Committee Recommendation

 

That Council approve that the provisions of subsection 18(1), 19(2)&(3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Relay For Life event, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of June 11th and June 18th, 2010.

Que le Conseil approuve que les dispositions des paragraphes 18(1), 19(2) et (3) du Règlement sur le bruit de la Ville d’Ottawa (2004-253) visant à interdire l’utilisation de matériel de reproduction du son dont le niveau de bruit pourrait dépasser 55 dBA, sans toutefois excéder 65 dBA, lorsque les mesures sont prises à la limite de la propriété d’une personne d’affaires ou d’une personne dont la quiétude et le confort sont dérangés avant 23 h, ou d’un résident dont la quiétude et le confort sont dérangés après 23 h, ne s’appliquent pas les 11 et 18 juin 2010 durant l’activité Relais pour la vie.

BACKGROUND

 

On 1 April 2010, the Community and Protective Service Committee suspended the rules and voted on the following Notice of Motion.

 

WHEREAS the Relay For Life, which is a major fund raising event for the Canadian Cancer Society, is hosting an event starting Friday, June 11th at 7 p.m. until Saturday, June 12th, at 7 a.m., 2010 at the Nepean Sportsplex and on June 18th at 7 p.m. until June 19th at 7 a.m. at Sacred Heart Catholic High School in Stittsville and at the Millenium Park in Orleans.

 

AND WHEREAS exemption from subsections 18(1), 19(2)&(3) of the City of Ottawa Noise By-law (2004-253) is required to allow the use of sound reproduction devices which may surpass the allowed 55 decibel level, but will not exceed 65 decibels, in effect until 11:00 p.m. or which may disturb the peace and comfort of a resident after 11:00 p.m.;

 

THEREFORE BE IT RESOLVED that the provisions of subsection 18(1), 19(2)&(3) of the City of Ottawa Noise By-law (2004-253) shall not apply so as to preclude the use of sound reproduction devices during the Relay For Life event, which may exceed 55 dBA, but will not exceed 65 dBA, when measured at the property line of a business person or person whose peace and comfort is disturbed before 11 p.m. or disturbs the peace and comfort of a resident whose peace and comfort is disturbed after 11:00 p.m. on the dates of June 11th and June 18th, 2010.
