That the Agriculture and Rural Affairs Committee recommend Council approve that staff be directed to include policies for infill severances outside of historic settlement areas as part of staff’s review and consultation through its “Rural Review” process.

BACKGROUND

 

At the 3 March 2011 (Regular) meeting of the Agriculture and Rural Affairs Committee, Councillor El-Chantiry submitted the following motion for consideration at the Committee’s next regular meeting:

 

WHEREAS policies for infill severances outside of historic settlement areas (3.7.2.21) in the rural area were introduced through OPA 76;

 

AND WHEREAS City staff are undertaking a review of a number of rural policies within the Official Plan that has been described in previous reports to Council as the “Rural Review”;

 

THEREFORE BE IT RESOLVED THAT staff be directed to include these policies as part of their review and consultation through the “Rural Review” process.

 

 

DISCUSSION

 

As the City is to undertake a review of a number of rural policies within its Official Plan through its “Rural Review”, the Councillor has indicated that by way of the above Motion, he wishes to ensure that this review include policies for infill severances outside of historic settlement areas, introduced through Official Plan Amendment (OPA) 76. 

 

 

STAFF COMMENTS

 

Planning and Growth Management

 

The new severance policies related to ‘infill severances outside of historic settlement areas” that were included in Official Plan Amendment (OPA) 76 were proposed and included by Councillor Motion at the Joint Planning and Environment Committee and Agriculture and Rural Affairs Committee.  Those policies were subsequently approved by Council and the Ministry but have been appealed to the OMB and are scheduled to be considered at a Hearing in October 2011.   

 

The Agricultural and Rural Affairs Committee at their meeting of January 25th 2011 requested staff to include the review of a proposal for large lot severances as part of the review of rural policies for the next Official Plan update scheduled for 2014.  Staff proposes to include the requested review of the policies for “infill severances outside of historic settlement areas” as part of the City’s commitment to review the merits of large lot severances and the clustering of country lot subdivisions.  

 

 

RURAL IMPLICATIONS

 

The implications of the current and possible future policies on the rural area will be evaluated through the Staff review process. The rural community will be provided with opportunities for  input into the staff recommendations and Council deliberations.

This item will be advertised in the local dailies as part of the Public Meeting Advertisement on Friday preceding the Agriculture and Rural Affairs Committee Meeting.

Ms. Debbie Belfie noted that under Official Plan Amendment (OPA) 76, Council had included policies to allow 0.8 hectare (ha) lots outside of historical areas if certain criteria were met, but that larger lot severances had not been included.  She asked for clarification as to whether the intent of the recommendation was to go beyond what was proposed in OPA 76 to allow for a review of large lot severances, or whether it was to direct a review of the whole policy regarding infill severances outside of historical areas. 

 

Mr. Moser said he had taken this direction to mean that as the Rural Review proceeded, working towards a review of the OP, staff would undertake a comprehensive review of all policies related to development in the Rural Area, i.e., infill severances outside of historic settlement areas, the creation of subdivisions and lots, clustering, development, etc., to establish a residential development strategy for the next OP.

 

Councillor Qadri asked whether this meant that staff would include what had already been approved under OPA 76 as a part of their review, or whether OPA 76 was set.  Mr. Moser suggested it might be too early to determine what the outcome of the review would include.  Ms. Marica Clarke, Program Manager, Land Use and Natural Systems, Policy Development and Urban Design, PGM, ISCS added that, as a part of the direction given at ARAC's meeting of 3 March 2011, both 0.8 ha lots and large lot severances would be included in staff’s cluster country lot review.

 

Councillor El-Chantiry clarified that the intent of his original Notice of Motion had been to address concerns regarding the need to review uses for infill areas left over following development.  He felt that since various Community Design Plans (CDP) were being reviewed, this could be included within staff’s Rural Review.

 

Mr. Murray Chown, Novatech Engineering said he supported a comprehensive review of severance policies within the OP, and that adding this portion would make sense.  Noting that there was an Ontario Municipal Board (OMB) hearing scheduled for October of 2011, and that this particular policy would be before the Board at such time, he suggested it would be helpful to know what staff’s position might be regarding rural severance policies before September, in order to minimize policy discussions before the OMB if all parties were in relative accord. 

 

Mr. Moser acknowledged that staff were aware of the hearing referenced by Mr. Chown, but said that this review was being considered as a part of the run-up to a comprehensive OP review.  He suggested that although he would take Mr. Chown’s suggestion under advisement, it might not be possible to have such matters resolved by September.

 

That the Agriculture and Rural Affairs Committee recommend Council direct staff to include policies for infill severances outside of historic settlement areas as part of staff’s review and consultation through its “Rural Review” process.
