That Council approve the demolition of a two-storey detached dwelling at 389 Wilmont Avenue, subject to the following conditions:

 

1.         The Registered Owner shall seed/sod the property and install bollards around the perimeter to maintain the property as open space, and to prevent the use of the property for other interim uses until the time of construction of the replacement building.  The foregoing shall occur within six months of demolition of the building, failing which, the City will undertake this work and enter on the collector’s roll the sum of the costs incurred to perform this work.  The registered owner shall maintain the property in accordance with the Property Standards By-law. 

 

2.         That the Registered Owner enter into an Agreement with the City of Ottawa, to be registered on title, including the forgoing conditions, and pay all the costs associated with the registration of the said Agreement.  At such time as a building permit is issued to redevelop the site and the replacement building is in place, the Agreement will become null and void and will be released upon request by the owner. The owner shall pay all costs associated with the registration of the release from this Agreement.

 

3.         That the approval be considered null and void if the provisions of Recommendation 2 above have not been fulfilled within six months of the date of approval.

Que le Conseil approuve la démolition d’une maison unifamiliale de deux étages située au 389, avenue Wilmont, sous réserve des conditions suivantes :

 

1.         Que le propriétaire enregistré ensemence/engazonne la propriété et installe des bornes de délimitation sur son périmètre afin de laisser le terrain en espace ouvert et ainsi éviter son utilisation à d’autres fins provisoires, jusqu’à la construction de l’édifice de remplacement, qui doit survenir dans les six mois suivant la démolition du bâtiment actuel, faute de quoi la Ville entreprendra elle-même les travaux et ajoutera au rôle de perception le montant du coût de ces travaux. Le propriétaire enregistré doit entretenir la propriété conformément au Règlement sur les normes de bien-fonds. 

 

2.         Que le propriétaire enregistré conclue une entente avec la Ville d’Ottawa, inscrite au registre des titres et comprenant les conditions susmentionnées, et rembourse tous les frais associés à l’enregistrement de ladite entente. Lors de la délivrance d’un permis de construire permettant le réaménagement du terrain et une fois construit l’édifice de remplacement, cette entente deviendra nulle et sans effet, et sera annulée sur simple demande du propriétaire. Ce dernier devra prendre à sa charge tous les coûts liés à l’enregistrement de la renonciation à cette entente.

 

3.         Que l’approbation soit considérée nulle et sans effet si les dispositions de la recommandation 2 ci-dessus n’ont pas été respectées dans les six mois suivant la date d’approbation.

BACKGROUND

 

The subject property, 389 Wilmont Avenue, is located on the north side of Wilmont Avenue and near the northeast corner of Winston Avenue and Wilmont Avenue. The site is occupied by a two-storey detached dwelling.  The total area of the property is 306.67 square metres.  Surrounding uses comprise of residential uses with the exception of a car repair garage use to the immediate west and at the rear of subject property.

 

The purpose of the Demolition Control Application is to seek approval from the City as to not replace the existing two-storey detached dwelling until the environmental remediation is completed. The agent for the owner has indicated the following: “Terrapex Environmental Ltd. has been requested and authorized by the property owner (Ultramar Ltd.) to proceed with demolition of the residence and environmental remediation at this property.  An oil spill in 2005 has impacted the base of foundations and footings, in soil and in bedrock fractures beneath the residence. Proper access to the footings and fractures is required in order to clean the site. It is our opinion that the environmental remediation at this property cannot be conducted properly while the residence remains, and therefore we are seeking demolition permit (i.e. prior to developing a remediation report).”

 

Under the Demolition Control By-law, City Council approval of a demolition permit is required within the former City of Ottawa when a residential use building is proposed to be removed from a property without a replacement building.  To ensure compliance with the Demolition Control By-law, the owner has submitted this application to obtain Council approval for the demolition as the owner does not intend to replace the former building until the environmental remediation is completed. 

 

DISCUSSION

 

Staff is recommending approval of this application.  The removal of the building is required due to an oil spill in 2005 that has impacted the base of foundations and footings, in soil and in bedrock fractures beneath the residence. Proper access to the footings and fractures is required in order to clean the site. The environmental remediation at this property cannot be conducted properly while the residence remains. 

 

The Planning Act and the Demolition Control By-law enable Council to impose conditions on demolition control approvals.  Condition 1 will ensure that the property will be seeded or sodded and that bollards be installed around the perimeter to maintain the property as open space, and to prevent the use of the property for other interim uses until the time of construction of the replacement building.  Sod is the preferred treatment because it softens the property’s appearance while helping to minimize erosion.  Condition 2 requires the owner to comply with the conditions outlined in this report by entering into a legal agreement with the City.  Condition 3 provides a timeline for finalizing the approval.

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  One comment was received indicating concerns on how the clean-up of the oil spill will be achieved.  Terrapex Environmental Ltd. (project’s engineering firm) contacted the concerned resident and explained the process of remediation.

The Ward Councillor is aware of this application and the staff recommendation.

The Planning and Growth Management priorities of the City’s Strategic Plan are adhered to as the site, when redeveloped, will respect the existing urban fabric, neighbourhood form and the limits of existing hard services, so that new growth is integrated seamlessly with established communities.
