1.         That the Director of Real Estate Partnership and Development Office be authorized to enter into a License of Occupation agreement on behalf of the City with the Owner in accordance with the terms and conditions as set out in Document 1, which terms and conditions will provide a 10 year term for the License of Occupation agreement with a nominal yearly fee of $1.00 for the 10 year term, which will be subject to renegotiation for further renewals based on applicable City land lease policy in place thereafter.

 

2.         That the Deputy City Manager, Infrastructure Services and Community Sustainability provide for the issuance of the required road cut permit to allow the Owner to undertake the proposed improvements subject to all technical matters related to the works being to the satisfaction of the Deputy City Manager and subject to any securities as set out in Document 1 being posted.

 

3.         That the following condition from the “Contents of License of Occupation Agreement” (Document 1):

 

“Should the City and/or Public Utilities operating within the Public Right of Way decide to renew or repair infrastructure below the surface of the Lands, the Owner must remove the improvements and repair or renew the surface of the lands at its expense upon the time specified within written notice from the City.”

"Should the City or utility companies decide to renew or repair infrastructure below the surface of the lands, the City or utility company is responsible for compacting while the owners are responsible for removing and replacing the pavers within time periods specified in written notice from the City.

BACKGROUND

 

On 2 December 2009, the aforementioned Notice of Motion was submitted for consideration at a subsequent meeting of the Transportation Committee.  The full Motion is attached as Document 3 to this report.

 

 

DISCUSSION

 

The Owner of 90 George Street Ltd., and 135 Rideau Street obtained site plan approval for the construction of a mixed commercial residential condominium, provided that the Owner:

 

The improvements provided for specialized landscaping and surface treatments to distinguish the forecourt area in front of 90 George Street from the remaining parking courts along George Street, so as to establish a forecourt area for the commercial and residential condominium.  The Owner wishes to undertake additional improvements to this forecourt area, as reflected on Document 2.  The effect of these further improvements would be to have the forecourt further distinguished and separated from the remaining parking courts along George Street.

 

Further, the Owner also wishes to be given the right to use and maintain the improved forecourt to manage drop off and pick-up activities and a valet parking service to be provided in conjunction with the commercial/residential condominium at 90 George/135 Rideau.

 

The improvements proposed are seen as being beneficial from an aesthetic, safety and operational perspective to ensure that activities associated with drop-off and pick-up and the valet parking service will be managed for the benefit of residents of the residential condominium, staff and customers of the commercial condominium and the public who will use the public parking provided.  It is considered reasonable in view of these benefits, to provide for a nominal yearly fee of $1.00 for a term of 10 years which would provide an amount equal to the capital cost of the improvements.

 

 

CONSULTATION

 

The proposed improvements have been reviewed and accepted by staff, subject to the Owner entering into a License of Occupation agreement with the City that sets out obligations on the part of the Owner to improve and maintain the lands and provides to the Owner the right to manage and operate activities in the forecourt.  The Owner is prepared to enter into such an agreement but wishes to have the fee waived in consideration of the investment being made in the proposed improvements, estimated at $260,000.  The normal fee in accordance with Council policy would provide for a yearly payment to the City of $26,000 based on current market rent.

 

The proposed improvements are supported by the ByWard Market and Rideau Street BIAs.

 

Public Works Department

 

Site plan approval for 90 George Street was negotiated and approved prior to the Municipal Parking Management Strategy’s approval by Council in April 2009. The site plan approval provides for the elimination of 6 public parking spaces in the parking court in front of 90 George Street and requires that 20 publicly accessible parking spaces be provided as part of the development. It is understood that the proposed License of Occupation Agreement is intended to allow the owner to improve and manage vehicular activity in the public ROW in front of 90 George, support the proposed valet parking service and accommodate pick-up and drop-off activities associated with the uses within 90 George. The Parking Management Strategy therefore will not apply to or govern either the parking in the ROW that will serve the 90 George Street development or the parking that will be accessible to the public that is located within the development. These spaces will be managed and controlled by the owner as publicly accessible commercial parking.

