REPORT RECOMMENDATION

 

That the Planning Committee recommend Council approve the deletion of the requirement for Mattamy to construct the sidewalk on River Landing Avenue in Subdivision Plan 4M-1428, Half Moon Bay.

BACKGROUND

 

At the 13 September 2011 meeting of the Planning Committee, Councillor Harder introduced the following Notice of Motion:

 

WHEREAS the subdivision agreement for Plan 4M-1428 in Half Moon Bay provides for the construction of a sidewalk on River Landing Avenue;

 

AND WHEREAS street lights have been constructed in the subdivision;

 

AND WHEREAS the construction of the sidewalk would require the removal and replacement of the street lights;

 

THEREFORE BE IT RESOLVED that Council approve the deletion of the requirement for Mattamy to construct the sidewalk on River Landing Avenue in Subdivision Plan 4M-1428, Half Moon Bay.

 

 

DISCUSSION

 

A decision to remove the requirement for sidewalks at this location would be consistent with the decision made by Council on September 8, 2010 to remove sidewalks from local streets in Half Moon Bay where there is access to the sidewalk network which connects to major walking designations, such as the school, park and stormwater pond, within close proximity (as shown on Document 1, Location Map).  Those affected by this deletion only include the residents of units fronting onto River Landing Ave. The impact is minimal and limited.

 

The urban intensification working group is still reviewing this issue from a broader policy context.

 

 

Planning and Growth Management Comments

 

Planning and Growth Management have no objection.

Notice of this meeting was advertised on the City’s website as per Section 77(1)(b) of the Procedure By-law.

 

 

COMMENTS FROM THE WARD COUNCILLOR

 

Councillor Harder is in support of removing the sidewalks, and has moved the motion to this effect.

 

 

FINANCIAL IMPLICATIONS

 

There are no financial implications.

 

 

LEGAL IMPLICATIONS

 

There are no legal implications associated with the report.

 

The requirement for sidewalks in the locations identified in the recommendations is encouraged by the Council-approved Barrhaven South Community Design Plan.  While there are no legal implications to this matter, given the policy basis for the sidewalks, Legal Services has provided the opinion that the recommendation should be submitted to Committee and Council for approval.
