REPORT
RECOMMENDATION
That the Agriculture
and Rural Affairs Committee and the Planning and Environment Committee receive
public delegations to allow for additional public consultation and possible
amendment to the Environmental Impact Statement Guidelines, regarding phased subdivision development, as
directed by Council at its meeting of 14 July 2010.

l’urbanisme et de l’environnement reçoivent les délégations du public en vue de
permettre la tenue d’autres consultations publiques et modifications possibles
aux Lignes directrices de l'étude d'impact sur l'environnement, au sujet de l’aménagement d’un lotissement par phases,
comme l’a exigé le Conseil au cours de sa réunion du 14 juillet 2010.
At
its meetings of 8 June 2010 and 8 July 2010, respectively, the Planning and
Environment Committee (PEC) and the the Agriculture and Rural Affairs Committee
(ARAC) considered a report pertaining to Environmental
Impact Statement Guidelines (ACS2010-ICS-PGM-0104, held on file with the
City Clerk). Both Committees “Carried”
the recommendations without amendment, and the report was then forwarded for
Council’s consideration (ARAC Report 55, Item 3) for its meeting of 14 July
2010, at which it was approved. In
addition, Motion 94/6, recommending an amendment to Recommendation 2 of the original report recommendations, was
referred to both the Agriculture and Rural Affairs Committee and Planning and
Environment Committee as outlined in Motion 94/7, below, to allow for
additional public consultation and possible amendment to the Guidelines (original
recommendations included for point of reference):

3. ENVIRONMENTAL

COMMITTEE RECOMMENDATIONS
That Council :
1. Approve
the Environmental Impact Statement Guidelines as detailed in Document 1,
including the Environmental Impact Statement Form and the Environmental Impact
Statement Decision Tool contained in the document as Appendices 1 and 2, for
use in the development review process, effective immediately.
2. Direct
staff to provide a transition period during which applicants will not be
required to adhere strictly to the new Environmental Impact Statement
Guidelines in the preparation of an Environmental Impact Statement for a
specific development or site alteration application if, prior to the approval
and adoption of these Environmental Impact Statement Guidelines by City
Council, the applicant has: (a) received
formal direction from City planning staff on the preparation and requirements
of an Environmental Impact Statement for that specific development or site
alteration application (i.e. during a pre-application consultation or
other consultation with City staff on the specific content of that
Environmental Impact Statement); and, (b), commenced preparation of the
Environmental Impact Statement in accordance with the direction from City
staff.
3. Direct
staff to undertake a review of the Environmental Impact Statement Guidelines’
content and process, beginning one full year after implementation, and
considering any written feedback received from local stakeholder organizations
or members of the public in that time, and to report back to Committees and
Council on the results of the review.

THEREFORE BE IT RESOLVED that
recommendation 2 be amended by the addition of the following:
“but where a
subdivision is proceeding in phases, the environmental impact statement will be
required to be completed or updated in accordance with the guidelines attached
to this report for all subsequent phases.”

July 2010, respectively, the Planning and Environment Committee (PEC) and the
the Agriculture and Rural Affairs Committee (ARAC) considered a report
pertaining to Environmental Impact
Statement Guidelines (ACS2010-ICS-PGM-0104). Both Committees “Carried” the recommendations

which it was approved. At that meeting, Motion
94/6, recommending an amendment to Recommendation
2 of the original report, was referred to both ARAC and PEC as outlined by Motion
94/7, to allow for additional public consultation and possible amendment to the
Guidelines. Hence, this item was placed
on the ARAC agenda of 26 August 2010, and will be considered by PEC at its
meeting of 14 September 2010.
Speaking to Motion 94/6, Councillor
Wilkinson explained its intent had been to afford the public an opportunity to
speak to concerns over phased development. She outlined the concern is that when
development is phased or delayed for long periods of time, an Environmental
Impact Statement (EIS) acquired early in the process may be out of date due to
changing laws and regulations over time; hence, the Councillor felt the City
should have the ability to require that an EIS be updated to comply with
current legislation.
Although no public delegations had
registered to speak to this item, Councillor Wilkinson expressed her thanks
that the Committee had allowed her the opportunity to address her
concerns. Councillor Jellett concurred
with Councillor Wilkinson’s view that updates to an EIS should be required, and
he asked if such provisions currently exist.
Mr. Nick Stow, Senior Environmental Planner, Land Use and
Natural Systems Unit, Policy Development and Urban Design Branch, PGM, ISCS,
explained that the need for an EIS is triggered by certain types of
development applications, but that currently, there is no provision for an
update to an EIS once a draft plan has been approved. Mr. Stow said that in general terms,
recommendations from an EIS are incorporated into Conditions of Approval
(COA). He said staff had discussed how
EIS Guideline updates might be addressed through the approval of a development
application, i.e., COA’s requiring that an EIS be updated through each phase of
development; however, he noted that at present, this was no more than a working
idea.
Councillor Brooks referenced an
earlier site visit in his ward, where the possibility of creating a simpler EIS
‘short form’ had been discussed. Mr.
Stow stated that Natural Heritage Group staff were examining this possibility
with a view to changing the form and the requirements for simpler EIS documents
such as might be relevant to a rural severance, but were proceeding slowly due
to limited resources.
There being no further discussion,
the Committee received the report recommendation as presented.
