REPORT RECOMMENDATION
The Local Architectural Conservation
Advisory Committee recommends that Council approve:
1. the
demolition of 474 Bank Street, a property designated under Part V of the Ontario
Heritage Act, within the Centretown Heritage Conservation District; and
2. that
the site be graded upon the removal of the building.
Note: Approval to demolish this
property under the Ontario Heritage Act must not be construed to meet
the requirements for the issuance of a building permit.)

désignée en vertu de la partie 5 de la Loi sur le patrimoine de l’Ontario,
à l’intérieur du district de conservation du patrimoine du centre-ville; et
2. que l’emplacement soit nivelé après
l’enlèvement de l’immeuble.

The subject property is a category
four building located in the Centretown Heritage Conservation District. It was
extensively damaged by fire that destroyed the adjoining building on March 31,
2009. The portions of the building that remained after the fire have been
removed. The City has issued an “Order To Remove an Unsafe Building” (OTRUB) on
the rest of the site; however, as the building is located in a heritage
conservation district, the Ontario Heritage Act requires that the permission of
City Council be obtained prior to the issuance of a permit under the Act.
As staff has no objection to the removal of the building and does not wish to
unnecessarily delay the issuance of a demolition permit, this report was
prepared so that the Local Architectural Conservation Advisory Committee
(LACAC) could consider the application at its meeting on April 16, 2009 and
forward its recommendation directly to City Council for its meeting on April
22, 2009.
CONSULTATION
The ward Councillor and the Chair of
the Planning and Environment Committee were made aware that the application
would be considered by the LACAC on April 16, 2009 and that the report would be
sent to Council for consideration on April 22, and both concurred with the
approach being taken. The General Manager, Planning and Growth Management also
concurs.
The department notes that this
approach will apply to this property only because of the special circumstances
that have arisen due to the fire.
The application for a demolition
permit was duly submitted under the Ontario Heritage Act. The statutory
deadline for rendering a decision is July 15, 2009.

There are no financial implications associated with this
report.

Management Implications
There are no Legal/Risk Management
Implications to this report. Although it has been dealt with on an expedited
basis, the requirements of the Ontario Heritage Act have been observed.
As this report is going directly from LACAC to Council without consideration by
Planning and Environment Committee, suspension of the rules will be required.

Sally Coutts, Heritage Planner,
Infrastructure Services and Community Sustainability advised that she received
notice from the Building Services branch in the mid-afternoon that they had
received an application from the owners of the Tommy and Lefebvre building at
474 Bank Street to demolish the remaining portion of the building not destroyed
by fire on March 31, 2009. However, Ms. Coutts advised the demolition permit
could not be signed off without approval under the Ontario Heritage Act
(OHA) because the building is in a Heritage Conservation District (HCD). She
alerted Mr. Timothy Marc, Legal Services who suggested that she ask the LACAC
to consider the matter as an additional item at this meeting so it could then
be sent on to Council for consideration on April 22nd, so as to
avoid unnecessary delays for the applicant, who would otherwise have to wait
until May to have the application processed under the OHA.
She acknowledged that the department
doesn’t usually recommend the issuance of demolition permits under the OHA
until there are plans in place for a replacement building, but the City has
issued an “Order To Remove an Unsafe Building” and as the fire occurred just
three weeks ago, there has not been time for the owners to prepare plans for a
new building.
Ms. Coutts further advised that both
the ward councillor, Councillor Diane Holmes, and the Chair of the Planning and
Environment Committee (PEC), Councillor Peter Hume had been consulted, and both
concurred with the approach of by-passing the PEC so that the LACAC could
submit the recommendation directly to Council as quickly as possible. She noted
that Councillor Holmes has also requested that the site be graded after the
demolition.
Members inquired whether the plans
for the new building would have to come through the LACAC for consideration
when they are ready. Ms. Coutts confirmed that to be the case because the plans
will be subject to the OHA. Further, she noted there is a heritage overlay,
which would restrict the new building to one storey unless variances are sought
and approved. She said the demolition permit will not actually be issued until
a survey of the former building is provided so that plans for the new building
can be checked against the footprint of the old building when those plans are
brought forward.
