That the Corporate Services and Economic Development Committee recommend Council approve a reimbursement to Findlay Creek Properties Ltd and 1374537 Ontario Limited in the amount of $72,624 from the Sewer Reserve Fund in respect of stormwater development charges for the Rotary Home.
Que le Comité des services organisationnels et du développement économique recommande au Conseil d’approuver un remboursement d’un montant de 72 624 $ du Fonds de réserve des égouts à Findlay Creek Ltd et à 1374537 Ontario Limited en ce qui a trait aux redevances d’aménagement relatives aux eaux de ruissellement pour le Rotary Home.
Council
approved on 12 April 2006 (CSEDC Report 44, Item 9) a front-ending agreement
with Findlay Creek Properties Ltd and 1374537 Ontario Limited (“Tartan”) for
the Leitrim stormwater area. Pursuant
to this agreement, Tartan constructed a stormwater pond for the Leitrm
area. The agreement provides that
Tartan is to be reimbursed for the cost of constructing this pond from the
stormwater development charges for development within the Leitrim area.
On 26 March 2008, Council
considered and approved a request for an exemption for the Rotary Homes to be
constructed in the Leitrim area. The
report provided for an exemption both from the general development charges
under By-law 2004-298 and the area specific stormwater charges ($72,624)
pursant to the Leitrim Stormwater By-law, By-law 2004-303 as amended.
Tartan was not aware of the
report providing for the exemption.
Tartan has since advised that in accordance with the front-ending
agreement signed with the City that it requires to be reimbursed the $72,624
due in respect of the Rotary House development for stormwater development
charges.
Legal Services has reviewed the
agreement and confirms that the amount is due to Tartan.
ENVIRONMENTAL IMPLICATIONS
Not applicable.
Tartan has requested that the funds be remitted to it and is aware that this report is being submitted to Committee and Council
Pursuant to the front-ending agreement with Tartan, the City is responsible for collection stormwater development charges for development in the Leitrim area and remitting such funds to Tartan.
Funds are available in the Sewer Reserve Fund.
Legal Services will requisition the cheque and provide the funds to Tartan.
