That Council recommend that the City of Ottawa waive the patio encroachment permit fee for Feleena’s for the duration of Bank Street reconstruction in 2011.

That the Transportation Committee recommend to Council that the City of Ottawa waive the patio encroachment permit fee for Feleena’s for the duration of Bank Street reconstruction in 2011.
Que le Comité des transports recommande au Conseil de demander à la Ville d’Ottawa de renoncer aux droits de permis d’empiétement dans le cas du restaurant Feleena’s pour la durée des travaux de réfection de la rue Bank en 2011.
Councillor Chernushenko moved the addition of this item at the Transportation Committee meeting of 4 May 2011: The following motion was added and approved.
WHEREAS Bank Street reconstruction between Holmwood and the Queensway will take place from May to November 2011; and
WHEREAS Feleena’s Restaurant at 724 Bank Street has an outdoor patio; and
WHEREAS Feleena’s would typically pay a patio encroachment fee to the City of Ottawa of approximately $9,400.00 for the 2011 patio season; and
WHEREAS due to Bank Street reconstruction Feleena’s patio will be subjected to the noise, dust and temporary closures of road reconstruction for the duration of the patio season and therefore be mostly unusable;
THEREFORE BE IT RESOLVED THAT the Transportation Committee recommend to Council that the City of Ottawa waive the patio encroachment permit fee for Feleena’s for the duration of Bank Street reconstruction in 2011;
BE IT FURTHER RESOLVED that this matter rise to Council on 11 May 2011.
Staff in Planning and Growth Management have reviewed and agree with the motion.
There are no legal/risk management impediments to implementing the recommendation in this report
The associated patio permit fees are approximately $10,040. Waiving theses fees will reduce Planning and Growth Management’s 2011 operating revenues by this amount, which may affect the department’s operating budget status.

That the Transportation Committee approve the addition of the following item for consideration by the Committee at today’s meeting, pursuant to Section 84(3) of the Procedure By-law (being By-law No. 2006-462):
“Operation of Feleena’s Patio during Bank Street Reconstruction – Patio encroachment permit fee”
