At its meeting of 24 August 2010, the Planning and Environment Committee received the following Notice of Motion from Councillor Doucet:
WHEREAS the applicant for 1440 Bank Street
has been required to install extra sewage pipes to accommodate the city’s new
policy that requires the property owner at the end of a line to assume
responsibility for issues that arise on other properties,
WHEREAS the city has been aware of the
particular issues at this location for some time, specifically the nature of
the terrain and the soil conditions,
WHEREAS in order to be compliant with the city policy, the property owner will be paying a significant amount of money to address the issues that have been inherited at this location – costs which normally would not be borne for a development of this size.
THEREFORE BE IT RESOLVED THAT that the Cash in Lieu of Parkland fee
$19,451.00 associated with this application be waived.

Comments
The Parkland Dedication By-law provides for the dedication of park land or cash payments in lieu of such lands. On Feb. 25, 2009, Council approved an amendment to the By-law stating the 60 per cent of cash-in-lieu payments will go to projects in the ward from which the money is collected and 40 per cent will go to a City-wide fund. This request is Councillor initiated in response to site-specific concerns. The ultimate decision to waive this payment rests with Council.
There are no rural implications.
This item will be advertised in the local daily newspapers as part of the Public Meeting Advertisement on the Friday preceding the Planning and Environment Committee meeting
There are no Legal/Risk Management Implications associated with the recommendation in this report.
In accordance with By-Law 2009-95 on the administration of money in-lieu of parkland, 40% of monies-in-lieu of parkland should be directed to the City-wide Parkland Reserve, and 60% should be directed to the Ward-specific Parkland Reserve. Therefore, should Council approve this recommendation, the amount to be waived from the City-wide Parkland Reserve is $7,780.40 and the amount to be waived from the Ward 17 Parkland Reserve is $11,670.60.
The Planning and Growth Management Department will implement Council's decision.