 

The agreement reached through the site plan approval process would today not be supported by the Parking Management Strategy. However, as this arrangement pre-dates the Parking Management Strategy and, in recognition of the potential overall benefit to the community of having this proposal formalized through a License of Occupation Agreement and recognizing that the Ward Councillor and BIA’s are in support of this, Public Works staff see the proposed License of Occupation as concluding understandings reached through the site plan approval process related to the function of the right of way in front of 90 George and are in support of having these understandings finalized as set out in this report. Public Works staff would however, request that the terms of the agreement ensure that the design and signage make it obvious to the public that the parking is publicly accessible. Further, should the developer wish to reintroduce metered or non-metered public parking within the right-of-way, it should be managed by the Parking Branch as part of the municipal public parking system.

 

Infrastructure Services

 

Staff have worked with the Councillor in drafting Document three. Issues identified by staff for the use of the Public Right of Way as part of this private development have been identified and dealt with in the conditions for the License of Occupation Agreement. Infrastructure Services and Community Sustainability supports the motion.

 

Planning and Growth Management

 

Staff have worked with the Councillor in drafting Document 3.

 

Real Estate Partnerships and Development Office

 

Staff have worked with the Councillor on this agreement and support the motion.  After the agreement expires, staff will negotiate with the building owner renewals based on the applicable City land lease policy in place thereafter.

CONTEXTE

 

Le 2 décembre 2009, l’avis de motion susmentionné a été soumis pour examen lors d’une réunion subséquente du Comité des transports. La motion complète se trouve dans le document 1 ci-joint.

 

 

DISCUSSION

 

Le propriétaire du 90, rue George, et du 135, rue Rideau, a obtenu l’approbation de son plan d’implantation pour la construction d’une copropriété commerciale et résidentielle, sous réserve :

 

Afin de bien marquer la démarcation entre l’avant-cour de la copropriété commerciale et résidentielle du 90, rue George, et les autres aires de stationnement de cette artère, un aménagement paysager professionnel et des traitements de surface spécialisés ont été effectués. Le propriétaire souhaite apporter des améliorations additionnelles à l’avant-cour, comme en témoigne le document 2; celles-ci auront pour effet de la distinguer encore davantage des autres aires de stationnement de la rue George. 

 

De plus, le propriétaire souhaite obtenir le droit d’utiliser et d’entretenir cette avant-cour réaménagée pour des activités de livraison et de cueillette et un service voiturier liés à la copropriété commerciale et résidentielle du 90, rue George/135, rue Rideau. 

 

Les améliorations proposées sont jugées bénéfiques du point de vue de l’esthétisme et de la sécurité. Elles sont également avantageuses au plan opérationnel en permettant  que les activités de livraison et de cueillette ainsi que le service voiturier profitent tant aux résidents, aux commerçants et aux clients de la copropriété qu’aux  gens qui utiliseront le stationnement public. À la lumière de ces avantages, il est jugé raisonnable de n’exiger pendant 10 ans qu’un paiement annuel symbolique d’un dollar (1 $), ce qui permettrait au propriétaire de couvrir les coûts d’immobilisation des améliorations à apporter. 

 

 

CONSULTATION

 

Le personnel a examiné et accepté les améliorations proposées, étant entendu que le propriétaire signe une entente sur le permis d’occupation avec la Ville qui établit les obligations du propriétaire en ce qui concerne l’amélioration et l’entretien des terrains et lui donne le droit de gérer et d’exercer des activités dans l’avant-cour. Le propriétaire est prêt à signer une telle entente, mais souhaite être exempté des frais en considération de l’investissement dans les améliorations proposées, estimé à 260 000 $. Conformément à la politique du Conseil, les frais normaux consisteraient en un paiement annuel à la Ville de 26 000 $ en fonction du loyer du  marché actuel. 

 

Les zones d’amélioration commerciale du marché By et de la rue Rideau appuient les améliorations proposées.

