Committee recommendations
That Council approve:
1. An
increase to the project authority for account number 900812 Cardinal Creek
Stormwater Facility in the amount of $5.9M
2. Council
approve that the additional authority be funded in the following manner:
a.
The remaining 217 of the 809
single detached unit equivalent units will be subject to the the non-participating rate of $5,572 or
$0.423M;
b.
Ten per cent of the extra cost will be attributed to the remaining
development within the Area, for a revised rate of $6,231 or $0.533M; and
c.
The balance ($4.9M) from the
City Wide DC Storm Water Drainage Account

BACKGROUND
The Planning and Environment Committee considered an in camera report on this matter at its meeting of May 11, 2009. At that time, the following motion was carried:
That the Planning and Environment
Committee direct that the recommendations be considered in open session, where
possible, and that staff determine if all or part of the reports can also be
made public.
Accordingly, Legal Services staff have determined that the second and third recommendations of the original staff report (ACS2009-CMR-LEG-0013) could be considered in open session, but that the first recommendation and the entire report would remain in camera pursuant to the reporting out date.

CONSULTATION
As this matter was originally considered in camera, no public consultation was undertaken; however, the title of the report was included in the regular agenda, which is usual practice.

Legal Services, in cooperation with Real Estate Services, will seek to resolve the outstanding expropriations on the basis directed by Council.
Planning and Growth Management, in cooperation with Financial Services, will adjust the draft Development Charge background study to incorporate the means chosen by Council to recover the costs.
