At its meeting of 24 August 2010, the Planning and Environment Committee received the following Notice of Motion from Councillor Doucet:
WHEREAS the applicant to develop this property has been forced to
reduce the size of the proposed four storey building at this location to a
three storey building, and to move the building further from the street as a
result of the proximity to high voltage hydro lines on Main Street,
AND WHEREAS the information that there were any issues with the site
plan drawings related to the proximity to the hydro wires was not available to
the applicant until well into the process,
AND WHEREAS the associated financial costs to the applicant, to
entirely redo the drawings and to modify the project from four stories to three
and to modify the project from the proposed condominium units to rental units,
have been onerous; and do not allow for the full recuperation of costs,
THEREFORE BE IT RESOLVED that the cash-in-lieu of parkland fee
($11,191.94) associated with this application be waived.
Planning and Growth Management Comments
The Parkland Dedication By-law provides for the dedication of park land or cash payments in lieu of such lands. On Feb. 25, 2009, Council approved an amendment to the By-law stating the 60 per cent of cash-in-lieu payments will go to projects in the ward from which the money is collected and 40 per cent will go to a City-wide fund. This request is Councillor initiated in response to site-specific concerns. The ultimate decision to waive this payment rests with Council.
There are no rural implications.
This item will be advertised in the local daily newspapers as part of the Public Meeting Advertisement on the Friday preceding the Planning and Environment Committee meeting
There are no Legal/Risk Management Implications associated with the recommendation in this report.
In accordance with By-Law 2009-95 on the administration of money in-lieu of parkland, 40% of monies-in-lieu of parkland should be directed to the City-wide Parkland Reserve, and 60% should be directed to the Ward-specific Parkland Reserve. Therefore, should Council approve this recommendation, the amount to be waived from the City-wide Parkland Reserve is $4,476.78 and the amount to be waived from the Ward 17 Parkland Reserve is $6,715.16.
The Planning and Growth Management Department will implement Council's decision.
