That the Corporate Services and Economic
Development Committee recommend Council exempt the Centre Pauline-Charron from
the zoning change application fees noted within the report.

demande de modification du zonage indiqués dans le rapport.
BACKGROUND
At the 19 January 2010 meeting of the Corporate Services and Economic Development Committee (CSEDC), Councillor D. Deans on behalf of Councillor G. Bédard submitted the following Notice of Motion for consideration by the CSEDC at its meeting of 2 February 2010:
Whereas the Centre Pauline-Charron, an arts and cultural facility for seniors
located at 164 Jeanne-Mance Street, is a non-profit corporation and provides
great service to the City of Ottawa;
And Whereas because of its great success, the facility is undergoing an expansion of
its parking lot to accommodate approximately 20 more automobiles;
And Whereas the parking expansion requires a zoning change application for a section
of their property;
And Whereas there are constant complaints from their neighbours regarding on-street
parking;
And Whereas parking enforcement officers target this area and impose fines on
seniors using the facilities;
And Whereas the associated zoning change application fees total $12,610;
Therefore Be It
Resolved that Council
exempt the Centre Pauline-Charron from the above-mentioned zoning change
application fees.
PLANNING
AND GROWTH MANAGEMENT COMMENT
Fees for planning applications have been set
by Council to provide for the recovery of the processing costs incurred. Staff have no ability to waive fees, however,
it is the prerogative of Council to provide for any waivers Council deems appropriate.
CONSULTATION
This item will be advertised in the local dailies as part of the Public Meeting Advertisement on Friday preceding the Corporate Services and Economic Development Committee Meeting.
LEGAL/RISK MANAGEMENT IMPLICATIONS
On 28 October 2009, Council approved (Planning
and Environment Committee Report 59), a program for the reimbursement of
fees. The application of this report to
the present case would appear to limit the refund of the zoning fees in the
present instance to 50%.
FINANCIAL IMPLICATIONS
Approval
of the exemption would result in $12,610 of lost application fee revenues.
DISPOSITION
Staff to take appropriate action as directed by the Committee and Council.
