indicating residents
were assured that after construction, the properties would be landscaped
parkland and there would be no residential development on the properties. He
spoke to the adverse effect of the pre-construction and construction period on
the neighbourhood.
The report recommendation was put to
Committee and CARRIED, as presented.
