BACKGROUND

 

The subject land identified as part of 2574 Mer Bleue Road is located on the west side of Mer Bleue Road, north of the intersection of Wall Road. The property is a through lot with frontage on Du Domaine Street as well as Mer Bleue Road. The subject land is within the East Urban Community (EUC) - Community Design Plan (CDP), Phase 2. This is a residential parcel surrounded by residential uses to the north, south and east, by rural uses to the north-east and by large parcel of land reserved for future development to the west. There is an existing house fronting on Mer Bleue Road which is currently legal non-conforming.

 

Purpose of Zoning Amendment

 

The proposal is to rezone the land to meet a condition of consent imposed by the Committee of Adjustment (application no. D08-01-08/B-00494). The severance application is to sever the vacant land from the existing detached dwelling fronting on Mer Bleue Road. The parcel to be severed which consists of vacant land will contain a lot area of 8449 square metres, is presently zoned Development Reserve Zone “DR” and Residential First Density Subzone AA “R1AA” and will be known municipally as 2479 Du Domaine Street once the severance is finalized. The parcel to be retained which includes the existing detached dwelling will contain a lot area of 1872 square metres and is presently zoned Development Reserve Zone “DR”.

 

Existing Zoning

 

The current zoning is Development Reserve Zone "DR"  and Residential First Density Subzone AA "R1AA" under Zoning By-law 2008-250.

 

Proposed Zoning

 

The requested zoning amendment proposes to rezone the parcel to be retained from DR to Development Reserve Subzone 1 "DR1" to permit the existing dwelling and to rezone part of the parcel to be severed from R1AA to DR to prevent development of this parcel.

 

DISCUSSION

 

Official Plan

 

According to the Official Plan, the subject land is designated “Developing Community”.  The Developing Community designation identifies parts of the city that are undeveloped or substantially underdeveloped.  Developing Communities will offer a full range of choice in housing, commercial, institutional and leisure activities within a development pattern that prioritizes walking, cycling and transit over the automobile.  The completion of a community design plan is required prior to any development being approved in a Developing Community. 

 

Zoning By-law

 

According to the Zoning By-law 2008-250, the site is zoned Development Reserve Zone “DR” and Residential First Density Subzone AA “R1AA”. The DR zone does not permit detached dwellings. The existing detached dwelling is currently legal non-conforming but once the severance is finalized, it would automatically lose this status and become illegal. In order to ensure that the detached dwelling remains a legal use it is recommended that the zoning of the site be changed from “DR” to “DR1”, as shown on Document 1. The DR1 zone permits one detached dwelling.

 

The “R1AA” zoning permits detached dwellings and others uses. Since the property is located within the Developing Community where development is not currently permitted, the only method to permit the severance was to require a rezoning to ensure that an eligible residential lot was not created. Therefore in order to ensure that no development be permitted on the parcel to be severed it is recommended that the zoning of part of the parcel to be severed be changed from “R1AA” to “DR”, as shown on Document 1, in order to prohibit development. Development within this area is intended to be restricted until the CDP for the area is completed. The EUC -CDP Phase 2 is expected to be completed by the City later this year.

 

CONSULTATION

 

Notice of this application was carried out in accordance with the City's Public Notification and Consultation Policy.  The Ward Councillor is aware of this application and the staff recommendation.  The City did not receive any negative comments or opposition to this application.
