RECOMMENDATION
That Council consider the attached report pertaining to a request for modifications to drainage works under Section 78 and 84 of the Drainage Act and appoint Robinson Consultants Inc. as the Engineer of record to prepare a report in accordance with Section 10 of the Drainage Act of Ontario.

REPORT RECOMMENDATION
That the Agriculture and Rural Affairs Committee recommend that Council consider the attached report pertaining to a request for modifications to drainage works under Section 78 and 84 of the Drainage Act and appoint Robinson Consultants Inc. as the Engineer of record to prepare a report in accordance with Section 10 of the Drainage Act of Ontario.

BACKGROUND
The
City of Ottawa is in receipt of a request for modifications to the Monahan
Municipal Drain under Section 78 of the Drainage Act from a group of
landowners in the watershed of the drain in the Fernbank Community area in Rideau-Goulbourn
and Kanata Wards.
DISCUSSION
The
Monahan Municipal Drain was first constructed in 1969 under By-law 19-69 in the
former Township of Goulbourn and improved under By-laws 41-73 and 2003-396 in
the City of Ottawa. Under
Sections 65, 78 and 84 of the Drainage Act, R.S.O. 1990, a new
Engineer’s report is required to address these modifications and drainage
issues within the subwatershed to accommodate approved development and improved storm
water management in the Fernbank Community area.
The Drainage Act prescribes the process and timelines that must be followed for any modification or construction of a municipal drain.
This
report places the request for modifications to an existing drainage works
before the Agriculture and Rural Affairs Committee and Council as required under
Sections 65, 78 and 84 of the Drainage Act.
Should Committee and Council approve the appointment of the Engineer, Robinson Consultants Inc., the estimated schedule will be as follows:
· Council approval and appointment of Engineer – July 2011
· Preparation of report – July to December 2011
· Review of preliminary report by regulatory agencies – December 2011
· Submission of report and notification period – January 2012
· Consideration of report and By-law by Committee and Council – Q1 of 2012
·
Construction
of drainage works, if approved – Summer 2012
A portion of the land in the watershed of the Monahan Municipal Drain is currently used for agricultural purposes. In addition to providing legal and sufficient outlet for the proposed subdivision the drainage works will continue to provide outlet for area roads, including Terry Fox Drive.
CONSULTATION
As part of the development planning process consultation between the developers, their representatives, City staff and regulatory agencies is ongoing.

The Councillor for Rideau-Golbourn is aware of this report and the proposed drainage works.
LEGAL IMPLICATIONS
There are no legal impediments to implementing the recommendation in this report.
RISK MANAGEMENT IMPLICATIONS
There are no risk implications.
FINANCIAL IMPLICATIONS
All costs associated with this undertaking will be paid for from Internal Order 906194 Municipal Drain Improvements and recovered, in its entirety, from the benefiting landowners according to the Report of the Engineer and associated By-law. Funds in this account are available in the 2011 Capital budget.
ENVIRONMENTAL IMPLICATIONS
The modifications to the Monahan Municipal Drain are associated with a development application for the area for which discussions with the various City departments and regulatory agencies are ongoing. The proposed storm water management system, including any drainage works modifications, will provide outlet for the proposed subdivision and improve storm water management in the area while continuing to provide legal and sufficient outlet for area lands and roads, including some agricultural lands. There are no provincially significant wetlands affected by this undertaking and any works will protect and enhance fish habitat. Any proposed works will require compliance with City, Provincial and Federal policy standards, regulations and legislation.
