BY-LAW NO.  2011 –

 

A by-law of the City of Ottawa to levy an annual tax upon colleges and universities for the year 2011.

 

WHEREAS pursuant to Section 323 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, (the “Municipal Act, 2001”), the Council of a local municipality may by by-law levy upon a university designated by the Minister of Training, Colleges and Universities or a college of applied arts and technology, an annual tax not exceeding the prescribed amount for each full-time student enrolled in such university or college in the year preceding the year of levy, as determined by the Minister of Training, Colleges and Universities;

 

                        AND WHEREAS pursuant to Ontario Regulation 384/98, as amended, made under the Municipal Act, 2001, the prescribed amount for the purpose of Section 323 (1) of the Act is $75.00 per full-time student, per year;

 

                        AND WHEREAS City Council has, in the past years, levied the maximum allowable amount on these institutions;

 

                        AND WHEREAS City Council considers it desirable to continue to levy the maximum allowable amount on these institutions;

 

                        AND WHEREAS the capacity of full-time student enrollment has been determined at:

 

(a)               Carleton University has 20,940 students;

(b)               University of Ottawa has 32,330 students;

(c)               St. Paul's University has 481 students;

(d)              Algonquin College of Applied Arts and Technology has 14,121 students;

(e)               Dominican’s College of Philosophy and Theology has 93 students; and

(f)                La Cité Collégiale (Caat) has 4,118 students.

 

THEREFORE the Council of the City of Ottawa enacts as follows:

 

1.                     There will be levied upon the Carleton University for 2011 a tax of $75.00 for each of the 20,940 full-time students enrolled in the university, the annual tax levied being $1,570,500.00.

 

2.                                          There will be levied upon the University of Ottawa for 2011 a tax of $75.00 for each of the 32,330 full-time students enrolled in the university, the annual tax levied being $2,424,750.00.

 

3.                                          There will be levied upon the St. Paul’s University for 2011 a tax of $75.00 for each of the 481 full-time students enrolled in the university, the annual tax levied being $36,075.00.

 

4.                     There will be levied upon the Algonquin College of Applied Arts and Technology for 2011 a tax of $75.00 for each of the 14,121 full-time students enrolled in the college, the annual tax levied being $1,059,075.00.

 

5.                                          There will be levied upon the Dominican’s College of Philosophy and Theology for 2011 a tax of $75.00 for each of the 93 full-time students enrolled in the college, the annual tax levied being $6,975.00.

 

6.                                          There will be levied upon La Cité Collégiale (CAAT) for 2011 a tax of $75.00 for each of the 4,118 full-time students enrolled in the college, the annual tax levied being $308,850.00.

 

7.                                          The taxes levied under this by-law shall be paid to the City of Ottawa on or after July 1, 2011.

 

8.                                          The taxes levied under this by-law are recovered in the same manner as municipal taxes are recovered and are a special lien on the lands of the universities and colleges pursuant to the provisions of section 349 of the Municipal Act, 2001.

BY-LAW NO. 2011 -

 

                        A by-law of the City of Ottawa to levy an annual amount upon Ottawa Carleton Detention Centre for the year 2011.

 

                        WHEREAS pursuant to Section 323 (2) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, (the “Municipal Act, 2001”), the Council of a local municipality may by by-law levy upon a correctional institution designated by the Minister of Community Safety and Correctional Services, or a training school, or place of secure custody designated under subsection 85(2) of the Youth Criminal Justice Act (Canada) and designated by the Minister Community and Social Services, an annual amount not exceeding the prescribed amount for each resident place in such institution or school in the year preceding the year of levy, as determined by the Minister of Community Safety and Correctional Services or the Minister of Community and Social Services, as the case may be;

 

                        AND WHEREAS pursuant to Ontario Regulation 384/98, as amended, made under the Municipal Act, 2001, the prescribed amount for the purpose of Section 323 (2) of the Act is $75.00 per resident per year.

 

                        AND WHEREAS City Council has, in the past years, levied the maximum allowable amount on these institutions;

 

                        AND WHEREAS City Council considers it desirable to continue to levy the maximum allowable amount on these institutions;

 

                        AND WHEREAS the number of resident places has been determined at Ottawa Carleton Detention Centre as 575 resident places;

 

                        THEREFORE the Council of the City of Ottawa enacts as follows:

 

1.                                          There will be levied upon Ottawa Carleton Detention Centre for 2011 an amount of $75.00 for each of the 575 residents placed in the institution, the annual amount levied being $43,125.00.

 

2.                                          The amount levied under this by-law shall be paid to the City of Ottawa on or after July 1, 2011.

 

3.                                          The amount levied under this by-law shall be recovered in the same manner as municipal taxes are recovered and is a special lien on the lands of the correctional institution pursuant to the provisions of section 349 of the Municipal Act, 2001.