 

Service des Travaux publics

 

Le plan d’implantation approuvé pour le 90, rue George a été négocié et approuvé avant l’approbation de la Stratégie municipale de gestion du stationnement par le Conseil en avril 2009.  Le plan d’implantation approuvé comprend l’élimination de six places de stationnement public situées sur le terrain de stationnement devant le 90, rue George et nécessite l’établissement de 20 places de stationnement accessibles au public dans le cadre du projet d’aménagement. On convient que l’entente proposée du permis d’occupation vise à permettre au propriétaire d’améliorer et de gérer l’activité des véhicules sur l’emprise routière publique située devant le 90, rue George, d’appuyer le service voiturier proposé et de tenir compte des activités de livraison et de cueillette liées aux utilisations de la propriété du 90, rue George. Ainsi, la Stratégie municipale de gestion du stationnement ne s’appliquera pas au stationnement situé sur l’emprise routière desservant le 90, rue George, ni au stationnement rendu accessible au public situé sur place, et ne pourra servir à leur exploitation.  Ces places de stationnement seront gérées et contrôlées par le propriétaire en tant que stationnement commercial accessible au public.

 

L’entente établie dans le cadre du processus d’approbation du plan d’implantation ne serait pas conforme aujourd’hui à la Stratégie municipale de gestion du stationnement.  Toutefois, puisque cette entente a été établie avant l’adoption de la Stratégie municipale de gestion du stationnement et, grâce à l’avantage général que représente pour la communauté l’officialisation de cette proposition sous forme d’une entente de permis d’occupation et à l’appui du conseiller du quartier et de la ZAC, le personnel des Travaux publics voit le permis d’occupation proposé comme la conclusion des ententes établies dans le cadre du processus d’approbation du plan d’implantation lié à la fonction de l’emprise routière située devant le 90, rue George et il appuie la conclusion de ces ententes telles qu’établies dans le présent rapport.  Le personnel de Travaux publics souhaite toutefois s’assurer que les conditions de l’entente permettent de garantir que la conception et les enseignes indiquent clairement que le stationnement est accessible au public.  De plus, si le promoteur prévoit l’intégration d’un stationnement public avec ou sans parcomètre sur l’emprise routière en question, ce stationnement sera géré par la Direction du stationnement dans le cadre du système de stationnement public municipal.

 


Services d’infrastructure

 

Les questions relevées par le personnel en ce qui concerne l’utilisation de l’emprise publique dans le cadre de cet aménagement privé sont énumérées dans les conditions de l’entente sur le permis d’occupation. Les emprises publiques, spécialement celles situées dans le centre de la ville, constituent une ressource limitée qu’il faut gérer en ayant soin d’en assurer la meilleure utilisation publique possible. 

 

Urbanisme et gestion de la croissance

 

Le personnel a collaboré avec le conseiller à la rédaction du document 3.

 

Bureau des partenariats et du développement en immobilier

 

La décision de ne pas offrir les renouvellements en fonction de leur valeur sur le marché est contraire à la politique. Si une telle décision est prise, il doit donc en être question dans ce rapport.

ATTENDU QUE 90 George Street Ltd, propriétaire des terrains dont la désignation municipale est le 90, rue George, et le 135, rue Rideau,(le « propriétaire ») a obtenu l’approbation de son plan d’implantation pour la construction d’une copropriété commerciale et résidentielle; 

 

ATTENDU QUE cette approbation était conditionnelle à ce que le propriétaire apporte des améliorations à l’aire de stationnement située dans l’emprise en face du 90, rue George, ce qui a entraîné la disparition de six places de stationnement, et à ce qu’au moins 20 places soient réservées au public dans le stationnement souterrain de la copropriété, pour pallier la disparition de ces six places;

 

ATTENDU QUE ces améliorations ont nécessité un aménagement paysager professionnel et des traitements de surface spécialisés afin de bien marquer  la démarcation entre l’avant-cour de la copropriété commerciale et résidentielle du 90, rue George et les autres aires de stationnement de cette artère;

 

ATTENDU QUE le propriétaire souhaite apporter des améliorations additionnelles à l’avant‑cour du 90, rue George, comme en témoigne le document 2;

 

ATTENDU QUE ces améliorations auront pour effet de distinguer encore davantage l’avant-cour du 90, rue George des autres aires de stationnement de cette artère;

 

ATTENDU QUE le propriétaire souhaite obtenir le droit d’utiliser et d’entretenir cette avant-cour réaménagée pour des activités de livraison et de cueillette et un service voiturier liés à la copropriété commerciale et résidentielle du 90, rue George/135, rue Rideau;

 

ATTENDU QUE les améliorations proposées n’entraîneront la disparition d’aucune autre place de stationnement sur la rue George, hormis les six autorisées dans le cadre du plan d’implantation; 

