REPORT RECOMMENDATION
That the Finance and Economic Development Committee recommend Council amend the Bank Street Business Improvement Area By-law to specify the composition of the Board of Management shall be 11 members, one of which shall be a Member of Council.
RECOMMANDATION(S) DU RAPPORT
Que le Comité des finances et du développement économique recommande au Conseil de modifier le Règlement sur la Zone d’amélioration commerciale de la rue Bank afin de préciser que le conseil d’administration se composera de 11 membres, l’un étant un membre du Conseil.
BACKGROUND
A Business Improvement Area (BIA) is an association of business people within a specified district who join together, with official approval from the City, in a self-help program aimed at stimulating local business. A BIA Board of Management is an organization set up to provide business promotion and improvement functions.
Section 204 of the Municipal Act, 2001 requires that the municipality appoint members to the BIA’s Board of Management. The current Bank Street BIA By-law (By-law 250-83) specifies the Board’s composition as follows: 11 members, 2 of which shall be Members of Council"
At their meeting of June 22nd, 2011, the Bank Street BIA Board of Management unanimously approved a motion formally requesting that the City of Ottawa amend the Bank Street BIA By-law so that it will specify the Board’s composition as follows:
“11 members, 1 of which shall be a member of Council.”
DISCUSSION
Since amalgamation, the City of Ottawa has never appointed more than one Member of Council to sit on the Bank Street BIA Board of Management. In order to have a full complement of Board membership, the BIA is recommending reducing the number of Council seats to 1 and increasing the number of “community” seats by 1.
This brings the composition of this BIA in line with the City’s other BIAs, where the local Ward Councillor is the only Member of Council to sit on the board of management.
RURAL IMPLICATIONS
There are no rural implications.
CONSULTATION
This is an administrative matter completed on behalf of the BIA. The BIA Board of Management unanimously supported the motion.
Council’s current appointee to the Board, Councillor Diane Holmes, supported the BIA motion.
COMMENTS BY THE WARD COUNCILLOR
“I concur with the recommendation. The Bank St. BIA’s catchment is entirely within Somerset Ward; as a result, the appointment of one rather than two Council members is most appropriate.”

WHEREAS the current Bank Street BIA By-law (By-law 250-83) specifies the Board’s composition as follows:
“11 members, 2 of which shall be members of Council";
AND WHEREAS, since municipal amalgamation in 2001, the City of Ottawa has never appointed more than one member of Council to sit on the Bank Street BIA Board of
Management;
AND WHEREAS it is highly desirable to have a full complement of Board membership and in order to achieve this, the BIA would benefit from reducing the number of Council seats to reflect the post-amalgamation reality and increasing the number of “community” seats;
THEREFORE BE IT RESOLVED that the Bank Street BIA Board of Management formally requests that the City of Ottawa amend the Bank Street BIA By-law so that it will specify the Board’s composition as follows:
“11 members, 1 of which shall be a member of Council".”
