That the Ottawa Built Heritage Advisory
Committee recommend that Planning Committee recommend that Council approve the
public consultation policy for the adoption of Heritage Conservation District
plans as detailed in Document 1.

Comité de l’urbanisme de recommander à son tour au Conseil d’approuver la
politique sur les consultations publiques pour l’adoption des plans des
districts de conservation du patrimoine, telle qu’établie dans le document 1.
BACKGROUND
Part V of the Ontario Heritage Act provides the City with the ability to designate Heritage Conservation Districts through a municipal by-law. There are currently 16 Heritage Conservation Districts in Ottawa.
This report has been written to
establish and approve a consultation policy related to the adoption of new Heritage
Conservation District plans in accordance with Section 41.1 (6) of the Ontario Heritage Act.
DISCUSSION
The Ontario Heritage Act was updated in 2005 to provide municipalities with increased ability to protect built heritage. One of the additional requirements in the amended Act is the requirement for Council to adopt a Heritage Conservation District plan as part of the designation of any new districts.
A Heritage Conservation District plan is a document that is meant to outline the cultural heritage value and heritage attributes of the district and provide policy statements and guidelines for the management of change in the district in the future.
According to Section 41.1 (6), before passing a by-law adopting a Heritage Conservation District plan, the Council must ensure that:
(a)
Information
relating to the proposed heritage conservation district plan, including a copy
of the plan, is made available to the public;
(b)
At least one
public meeting is held with respect to the proposed heritage conservation
district plan; and
(c)
If the
council of the municipality has established a municipal heritage committee
under section 28, the committee is consulted with respect to the proposed
heritage conservation district plan. 2005 c.6, s.31
Section 41.1 (7) describes the manner in which notice of the public meeting described above in Section 41.1 (6) b is to take place:
The clerk of a municipality shall give
notice of a public meeting to discuss a proposed heritage conservation district
plan in such manner as the council of the municipality determines is
appropriate and to such persons and bodies the council believes may have any
interest in the plan. 2005,c.6, s.31.
The Public Consultation Policy spelled out in Document 1 fulfills the requirement of Section 41.1 (6) b and 41.1 (7).
RURAL
IMPLICATIONS
The public notification policy will apply equally to the urban and rural areas of the City.
CONSULTATION
This report deals with a consultation process under the Ontario Heritage Act. No consultation has taken place.

Adoption of the recommendations in this report will implement the provisions of the Ontario Heritage Act, subsection 41.1(7) with respect to Council authorizing a public notification policy for Heritage Conservation District Plans.

item for consideration by the committee at today’s meeting, pursuant to section
20(3) of the procedure by-law (being By-law no. 2007-104).
Lesley Collins, Heritage Planner,
introduced the report, explaining it is simply the formalization of a public
consultation policy for the practice that has been followed with respect to the
adoption of Heritage Conservation District plans.

During the course of the legal review of an upcoming report on the proposed
Clemow East Estate Heritage Conservation District, it was noted that Council
has not approved a notification policy for Heritage Conservation District
Plans;

WHEREAS approval of such a notification policy would permit the Clemow East
Estate Heritage Conservation District to move forward in a timely manner;

IT RESOLVED that the Planning Committee
approve the addition of this item for consideration by the Committee at today’s
meeting, pursuant to section 84(3) of the procedure by-law (being by-law no.
2006-462).