 

ATTENDU QUE les améliorations proposées ont été avalisées par le marché By et les ZAC de la rue Rideau;

 

ATTENDU QUE les améliorations proposées ont été examinées et acceptées par le personnel de la Ville sous réserve que le propriétaire conclue avec la Ville un accord concernant le permis d’occupation qui l’oblige à améliorer et à entretenir les terrains et lui donne en retour le droit de gérer et d’exploiter des activités dans l’avant-cour;

 

ATTENDU QUE le propriétaire est disposé à conclure un tel accord, mais souhaite que les frais soient suspendus en raison du montant investi, dans les améliorations proposées, estimé à 260 000 $;

 

ATTENDU QUE les frais normaux, en vertu de la politique du Conseil, équivaudraient, sur le marché actuel, à un paiement annuel de 26 000 $ à la Ville;

 

 

ATTENDU QUE les améliorations proposées sont jugées bénéfiques du point de vue de l’esthétisme et de la sécurité, et qu’elles sont également avantageuses au plan opérationnel en permettant  que les activités de livraison et de cueillette ainsi que le service voiturier profitent tant aux résidents, aux commerçants et aux clients de la copropriété qu’aux  gens qui utiliseront le stationnement public;

 

ATTENDU QUE compte tenu de ces avantages, il est jugé raisonnable de n’exiger pendant 10 ans qu’un paiement symbolique d’un dollar (1 $), ce qui permettrait au propriétaire de couvrir les coûts d’immobilisation des améliorations;

 

ET ATTENDU QUE le propriétaire souhaite, dans la mesure du possible, entreprendre les travaux proposés avant la fin de la saison de construction 2009, de manière à pouvoir mettre en œuvre des activités de livraison et de cueillette et un service voiturier dont pourront profiter tant les résidents, les commerçants et les clients de la copropriété que les gens qui utiliseront le stationnement public;

 

IL EST RÉSOLU QUE le directeur du Bureau des partenariats et du développement en immobilier soit autorisé à conclure, au nom de la Ville, un accord concernant le permis d’occupation, conformément aux conditions énoncées dans le document 1, soit un contrat d’une durée de 10 ans au cours duquel le propriétaire s’engage à payer un montant symbolique annuel d’un dollar (1 $), et dont les renouvellements subséquents devront faire l’objet de renégociations.

 

IL EST EN OUTRE RÉSOLU QUE le directeur municipal adjoint des Services d’infrastructure et Viabilité des collectivités délivre le permis de terrassement dont le propriétaire a besoin pour apporter les améliorations proposées, sous réserve que toutes les questions techniques relatives à l’exécution des travaux soient à la satisfaction du directeur municipal adjoint, et que les garanties établies dans le document 1 soient fournies.

Councillor Bédard indicated he had a technical amendment which had been agreed upon by staff and the property owner, but which had not been reflected in the report.

That the following condition from the “Contents of License of Occupation Agreement” (Document 1):

 

“Should the City and/or Public Utilities operating within the Public Right of Way decide to renew or repair infrastructure below the surface of the Lands, the Owner must remove the improvements and repair or renew the surface of the lands at its expense upon the time specified within written notice from the City.”

 

be replaced with:

 

"Should the City or utility companies decide to renew or repair infrastructure below the surface of the lands, the City or utility company is responsible for compacting while the owners are responsible for removing and replacing the pavers within time periods specified in written notice from the City.

That the Transportation Committee recommend that Council approve:

 

1.         That the Director of Real Estate Partnership and Development Office be authorized to enter into a License of Occupation agreement on behalf of the City with the Owner in accordance with the terms and conditions as set out in Document 1, which terms and conditions will provide a 10 year term for the License of Occupation agreement with a nominal yearly fee of $1.00 for the 10 year term, which will be subject to renegotiation for further renewals based on applicable City land lease policy in place thereafter.

 

2.         That the Deputy City Manager, Infrastructure Services and Community Sustainability provide for the issuance of the required road cut permit to allow the Owner to undertake the proposed improvements subject to all technical matters related to the works being to the satisfaction of the Deputy City Manager and subject to any securities as set out in Document 1 being posted.
