REPORT RECOMMENDATION

BACKGROUND

 

On 4 March 2010, the Community and Protective Service Committee suspended the rules and voted on the following Notice of Motion.

 

WHEREAS Affordable Housing Developments at 314 Booth Street and 424 Metcalfe Street are being developed under the City’s Action Ottawa Affordable Housing Program and have been deemed to be Municipal Housing Facilities under the City’s Municipal Housing Facilities By-law 2006-1;

 

WHEREAS By-law 2003-446, a by-law of the City of Ottawa to regulate encroachments on City highways requires the submission of an application for an encroachment permit for any proposed encroachments onto City lands;

 

WHEREAS Schedule B of By-law 2003-446, requires the payment of a non-refundable fee for temporary encroachments on the City roadways and sidewalks;

 

WHEREAS sidewalk and roadway encroachment fees are estimated to be $85,000 for 314 Booth Street and $100,000 for both phases of Beaver Barracks at 424 Metcalfe Street until completion in 2012.

 

WHEREAS By-law 2003-446, Section 92, entitled WAIVER OF FEES, stipulates that “The General Manager may waive all or part of the encroachment permit fees in Schedule “B” of this by-law for registered charitable and non-profit organizations, such as the United Way and the Santa Claus Parade, where deemed appropriate by the City”;

 

THEREFORE BE IT RESOLVED THAT City Council exempt up to $185,000 in Encroachment Fees for Affordable Housing developments known municipally as 314 Booth Street and 424 Metcalfe Street.

 

 

CONSULTATION

 

City Operations – Community and Social Services Department - Social Housing and Shelter Management Branch-

 

Staff is supportive of the motion.  

 

Both projects noted in this report provide a significant amount of new affordable rental and supportive housing in the City. The Centretown Citizens Ottawa Corporation affordable housing development at 424 Metcalfe Street will provide a total of 248 units once both phases are complete, and will include fully accessible apartments, housing with supports and housing suitable for families. The Cornerstone Foundation for Women project at 314 Booth Street will provide 42 units of supportive housing for a diversity women who are at risk of becoming homeless.

 

Due to the urban nature of both projects and density of development, part of the roadway and/or sidewalk will be required during construction. Staff believes that the exemption of these fees is consistent with other relief (e.g., building permit fees, development charges, parkland levies and planning fees) provided by the City to support the development of affordable rental and supportive housing projects developed under Action Ottawa and the Canada Ontario Affordable Housing Program. 

 

 

LEGAL/RISK MANAGEMENT IMPLICATIONS:

 

There are no legal/risk management impediments to implementing the recommendation in this report.

 

CITY STRATEGIC PLAN

 

There are a number of priorities in the Strategic Plan focused on the provision and protection of affordable housing.

 

Sustainable, Healthy and Active City Priority

 

Achieve the annual development of 500 housing units affordable to people earning low income. The objective is to close the gap in the affordable and appropriate housing supply

 

A new activity added to the Sustainable, Healthy and Active City Priority through the 2010 budget process is to “Implement City Housing Strategy” which contains a number of recommendations with the objective of promoting and preserving the stock of affordable housing within the City.

 

Infrastructure

 

Repair, replace and/or upload all City housing stock by 2020, including a review of innovative alternatives to rehabilitate the stock.

 

Planning and Growth Management

 

Become leading edge in community and urban design including housing creation for those in the city living on low incomes and residents at large.

 

Sustainable Finances (transformational)

 

Fund infrastructure renewal, including closing the gap in affordable and appropriate housing supply.

 

 

FINANCIAL IMPLICATIONS

 

Waiving the encroachment fees would result in lost revenues of $185,000 in Planning and Growth Management.

 

 

DISPOSITION

 

Staff will take the appropriate action following Council’s decision.
