5.             FEDERAL GAS TAX - AMENDING AGREEMENT

COMMITTEE RECOMENDATIONS

 

That Council:

 

1.                  Approve the signing of the Amending Agreement related to the transfer of federal gas tax revenues under the New Deal for Cities and Communities between the Association of Municipalities of Ontario and the City of Ottawa in the form attached as Document 1; and,

 

2.                  Enact a by-law in the form attached as Document 2 to authorize the Mayor and City Clerk to sign the Amending Agreement described in Document 1.

1.                  Approuve la signature d’un accord modificateur entre l’Association des municipalités de l’Ontario et la Ville d’Ottawa lié au transfert des recettes de la taxe sur l’essence fédérale en vertu du nouveau pacte pour les villes et les collectivités en entre l’Association des municipalités de l’Ontario et la Ville d’Ottawa tel qu’il se trouve au document 1

 

2.                  Adopte un règlement selon le modèle présenté au document 2, autorisant le maire et le greffier municipal à signer l’accord modificateur décrit au document 1.

That the Corporate Services and Economic Development Committee recommend Council:

BACKGROUND

 

The original agreement between The Association of Municipalities of Ontario and the City related to federal gas tax revenue was signed in June 2005 while the first amending agreement was signed in June 2007.

 

The City has received approximately $125.7 million of Federal Gas Tax Revenues under the New Deal for Cities and Communities agreement up to December 31, 2009.  The funding is currently being applied as a funding source for the City’s Transit Capital program.

 

With the Gas Tax Fund officially extended to March 31, 2014, the city is now required to execute an amendment to the Municipal Funding Agreement with The Association of Municipalities of Ontario in order to participate in future funding for the City’s Transit Capital Program.

 

 

DISCUSSION

 

The amendments include new allocations figures and revised timelines as a result of the extension. The major components of the agreement (i.e. eligible project categories, eligible costs, reporting requirements, etc.) remain the same.

 

 

CONSULTATION

 

The purpose of the report is administrative in nature and therefore no public consultation is required.

 

 

LEGAL/RISK MANAGEMENT IMPLICATIONS

 

There are no Legal/Risk Management impediments to implementing the recommendations of this Report.

 

 


FINANCIAL IMPLICATIONS

 

Upon submission of the signed Amending Agreement and authorizing by-law the city will receive scheduled payments over the life of the Amending Agreement.

 

 

RURAL IMPLICATIONS

 

There are no rural implications.

DISPOSITION

                        A by-law of the City of Ottawa to authorize the signing of an amending agreement respecting the Transfer of the Federal Gas Tax Revenues.

 

                        The Council of the City of Ottawa enacts as follows:

 

1.                     The Mayor and the City Clerk are hereby authorized to execute the Amending  Agreement for the Transfer of Federal Gas Tax Revenues under the New Deal for Cities and Communities between the Association of Municipalities of Ontario and the City of Ottawa in the form approved at the Council meeting of                        with the Schedule of Fund Payments as provided below:
