a.               Figures 9, 10, 11, 12, and 13 are deleted and replaced with new Figures 9, 10, 11, 12, and 13 as per Documents 1, 2, 3, 4 and 5;

b.               Tables 1, 2 and 3 are deleted and replaced with new tables 1, 2 and 3 as per Documents 6, 7 and 8;

c.                Section 5.2 -Parkland is amended by adding the following sentence at the end of the Section:

"As per the OMB decision of March 30, 2010, the Neighbourhood Park located at 570 Hazeldean Road will be dedicated at no cost to the City";

d.               Section 5.5- District Park is amended by adding the following sentence to the second last paragraph:

"As per the OMB decision of March 30, 2010, the 50 metre hydro corridor located at 570 Hazeldean Road will be deeded to the City for $1."

 

2.         That the Intensification Implementation Group Project Charter, Community Planning Project Team review of parks and recreation standards include the development of design guidelines for public parks.

2.                  Que l’examen des normes relatives aux parcs et aux loisirs de la chartre de projet du Groupe de mise en œuvre de la densification de l’équipe de projet de planification communautaire comprenne l’élaboration de lignes directrices pour la conception des parcs publics.

BACKGROUND

 

The purpose of this report is to:

 

·         Amend the Fernbank Community Design Plan (CDP) to implement the changes to Official Plan Amendment (OPA) 77 as per the Ontario Municipal Board (OMB) decision regarding the location of the District Park; and

 

·         Provide a debriefing on the OMB decision on the district park and recommend measures to address issues arising from the OMB decision in order to minimize the potential for future losses on appeal.

 

The Fernbank CDP and OPA 77 were approved by Council on June 24, 2009.  Three concurrent and integrated Class Environmental Assessment Studies/Master Plans for the Fernbank community were also approved by Council for the Fernbank Community: a Transportation Master Plan; a Master Servicing Study; and an Environmental Management Plan.  The three Master Plans were prepared in accordance with the Planning Act provision of the Municipal Engineers Association Environmental Assessment Process.  As approval of the Master Plans was done through the integrated process, no separate process for Part II Order ("bump up") requests under the Environmental Assessment Act was required.  OPA 77, the Transportation Master Plan, the Master Servicing Study, and the Environmental Management Plan were however subject to appeal under the provisions of the Planning Act.

 

There were two appeals to the Ontario Municipal Board:

 

1.      The Friends of the Greenspace Alliance appealed OPA 77 because of concerns regarding flood risk in the Carp River Valley.  A motion to dismiss this appeal was allowed and the appeal was dismissed without a hearing.

 

2.      Mattamy Homes appealed the location of the District Park, designated as Major Open Space, in OPA 77.

 

On March 30, 2010 the OMB issued a decision to allow the appeal by Mattamy Homes.  The Major Open Space designation (the District Park in the Fernbank Community) in OPA 77 is now approved in a new location.  CDP's must conform to the Official Plan therefore the Fernbank CDP needs to be revised to show the new location for the District Park to implement the OMB decision.  The Fernbank CDP is not a statutory document and was not before the OMB; therefore Council approval is required to amend the CDP.

 

On May 26, 2010 Council passed a motion that directed staff to provide post-mortem debriefings on OMB decisions to Planning and Environment Committee and "outline any potential changes to City plans, policies and/or procedures to address issues arising from OMB decision in order to minimize the potential for future losses on appeal and to more accurately reflect Council’s direction".

 

DISCUSSION

 

The District Park in the Fernbank Community is designated as Major Open Space on Official Plan Schedule B by OPA 77.  The location of the District Park was appealed to the OMB and the Board allowed the appeal and OPA 77 was amended to change the location of the Park.  Also the OMB decision indicated that "the Board expects that as a matter of course, Mattamy Homes will fulfill their undertakings which it described during the hearing, namely to arrange for another Neighbourhood Park of 0.8 ha and to deed its share of the 50 metre corridor, to the City for $1".  The OMB decision is attached as Document 9.

 

Implementation of the OMB Decision

 

In order to implement the OMB decision to change the location of the District Park, the following changes are required to the Fernbank CDP:

 

a)      Figures 9, 10, 11, 12, and 13  need to be revised to show the new approved location for the District Park;

b)      Tables 1, 2 and 3 need to be amended to reflect minor changes to changes to land use distribution area calculations and unit potential.  The new park approved by the OMB is bigger 9.7 ha vs. 8.9 ha for park site approved by Council;

c)      Policies are added to implement the OMB direction regarding the Neighbourhood Park and the portion of the hydro corridor owned by Mattamy Homes:

                                i.            Section 5.2- Parkland is amended by adding the following sentence to the end of the second paragraph:

"The Neighbourhood Park located at 570 Hazeldean Road will be dedicated at no cost to the City".

                              ii.            Section 5.5- District Park is amended by adding the following sentence to the second last paragraph:

"As per the OMB decision of March 30, 2010, the 50 metre hydro corridor located at 570 Hazeldean Road will be deeded to the City for $1."

 

Debriefing of OMB Decision

 

The OMB referred to Council approved documents, the Official Plan and the Greenspace Master Plan (GMP), as the policy basis in its decision on the location of the District Park.  The OMB decision stated that the "GMP also refers repeatedly to the physical linkage of open spaces, mentioning hydro corridors specifically".  The City argued that the site between the hydro corridors was not a good location for the District Park because of concerns related to safety, accessibility, visibility, community integration, programming potential, and use of hydro corridors.  The City was not successful in arguing its case at the OMB that the site located between the hydro corridors was not a good location for the District Park because there was no Council direction or policy basis for the issues/concerns presented to the OMB by the City, in opposition to the site approved by the OMB.  There were no Council approved guidelines for public parks to address issues presented by the City at the Fernbank OMB hearing related to safety, accessibility, visibility, community integration, programming potential, and use of hydro corridors when planning public parks.  These were key factors in selecting the site that was recommended by staff and approved by Council.

 

Section 4.1.1 of the Greenspace Master Plan, policy 10, states that “The City will develop design guidelines for public parks in new communities and redeveloping areas, to be implemented through community design plans and through the development review process”.  These guidelines have not yet been developed.  Council approval of the guidelines for public parks will ensure that these issues are addressed during the planning process and there will be a Council policy to support future decisions on park location and intended purpose at the OMB.

 

The Intensification Implementation Group (IIG) Project Charter was approved by Council on January 27, 2010.  The IIG will conduct its activities through project teams that are focused on intensification issues within the urban and suburban areas. The Community Planning Project Team will be undertaking a review of parks and recreation practices and will develop a new nomenclature of public open spaces for the urban parks of the city and provide a ranges of urban standards to provide for greater flexibility than the current practice, which is unachievable in most cases in the older parts of the city.  This process provides an opportunity to develop guidelines for public parks as part of the comprehensive parks review process.

 

The development and Council approval of design guidelines for parks responds to the Council directive to "minimize the potential for future losses on appeal and to more accurately reflect Council’s direction" for parks.

 

RURAL IMPLICATIONS

 

The Fernbank Community is located within the Urban Area.

 

CONSULTATION

 

Richcraft and Mattamy Homes, landowners of the land where the District Park is located, have been advised of the report.
