That Council
recommend that the necessary steps be taken immediately to move the Flowing
Creek Drainage Ditch Project forward in an expeditious manner, and that
procedures be put in place to avoid these unacceptable delays in future
projects of this type.

On 9 April 2009, a Notice of Motion outlined below
was presented to the Agriculture and Rural Affairs Committee for consideration
at a subsequent meeting.
WHEREAS the
property owners along the drainage ditch known as Flowing Creek, submitted in
May 2006, a petition under the Provincial Drainage Act to clean out the ditch
and designate it as a Municipal Drain;
AND WHEREAS
the project is now two years behind schedule;
AND WHEREAS
the necessary approvals and permits due not appear to be forthcoming within the
foreseeable future;
THEREFORE BE IT RESOLVED THAT Ward 21 Council
recommends that Councillor Brooks pursue this matter with the Agriculture and
rural Affairs Committee (ARAC) and recommend to City Council that the necessary
steps be taken immediately to move this project forward in an expeditious
manner, and that procedures be put in place to avoid these unacceptable delays
in future projects of this type.
In May
2006, property owners along the drainage ditch known as Flowing Creek,
submitted a petition under the Provincial Drainage Act to clean out the
ditch and designate it as a Municipal Drain.
It appears that the necessary approvals and permits are not forthcoming within the foreseeable future and the Ward Councillor would like to ensure that necessary steps are taken to move the project forward.
CONSULTATION
New regulations and policies implemented since 2006, by the Conservation Authorities and Fisheries and Oceans Canada, require Drainage Engineers, appointed by Councils under the Drainage Act, to undertake extensive environmental studies, including fish habitat assessment studies and fish mitigation design measures, as well as prepare comprehensive construction and post-effectiveness environmental monitoring programs.
In the case of the petition for drainage works in the Upper Flowing Creek area this information requested by the Rideau Valley Conservation Authority (RVCA) has been prepared by the Drainage Engineer, Robinson Consultants and sub-consultant Golder Associates Ltd. and submitted to the RVCA for review and comment. Pending RVCA approval of the comprehensive construction and post-construction monitoring program the Drainage Engineer will update and finalize the Fisheries Assessment and Habitat Mapping Report and the Engineer's Report for submission and approval to the RVCA. Pending the outcome of the RVCA review it is expected that the necessary approvals and conditional permits will be issued for the drainage works.
Once the necessary regulatory approvals have been received the Drainage Act approval process will begin involving required notifications to affected landowners and meetings before the Agriculture and Rural Affairs Committee.
There are no legal/risk management impediments to implementing any of the Recommendations arising from this report.

works will be contained in the engineer’s report when submitted to the City of
Ottawa.
