COMMITTEE RECOMMENDATION

 

That Council consider the attached report pertaining to a request for modifications to drainage works under Section 78 of the Drainage Act and appoint Robinson Consultants Inc. as the Engineer of record to prepare a report in accordance with the Drainage Act of Ontario.

BACKGROUND

 

The City of Ottawa is in receipt of a request for modifications to Branch 6 of the Dowdall Municipal Drain under Section 78 of the Drainage Act from a landowner in the watershed of the drain.

 

 

DISCUSSION

 

The Dowdall Municipal Drain is located in the vicinity of the intersection of Franktown Road and Dwyer Hill Road and was originally constructed in 1971 under By-law 3969 of the former Township of Goulbourn and improved under By-law 2011-79 of the City of Ottawa.

 

The Drainage Act prescribes the process and timelines that must be followed for any modification or construction of a municipal drain.

 

This report places the request for modifications to an existing drainage works before the Agriculture and Rural Affairs Committee and Council as required under Section 78 of the Act.

 

Schedule for the Dowdall Municipal Drain Modifications

 

Should the Agriculture and Rural Affairs Committee and Council approve the appointment of the Engineer, Robinson Consultants Inc., the estimated schedule will be as follows:

 

·         Council approval and appointment of Engineer – October 2011

·         Preparation of report – November 2011 to April 2012

·         Review of preliminary report by regulatory agencies – April/May 2012

·         Submission of report and notification period – June 2012

·         Consideration of report and By-law by Committee and Council – Q3 of 2012

·         Construction of drainage works, if approved – Q4 of 2012

 

 

RURAL IMPLICATIONS

 

This portion of the land in the watershed of Branch 6 of the Dowdall Municipal Drain is currently used by the Department of National Defence.  The drainage works will continue to provide outlet for area roads, including Dwyer Hill Road.

 

 

CONSULTATION

 

Consultation between landowner representatives, the City Drainage Superintendent, consultants and regulatory agencies is ongoing.

 

 

COMMENTS BY THE WARD COUNCILLOR

 

The Councillor for Rideau-Golbourn is aware of this report and the proposed drainage works.

 

 

LEGAL IMPLICATIONS

 

There are no legal impediments to implementing the recommendation in this report.

 

 

RISK MANAGEMENT IMPLICATIONS

 

There are no risk implications.

 

 

FINANCIAL IMPLICATIONS

 

All costs associated with this undertaking will be paid for from Internal Order 906194 Municipal Drain Improvements and recovered, in its entirety, from the benefiting landowners according to the Report of the Engineer and associated By-law.  Funds in this account are available in the approved 2011 Capital budget.

 

 

ENVIRONMENTAL IMPLICATIONS

 

The modifications to Branch 6 of the Dowdall Municipal Drain are associated with development on federally-owned lands.  There are no provincially significant wetlands affected by this undertaking.  Any proposed works will require compliance with City, Provincial and Federal policies, standards, regulations and legislation.

 

 

TECHNOLOGY IMPLICATIONS

 

There are no technology implications.

 

 

CITY STRATEGIC PLAN

 

The proposed works to Branch 6 of the Dowdall Municipal Drain will fulfill the City’s Strategic Plan’s environment and infrastructure protection priorities.

DISPOSITION

 

The Drainage Superintendent shall notify all affected landowners and the local conservation authority of the decision of Council.
