That Council
approve that:
1. The Ottawa Hospital – General, Riverside and Civic Campuses be
remitted $1,525,008.64, representing the amount paid to the City for
Cash-in-lieu of Parkland ($101,143.59), Planning application fees ($13,158.60)
and the Building permit fees ($1,410,706.45) for construction projects
undertaken pursuant to the hospital’s approved 10-Year Capital Program up to
and including March 31, 2009, as noted in Document 2
to this report;
2. The
Cash-in-Lieu of Parkland remittance ($101,143.59), and the Building Permit fees
remittance ($1,410,706.45) be funded from the City-Wide Capital Reserve Fund;
and
3. The Planning Application fees remittance ($13,158.60) be funded from the 2009 Planning and Growth Management 2009 Planning Application fees revenue budget.

On January 23,
2002, City Council confirmed its commitment to the quality of life of the
community by partnering with Ottawa’s hospitals to tackle the financial
challenge of raising $232 million locally to fund the 10-year capital
requirements identified by the hospitals.
Specifically, Council considered and approved the following
recommendations from the Corporate Services and Economic Development Committee:
Development by the Ottawa hospitals is specifically
exempted from the Development Charges By-law 2004-298 and thus the first
recommendation has been satisfied. To
date, City Council has reimbursed to the Ottawa hospitals $6,073,984.52 in
building permit, planning approval fees and levies to meet the challenge of
raising $232 million locally in support of the capital requirements of the
local hospitals.
Up until July 1,
2005, the reimbursement of building permit fees was offset by surplus permit
revenues. However, on July 1, 2005, new
legislation, the Building Code Statute
Law Amendment Act, 2002 and Ontario Regulation 305/03 took effect, which
necessitated changes on how municipalities administered and enforced the Building Code Act and Building
Code.
One of the changes
related to the collection of building permit fees, in that these fees could
cover only those costs associated with servicing building permits and enforcing
the Act and Code. In essence, the new legislation required
that the building regulatory activities be revenue neutral. Thus, surplus revenues no longer could be
generated, nor relied upon for offsetting the waiver of fees in support of
various construction projects by charitable and non-profit organizations. This impact was discussed in the report
presented to Council on June 22, 2005 entitled “Building Regulatory Changes –
Impact of Building Code Statute Law
Amendment Act and Ontario Regulation 305/05” (ACS2005-PGM-BLD-0010).
As a result, any
requests for grants to offset building permit fees, if approved, would require
funding from the City-Wide Capital Reserve Fund or other sources. Requests in 2005 and 2006 relied on the
City-Wide Capital Reserve Fund for funding.
However, in 2008 the Fund was insufficient to cover proposed grants and
thus any grants would have created a budget pressure. This was not consistent with the intent of Council when the
program was approved in 2002, which was premised on such funding support not
creating a budget pressure.
On October 7, 2008
a report requesting the reimbursement of fees and charges for the Ottawa Hospital
(General, Riverside and Civic campuses) was presented to the Corporate Services
and Economic Development Committee. As
the approval of the request would have entailed creating a budget pressure and
this was clearly contrary to Council intent, the Committee directed staff to
“…review the Policy approved on January 23, 2002 related to Development Charges
and permit fees paid to the City and the Policy review and recommendations be
presented to Committee and Council before any additional capital funding supports
are considered by the Corporate Services and Economic Development Committee and
Council.”
On March 11, 2009,
the Corporate Service and Economic Development Committee recommended to Council
that it “…revise its policy of reimbursing building permit, planning
application and cash-in-lieu of parkland fees paid to the City by hospitals for
capital projects to include a sunset clause stating that in order to apply for
the reimbursement, the building permit, planning application and cash-in-lieu
of parkland fees must have been paid prior to March 31, 2009.”
The Ottawa Hospital
has requested reimbursement of fees paid up to March 31, 2009 in relation to
capital projects falling within the scope of their 10-Year Capital Funding
Program as approved by the Province (refer to letter – Document 1).
Review of the
request for reimbursement from the Ottawa Hospital was undertaken in accordance
with the criteria established January 23, 2002 and in keeping with the more
recent direction from Council, specifically March 11, 2009.
Support
for requests for grants to offset building permit fees ($1,410,706.45) and Cash-in-Lieu of Parkland fees ($101,143.59), must be
funded from the City-Wide Capital Reserve Fund. Support for funding to offset Planning Application fees
($13,158.60) paid to the City must be
funded from the 2009 Planning and Growth Management 2009 Planning Application
fees revenue budget.
The Ottawa Hospital (General, Riverside and Civic Campuses) has been consulted and a copy of this report has been forwarded to them for review and information.
There are no legal/risk management impediments to implementing the recommendations of this report.
Approval of this report will result in a total remittance of
$1,525,008.64 to the Ottawa Hospital, to be funded as follows:

Planning and Growth Management 2009 operating budget (Planning
Application fees) $13,158.60.
·
City-wide Capital Reserve Fund $1,511,850.04. This amount
represents the Building Permit fees and Cash in lieu of Parkland paid by the
Ottawa Hospital. In accordance with
provincial legislation, funds collected for these purposes cannot be reimbursed
from the Building Code Services Permit Fees account or the Cash-in-lieu of
Parkland reserve. Based on the level of contributions to the City Wide Reserve
Fund and the projected commitments, the 2009 year-end balance in the Fund is
forecasted to be in a $3.3 million overdraft position. Should Committee
and Council approve this grant request, the 2010 capital program will be
restricted in order to re-establish a positive Fund balance.

The Planning and Growth Management Department is to process the remittance request.
Finance is to prepare the payment to the Ottawa Hospital – General, Riverside and Civic Campuses and adjust accounts accordingly.
