Committee Recommendations

 

That Council approve the construction of a retaining wall to be located within the Rideau Terrace road allowance with the following conditions:

 

1.         That the applicant provide assurances that the excavation into the road allowance be less than 300mm (depth), and no cuts will be made into the hard surfaces (e.g. roadway, or sidewalk) therefore removing the requirement for a “road cut permit”.

 

2.         That the annual fee as part of the Permanent Encroachment Agreement be waived.

 

3.         That Section 3(2) of the By-law 2003-446, as amended, be waived to permit the construction of a retaining wall within the road allowance, with a length of no more than forty two and a half feet and height not to exceed twenty four inches, subject to the following conditions:

 

a. That, before construction of the wall begins, proper plans be submitted for approval by the Deputy City manager of Public Works and Services or his delegate;

 

b. That the owner enter into the City’s standard form encroachment agreement.

Que le Conseil approuve la construction d’un mur de soutènement qui sera situé dans l’emprise routière de la voie Rideau Terrace avec les conditions suivantes :

1.         Que le demandeur fournisse l’assurance que l’excavation dans l’emprise routière sera de moins de 300 mm (en profondeur) et qu’aucune coupure ne sera faite dans les surfaces dures (p. ex., chaussée ou trottoir), éliminant par le fait même le besoin d’un « permis de terrassement de routes ».

2.         Que le droit annuel dans le cadre de la Convention d’empiètement permanent soit suspendu.

3.         Que l’on déroge à l’article 3(2) du règlement modifié 2003-446 pour permettre la construction d’un mur de soutènement, dans l’emprise routière le long de la façade de Rideau Terrace, d’une longueur d’au  plus quarante-deux pieds et demi et d’une hauteur ne devant pas excéder vingt-quatre pouces, sous réserve des conditions suivantes :

a. Qu’un plan d’implantation en bonne et due forme soit présenté pour fins d’approbation par le directeur municipal adjoint de Services et Travaux publics ou son délégué avant que la construction du mur ne débute.

b. Que le propriétaire convienne de signer le modèle de convention d’empiètement de la Ville.

BACKGROUND

 

On 17 September 2008, at a joint meeting of the Transportation and Transit Committees, the Joint Committee agreed to suspend the rules of procedure to consider an item brought forward by Councillor Legendre.  The extract of Minute, which contains the full text of the Motion, is appended as Document 1.

 

 


DISCUSSION

 

The property owner of 125 Rideau Terrace wishes to construct a retaining wall to be located within the Rideau Terrace road allowance.  He has provided assurances that the excavation into the road allowance will be less than 300mm (depth), and no cuts will be made into the hard surfaces (e.g. roadway, or sidewalk) therefore removing the requirement for a “road cut permit”.

 

It should be noted that Section 3(1) of the City of Ottawa Encroachment By-law 2003-446, as amended, provides that, “No person shall construct, erect, or alter any encroachment without first obtaining a permit in accordance with the provisions of this by-law”.  The by-law further provides that, despite section 3(1), “no person shall erect any permanent surface encroachment.

 

It is recommended that Section 3(2) of the By-law 2003-446, as amended, be waived to permit the construction of a retaining wall, within the road allowance, with a length of no more than forty two and a half feet and height not to exceed twenty four inches, subject to the conditions detailed in the recommendations.

 

 

CONSULTATION / PUBLIC NOTIFICATION

 

Surface Operations Branch

 

Assuming the waiver is approved, as part of the proponent’s final design drawings submission to the City, staff will be evaluating and determining the requirements for snow storage and maintenance.

 

 

FINANCIAL IMPLICATIONS

 

The annual encroachment fee as calculated by Traffic and Parking Operation Branch is $34.00.

Councillor Legendre explained that the homeowner at 125 Rideau Terrace would like to build a retaining wall on his property.  In support of his Motion requesting that Committee allow the construction of a retaining wall, photographs were distributed and described as follows:

Photo 1. Illustrated the property in question.  The level change between the sidewalk and the lawn results in a slope and the homeowner cannot maintain it because of salt damage to the lawn during the winter.

Photo 2. Superimposes a retaining wall onto the property to illustrate the size and position of the wall.

Photo 3. Ridgeway Park in the City of Ottawa that has a similar retaining wall.

Photos 4 & 5 Nearby properties which have retaining walls, illustrating how common a practice this is.

 

The councillor explained that while the Motion was crafted with the assistance of staff, it does not imply their full agreement.  In support of the homeowner, Councillor Legendre asked the Committee to support this request and to waive the annual fee since none of the other homeowners with retaining walls on the street are charged this yearly fee.  In order to expedite this request, he further requested that the item rise to Council next week.

 

Councillor Wilkinson was concerned that the wall is referenced as being only six inches from the sidewalk and given the problems of snow storage during the winter, wondered where the snow would be stored when plowed.  Councillor Legendre explained that the space is not to allow for snow storage, but to ensure the sidewalk plow avoids bumping into the wall.  To satisfy the councillor’s concerns, Chair McRae suggested that, in the event the item is approved and before it rises to Council, that staff could provide their feedback.  Councillor Wilkinson preferred that staff provide a memo to Council on what would be their preferred set back.  She was prepared to allow some encroachment, but did not know whether or not six inches was appropriate.  She suggested sending the appropriate direction to staff as mentioned.

 

In the absence of staff from the Surface Operations Branch, Chair McRae asked staff in the DCM’s office to confirm if they would take that direction back to SOP so that a memo is sent out which will include the preferred set-back options.  Councillor Wilkinson suggested adding particularly at the corner, since this is a corner lot.

 

Gary Craig, Manager, Strategic Initiative/BusinessPlan, explained that staff would do their best to have that information available at Council, if not before; if they are unable to meet that timeline, they would advise Council accordingly.

 

To address Councillor Wilkinson’s concerns and to avoid having to give direction to staff, Councillor Bédard suggested that the following words be deleted from the Motion:  six inches away from the sidewalk, along the Rideau Terrace frontage…”  Councillor Legendre accepted the amendment.

 

Given this amendment, Councillor Wilkinson agreed that no staff direction was required.  However, when staff are reviewing the plans, she asked that they take account of that particular question.  The Chair deemed that no direction would be given to staff.

WHEREAS Section 3(1) of the City of Ottawa Encroachment By-law 2003-446, as amended, provides that, “No person shall construct, erect, or alter any encroachment without first obtaining a permit in accordance with the provisions of this by-law”;

 

AND WHEREAS Section 3(2) of the By-law 2003-446, as amended, provides that, despite section 3(1), “no person shall erect any permanent surface encroachment;

 

AND WHEREAS the property owner of 125 Rideau Terrace, Ottawa wishes to construct a retaining wall to be located within the Rideau Terrace road allowance;

 

BE IT THEREFORE RESOLVED that the applicant provide assurances that the excavation into the road allowance be less than 300mm (depth), and no cuts will be made into the hard surfaces (e.g. roadway, or sidewalk) therefore removing the requirement for a “road cut permit”;

 

BE IT FURTHER RESOLVED that the annual fee as part of the Permanent Encroachment Agreement be waived;