BY-LAW NO. 2011 -

 

A by-law of the City of Ottawa to levy an annual amount upon public hospitals or provincial mental health facilities for the year 2011.

 

                        WHEREAS pursuant to Section 323 (3) of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, (the “Municipal Act, 2001”) the Council of a local municipality may by by-law levy upon a public hospital or a provincial mental health facility designated by the Minister of Health and Long-Term Care and situate in the municipality, an annual amount not exceeding the prescribed amount for each provincially rated bed in such public hospital or provincial mental health facility, as determined by the Minister of Health and Long-Term Care;

 

                        AND WHEREAS pursuant to Ontario Regulation 384/98 as amended, made under the Municipal Act, 2001, the prescribed amount for the purpose of Section 323(3) of the Municipal Act is $75.00 per rated bed, per year. 

 

                        AND WHEREAS City Council has, in the past years, levied the maximum allowable amount on these institutions;

 

                        AND WHEREAS City Council considers it desirable to continue to levy the maximum allowable amount on these institutions;

 

                        AND WHEREAS the Minister of Health and Long-Term Care has determined the capacity of provincially rated beds at:

 

(g)               Children’s Hospital of Eastern Ontario has 230 beds;

(h)               Montfort Hospital has 289 beds;

(i)                 Royal Ottawa Hospital has 179 beds;

(j)                 Bruyere Continuing Care Corp has 741 beds;

(k)               The Ottawa Hospital has 1,689 beds

(l)                 Queensway-Carleton Hospital has 288 beds and;

(m)             University of Ottawa Heart Institute has 141 beds

 

THEREFORE the Council of the City of Ottawa enacts as follows:

 

1.                     There will be levied upon the Children’s Hospital of Eastern Ontario for 2011 an amount of $75.00 for each of the 230 rated beds in the hospital, the annual amount levied being $17,250.00.

 

2.                    There will be levied upon the Montfort Hospital for 2011 an amount of $75.00 for each of the 289 rated beds in the hospital, the annual amount levied being $21,675.00.

 

3.                                There will be levied upon the Royal Ottawa Hospital for 2011 an amount of $75.00 for each of the 179 rated beds in the hospital, the annual amount levied being $13,425.00.


4.                                          There will be levied upon the Bruyere Continuing Care Corp for 2011 an amount of $75.00 for each of the 741 rated beds in the hospital, the annual amount levied being $55,575.00.

 

5.                     There will be levied upon The Ottawa Hospital for 2011 an amount of $75.00 for each of the 1,689 rated beds in the hospital, the annual amount levied being $126,675.00.

 

6.                                          There will be levied upon the Queensway-Carleton Hospital for 2011 an amount of $75.00 for each of the 288 rated beds in the hospital, the annual amount levied being $21,600.00.

                                                                                                   

7.                                          There will be levied upon the University of Ottawa Heart Institute for 2011 an amount of $75.00 for each of the 141 rated beds in the hospital, the annual amount levied being $10,575.00.

 

8.                                          The amounts levied under this by-law shall be paid to the City of Ottawa on or after July 1, 2011.

 

9.                                          The amounts levied under this by-law are recovered in the same manner as municipal taxes are recovered and are a special lien on the lands of the public hospitals and provincial mental health facilities pursuant to the provisions of section 349 of the Municipal Act, 2001.

BY-LAW NO. 2011 -

 

                        A by-law of the City of Ottawa to levy an annual amount upon provincial education institutions for the year 2011.

 

                        WHEREAS pursuant to Section 323 (5) of the Municipal Act, 2001, S.O. 1990, c. 25, as amended, (the “Municipal Act, 2001”), the Council of a local municipality may by by-law levy upon a provincial education institution situate in the municipality an annual amount not exceeding the prescribed amount for each place in such institution as determined by the Minister under whose jurisdiction such institution falls;

 

                        AND WHEREAS pursuant to Ontario Regulation 384/98, as amended, made under the Municipal Act, 2001, the prescribed amount for the purpose of Section 323 (5) of the Act is $75.00 per year;

 

                        AND WHEREAS City Council has, in the past years, levied the maximum allowable amount on these institutions;

 

                        AND WHEREAS City Council considers it desirable to continue to levy the maximum allowable amount on these institutions;

 

              AND WHEREAS the capacity has been determined at Centre Jules-Léger as 74 places;

 

                        THEREFORE the Council of the City of Ottawa enacts as follows:

 

1.                                          There will be levied upon the Centre Jules-Léger for 2011 an amount of $75.00 for each of the 74 places in the provincial education institution, the annual amount levied being $5,550.00.

 

2.                                          The amount levied under this by-law shall be paid to the City of Ottawa on or after July 1, 2011.

 

3.                                          The amount levied under this by-law shall be recovered in the same manner as municipal taxes are recovered and is a special lien on the lands of the provincial education institution pursuant to the provisions of section 349 of the Municipal Act, 2001.
