1.            that the Permanent Signs on Private Property By-law 2005-439 (as amended) be waived to allow a mural on the portable building located at 6 Lisa Avenue; and

 

2.            that, in accordance with By-law 2002-522 (as amended) respecting public notice, and in particular notice for changes to the Permanent Signs on Property By-law, that the notice requirements be waived as the timeline for a decision in order to proceed with this mural during the summer does not make it possible to comply with the notice requirements.

That Council approve:

BACKGROUND

 

Councillor Chiarelli moved the addition of this item at the Planning Committee meeting of 28 June 2011.  The following motion was added and approved:

 

WHEREAS in May 2007 City Council approved the Graffiti Management Strategy, which identifies the use of murals and art as an effective deterrent;

 

AND WHEREAS the Ottawa West End Community Chaplaincy, a non-profit entity representing 17 places of worship that provide services to the tenants of Morrison Gardens, are planning a mural to be painted on the south wall of a portable that they own which is used by the community;

 

AND WHEREAS the portable is located in Lisa Park which is zoned O1 (open space zone), and is therefore subject to the District 1 regulations of the Permanent Signs on Private Property By-law which do not permit murals in this District;

 

AND WHEREAS prior to amendments to the Permanent Signs on Private Property By-law in 2008 grouping together the zones of the new Comprehensive Zoning By-law under various signs Districts, parks such as Lisa Park were subject to the District 3 regulations which permitted murals;

 

AND WHEREAS the O1 zone for such parks should instead be subject to the District 2 rather than the District 1 sign regulations, consistent with other similar open space zones which are in a District 2, where murals are permitted for institutional uses;

 

AND WHEREAS it is intended to align certain zones under a more appropriate sign District in a report on technical amendments to the Permanent Signs on Private Property By-law in the fall of 2011;

 

THEREFORE BE IT RESOLVED that the Permanent Signs on Private Property By-law 2005-439 (as amended) be waived to allow a mural on the portable building located at 6 Lisa Avenue; and

 

BE IT FURTHER RESOLVED THAT in accordance with By-law 2002-522 (as amended) respecting public notice, and in particular notice for changes to the Permanent Signs on Property By-law; that the notice requirements be waived as the timeline for a decision in order to proceed with this mural during the summer does not make it possible to comply with the notice requirements.

 

 

DISCUSSION

 

The Ottawa West End Community Chaplaincy, a non-profit entity representing 17 places of worship that provide services to the tenants of Morrison Gardens, is planning a mural for the south wall of a portable building that they own in Lisa Park. The Graffiti Management Strategy approved by Council in 2007 identifies the use of murals and art as an effective deterrent for graffiti. 

 

Lisa Park, located at the northwest corner of Lisa avenue and Greenbank road, is zoned O1 (open space zone), and is therefore subject to the District 1 regulations of the Permanent Signs on Private Property By-law which do not permit murals in this District.  Prior to amendments to the Permanent Signs on Private Property By-law in 2008, which grouped together the zones of the new Comprehensive Zoning By-law under various signs Districts, parks such as Lisa Park were subject to the District 3 regulations, which permitted murals.

 

As indicated at the Planning Committee meeting, staff agrees that the O1 zone for parks such as Lisa Park should instead be subject to the District 2 rather than the District 1 sign regulations, consistent with other similar open space zones which are in a District 2, where murals are permitted for institutional uses.  Staff intends to bring forward a on technical amendments to the Permanent Signs on Private Property By-law in the fall of 2011, which is intended to align certain zones under a more appropriate sign District in a report. 

 

CONSULTATION

 

No specific public consultations were undertaken in the production of the report.  Staff in the Building Code Services Branch, Planning and Growth Management Department, were consulted in the preparation of this motion.

No legal/ risk management implications have been identified.  Staff will be available at the Council meeting to speak to any legal/risk management implications.

Staff in Building Code Services will implement the directions of Council and issue any necessary permits.
